alright so I'm gonna explain to you

exactly what you were going to need as

far as the types of permits and licenses

and even business insurance to get your

food business up and running this is one
[54]
of the most frequent questions that I
[55]
get not only from my subscribers but

also my clients that I do my consulting

with and by the way really quick if you

right into it so I want to explain to

you licenses and permits so this is

something that gets kind of confusing

but I'm going to kind of break it down

for you give you some great tips on what
[83]
you might need and what you might not
[85]
need now the reason why I say you might
[87]
need this or may not is because every
[90]
state is different and the regulations
[93]
that operate in each state are in a
[96]
really quick easy way to say they vary
[98]
greatly now this is going to be
[100]
dependent highly upon where you're going
[103]
to operate the business if you're going
[104]
to be at home or in a commercial kitchen

the types of licenses and insurances and
[110]
all of the regulations that regulate
[112]
those businesses are going to vary

dramatically now I'll give you a basic
[117]
rundown of what you can expect starting
[119]
in your cottage food business so if
[122]
you're starting from home that's going
[124]
to be considered a cottage food business
[126]
now what types of permits that you need
[128]
and what type of licenses and do I have
[130]
to have food business insurance number
[132]
one in most states they will not require
[135]
you to have a business license now
[138]
that's actually something that's very
[139]
odd and it may sound like what do you
[141]
mean how could you make food from a home
[142]
and give it to people and sell it and
[143]
I'd have to have a business license this
[146]
is where you will need to do a little
[148]
bit of research and dig into the magical
[150]
Google button you need to go over to
[152]
Google and you need to type in your
[154]
state and more specifically where you
[156]
are and then from there type in cottage
[159]
food law and if it happens to be as an
[161]
example let's say Los Angeles California
[163]
type in Los Angeles California cottage
[166]
food law and there will be some
[168]
resources that will pop up before your
[170]
state specifically and you can click on
[172]
those links and most of them are state
[173]
websites
[174]
that are going to show you exactly what
[176]
would be needed in order for you to get
[178]
started now what can you expect if you
[181]
do start from home some of the permits
[184]
are as follows
[185]
they're going to require to have a
[187]
business license in essence you are
[189]
actually operating a business from home
[191]
it is a food based business but it still
[193]
is a business now my recommendation in
[196]
some states that do not require it by
[199]
law I would highly recommend that you
[201]
incorporate yourself as a business
[203]
though reason being is that you want to
[205]
protect your assets if you have a home
[208]
and you were producing a baked good and
[210]
you take it to a farmers market and
[211]
somebody gets sick and they sue you you
[214]
could lose your house and your car and
[215]
your savings and everything you own that
[218]
potentially could happen now if you
[221]
create a business and you incorporate
[223]
yourself and you get food business
[225]
insurance to cover the production of the
[227]
food that you make you are going to set
[229]
yourself up for success because I don't
[232]
wish this upon anybody but if it happens
[234]
and somebody gets sick and they have the
[236]
potential to sue you well that's going
[238]
to cause a big big problem for you okay
[241]
so get yourself incorporated and get
[244]
yourself some insurance to separate you
[246]
from your business now also working from
[249]
home in some states you may be on a well
[252]
may be the water that comes into your
[254]
home actually comes from a well on your
[256]
property that actually has to be
[258]
examined by the county now again the
[262]
county and cities they operate under
[263]
different ordinances that they have
[265]
established based upon the rules they
[268]
set up that has nothing to do with the
[269]
state but it has to do with the
[272]
municipalities and the local laws that
[274]
are regulating home-based businesses so
[277]
there is a difference between that make
[279]
sure you understand that and you if you
[281]
Robert you know from a home that has
[283]
well water as opposed to city water the
[285]
well water will have to be checked a
[287]
checked and analyzed now that actually
[290]
cost something normally because that's
[292]
not a free service and you'll have to
[293]
pay to have that analyzed if you are on
[295]
a well so keep that in mind if you are
[298]
on a septic tank and you're not on well
[300]
sitting water as far as using a septic
[302]
tank which are two different things you
[304]
then also need to have that looked at to
[306]
make sure that it's functioning properly
[308]
because you will be operating a food
[309]
business from your home so your water
[311]
usage goes up that is another permit
[315]
that you may potentially have to pay for
[317]
to have someone inspect your septic tank
[319]
okay
[320]
now every state does not require this
[324]
but some states do and it's called a
[326]
food handlers license
[327]
food handlers course and 99% of the time
[330]
in nowadays you can actually take that
[332]
course online now food handlers license
[335]
is basically a basic educational program
[338]
that will explain to you how to handle
[341]
food in a safe and sanitized way making
[344]
sure that you understand how it works
[346]
and how to clean up after yourself some
[348]
states require that and then some states
[351]
do not again this is where the magical
[353]
Google button comes into play and you
[355]
need to find out specifically for your
[358]
county and city and state if they
[360]
require that okay now next up is as I
[363]
mentioned briefly a little while ago is
[365]
business insurance now again if you're
[367]
producing a food product where someone
[369]
can potentially get sick and sue you you
[372]
want to make sure that you're covered
[374]
and separating yourself from your
[376]
business entity from your personal
[378]
possessions and assets how do you do
[380]
that
[381]
is this insurance this is insurance this
[384]
means that you can actually get a policy
[386]
to protect the food production that is
[388]
going on on your home in your property
[390]
that you're going to sell it farmers
[392]
markets or wherever it may be no Danny
[395]
and how much does that cost well on an
[398]
average a food business policy can range
[400]
greatly from 300 to even up to a
[403]
thousand dollars but normally the middle
[406]
price the median is about five hundred
[408]
to six hundred dollars a year you're
[409]
probably thinking oh my god that's a lot
[411]
of money well it's really not when you
[413]
break it up over 12 months normally the
[415]
the payment is a monthly payment not a
[417]
upfront payment and it can run about
[420]
forty to fifty dollars a month give or
[422]
take okay and that's really not a lot
[423]
you could go to a farmers market on a
[425]
weekend and sell a few hundred dollars
[426]
and you've already covered your entire
[428]
you know months worth of insurance right
[430]
off of the mat so next up is doing
[434]
business as or a DBA now a DBA is going
[439]
to allow you to set up a business
[441]
under a name that doing business as
[444]
let's say Sara's chocolates something to
[448]
that effect you can do that so you can
[449]
establish your business some states
[451]
require a DBA
[453]
and other states don't so again this is
[455]
going to be something that you need to
[456]
Google just to find out for sure if it
[459]
is something that's required now many
[461]
many states don't require it if you're
[463]
going to incorporate as a business you
[464]
can create a business name for yourself
[466]
and not necessarily have to create kind
[468]
of a fictitious name or DBA
[470]
okay the next thing up is a resale
[473]
license now if you are going to a store
[476]
and you're gonna buy flour and sugar and
[478]
a whole bunch of baked good stuff and
[479]
you create a baked good item you want to
[481]
make sure that you get a resale license
[483]
because that's going to allow you to buy
[485]
ingredients in bulk and wholesale
[487]
pricing etc etc and that is something
[489]
that a lot of people don't think about
[491]
getting now normally to my understanding
[492]
the resale license may cost very very
[495]
little if any probably about 40 to 50
[497]
bucks
[498]
most of the licenses and the things that
[500]
I'm explaining to you are very
[501]
inexpensive except for when you file
[504]
papers of incorporation now when you
[506]
want to incorporate yourself in your
[508]
food business as I really really
[509]
recommend that could be a couple hundred
[512]
dollars to maybe three or four or five
[514]
hundred bucks okay I don't know I've
[516]
ever seen it go too high as far as 500
[518]
or 400 but every state is different and
[521]
you have a lawyer do it for you and
[522]
there's some other companies that come
[524]
into play it might run that high when I
[526]
got incorporated I think it was about
[528]
300 bucks wasn't very expensive no the
[532]
last thing you want to also have and
[534]
potentially need to have based on your
[536]
state requirements is going to be a
[538]
sales tax certificate certification it's
[542]
a certificate that allows you on behalf
[544]
of the state if you're selling products
[546]
within the state you have to collect
[548]
sales tax and then give it to the state
[550]
that's normally done where you can file
[552]
it either quarterly which means every
[554]
three months or you can just do it one
[557]
time a year and it depends on the state
[558]
and how they choose to have you clad if
[562]
it's classified okay
[563]
so you want to check with your state and
[564]
say look is this something that I'm not
[566]
going to be collecting a lot of sales
[567]
tax because I'm not making a lot of
[569]
sales just yet can I do it annually
[571]
instead of every quarter we actually
[573]
started when we just started we were
[575]
the quarterly schedule so every three
[577]
months we did it but now we're at the
[578]
point where we're selling so much that
[580]
we just do it once a year that's one big
[581]
lump sum so keep in mind again what I
[585]
just told you are some some permits and
[588]
licenses and such that may be required
[591]
by your state you just got to do a
[593]
little bit of homework and double-check
[594]
on that but those variety of things are
[597]
going to be the things that come into
[598]
play when you start a food business from
[600]
home now
[601]
the next one up is going to be if you
[604]
are in a commercial facility now this
[606]
changes the ballgame dramatically to be
[608]
honest with you there's a lot of other
[610]
types of licenses and permits and even
[613]
inspections when you begin to get into a
[615]
commercial facility now to save yourself
[618]
the headache from having to go through
[619]
all of that you can actually just rent a
[621]
commercial kitchen that you don't own
[623]
but you're actually just using the space
[626]
and the equipment to create your food
[628]
product and then get it out there to the
[630]
public
[631]
I personally when you're starting off
[632]
don't recommend you diving into renting
[636]
a huge building or warehouse and start
[638]
putting up freezers and coolers and
[639]
tables unless you've got about two or
[641]
three hundred grand in the bank and you
[643]
have nothing to do with it you can go
[645]
ahead and do that and open one up and
[646]
even if you did have that much money if
[648]
you've never experienced a food business
[650]
or you're not familiar with how to grow
[652]
a food business compared to others that
[655]
may be a huge waste of money so start
[658]
small always think big but take really
[660]
small steps and figure out if it's
[662]
really something that you want to do
[663]
commercial kitchens are great because
[666]
they've already established all of those
[668]
licenses and other things the only thing
[670]
that I would still recommend that you do
[672]
even if it's not required by your state
[674]
is still incorporate yourself as a
[676]
business don't be doing this just as
[677]
something on the side that you're not
[679]
getting yourself covered with insurance
[681]
or making yourself completely legal as a
[683]
business incorporate yourself get
[686]
yourself the food business insurance
[687]
make sure you cover yourself and then
[690]
move forward with your plans to create
[692]
your food product okay always want to
[694]
protect yourself from the personal
[696]
aspect you don't want to lose your house
[698]
and there's everything you've worked
[699]
hard for all your entire life just
[701]
because you didn't file papers on a
[702]
corporation or you didn't get food
[704]
business insurance because you thought
[706]
you couldn't afford it so you rented a
[707]
commercial kitchen and then you got in
[708]
trouble so
[709]
make sure you do that and in some states
[712]
that I've actually worked with I've
[713]
actually called and spoke with a handful
[715]
of commercial kitchens to get a feel for
[717]
how they worked in other states many of
[719]
them actually require you to be a
[721]
incorporation or be incorporated and you
[724]
could do that just through a basic LLC
[725]
you don't have to be a c-- corporate or
[727]
but that is your your choice and your
[729]
preference but making sure that you also
[731]
have food business insurance is
[733]
something that a lot of commercial
[735]
kitchens require or they'll request to
[737]
see documentation proving that you're
[739]
insured just to cover yourself so would
[742]
that be instead I like to keep my videos
[744]
short and sweet and kind of make sure I

compact all of this information together
