Welcome back! In today's episode, we're going聽 to talk about the 1099-NEC form. Chances are, if聽聽
[69]
you're a business owner and you have independent聽 contractors, that you pay or vendors that you pay,聽聽
[75]
every year you have to pay that, you have to聽 issue them what's called the 1099-MISC form,聽聽
[81]
or if you are a freelancer, you're most聽 likely have received these 1099-MISC聽聽
[87]
forms. And the purpose of the 1099-MISC form聽 is to show to the IRS either that you've paid聽聽
[93]
someone a certain amount of money and then聽 if you are a recipient of a 1099-MISC form,聽聽
[99]
is to show the IRS that now you've earned聽 this money and that you have to pay tax on it.聽聽

So, in today's episode we're going to cover聽 the new form 1099-NEC, and how it replaces the聽聽
[111]
previous 1099-MISC. So, we're going to cover what聽 the two differences are between the two forms,聽聽

we're also going to cover what the聽 threshold is for filing the new 1099-NEC,聽聽

and we're going to talk about when the聽 due date is for actually filing the 1099s,聽聽

and then lastly, we're going to talk聽 about some of the exemptions, basically聽聽

what are some instances where you don't have to聽 file a 1099, even if you're above that threshold.聽

So, what is the new 1099-NEC form, and how聽 does it differ from the 1099-MISC form?聽
[147]
Now, NEC stands for non-employee compensation.聽 This is a new form that the IRS has聽聽
[153]
changed for 2020, which is due in 2021,聽 and it replaces a Miscellaneous form聽聽
[160]
only for non-employee compensation, and the purpose of the form is that you're聽聽
[165]
reporting to the IRS, that you paid someone聽 a certain amount of money, and so the IRS can聽聽
[171]
cross-check that person's tax record to make sure聽 that they are also reporting that income to ensure聽聽
[177]
that proper taxes are paid for that individual.聽 Now, the 1099-MISC form isn't going away,聽聽
[185]
it's just being used for other payments. So, if you have non-employee compensation,聽聽
[190]
you issue them a 1099-NEC, but if you're paying聽 rent to someone, royalties, prize money, health聽聽
[200]
care payments, payments to an attorney, or other聽 income, you will continue to use the 1099-MISC.聽聽

So, again, the 1099-NEC is only for independent聽 contractors that you pay, you would only use聽聽
[215]
that form for those payments. So, what is the聽 threshold, and what are the due dates for the聽聽
[220]
1099-NEC? The threshold depends on the nature of聽 the payment. It's $600 for any payment other than聽聽
[228]
interest and royalties. For interest and royalties聽 the threshold is $10 and for any other payments聽聽
[236]
is $600. So, for example, if you paid a contractor聽 $600 or more, you would have to file the 1099-NEC.聽聽

However, if you paid someone interest or royalties聽 of $10 or more, then the threshold as you can see聽聽
[250]
falls below that $600, and you'd have to file a聽 1099. The due date is February 1 of 2021. So, it's聽聽
[258]
coming up relatively soon, and it's right after聽 the New Year. So, you have to actually file these聽聽
[263]
with the IRS by February 1 of 2021, to ensure the聽 individual receives that 1099-NEC. So, are there聽聽
[271]
any exceptions to filing the 1099-NEC form? And the answer is - Yes! It depends,聽聽
[277]
if you're paying a corporation including an LLC,聽 taxes as a C corporation, or an S corporation,聽聽
[284]
or rents paid to a real estate agent, or a聽 property manager, those are exempt from filing聽聽
[290]
a 1099-NEC. However, I would still recommend聽 preemptively filing one anyway just in case.聽聽

There's also exceptions to the exception.聽 So, for example, if you pay an attorney,聽聽
[301]
even if they are a corporation, a C-corp, or an聽 S-corp, you still have to file a 1099, regardless聽聽
[308]
of the income. The other is, if you have medical聽 payments that you pay to a health care company,聽聽
[314]
those are also still reportable, even if聽 that is a corporation. So, in closing,聽聽
[319]
the process for filing 1099s in 2020 or for 2020,聽 is completely different than in prior years.聽

If you have non-employee compensation that you聽 have paid, the new form you have to use is a聽聽
[332]
1099-NEC, you can no longer use the 1099-MISC.聽 However, if it's any other type of payment, then聽聽
[339]
you can continue to use the 1099-MISC form. As聽 you can see, which form to use and when to file,聽聽
[347]
it is very important. So, it's important聽 to contact your CPA or work with a CPA,聽聽
[353]
who fully understands which form you need to聽 file, and the deadline for filing those forms,聽聽
[359]
because, if you don't file the forms on time,聽 then you're going to face stiff penalties,聽聽
[363]
based on the dollar amount and the length聽 of time, that you do not file that form.
