[0]
comment on that now we know that justice
[3]
barrett's
[4]
previous record in public statements
[6]
indicate
[7]
she would vote to strike down the aca
[11]
and protections for millions of
[13]
americans and
[14]
overturn roe protections for women
[18]
nothing in her opening statement allays
[21]
those concerns nothing in her opening
[23]
statement allays the concerns america
[26]
has
[26]
that she will overturn aca
[30]
and hurt people's health care and she
[32]
will act
[33]
to undo roe v wade so a vote for judge
[36]
barrett is very simple
[38]
it's a vote to take health care away
[39]
from 20 million americans
[41]
it's a vote to strip protections from
[44]
over 130 american exist
[47]
americans with pre-existing conditions
[49]
and it's a vote to vastly curtail
[52]
a women's productive freedom ultimately
[54]
it's a vote for an activist judge
[57]
whose mission whose mission will be to
[59]
implement a deeply unpopular
[62]
hard right republican agenda
[65]
that will undercut the rights and safety
[67]
of americans
[70]
now
[74]
okay now let's go to the um
[78]
issue at hand recusal
[82]
130 million did i say it wrong
[86]
okay so we know that
[89]
a vote for judge barrett and her
[91]
statement does
[92]
nothing to allay those concerns will be
[95]
a vote to strip protections from over
[97]
130 million americans
[100]
who have pre-existing conditions strip
[103]
health care from 20 million americans
[105]
raise medicare drug prices for over 40
[109]
million seniors
[110]
that's what it will do okay now let's go
[112]
to the issue of
[114]
recusal which i will
[117]
since i change the order around here
[121]
okay well we all know that the hearing
[125]
for judge
[126]
amy coney barrett to the highest court
[128]
in the land the supreme court begins
[130]
tomorrow but this is a moment unlike
[134]
any other because this nominee comes
[137]
before us
[138]
with serious conflicts of interest
[141]
and we're here today to say that given
[145]
judge barrett's conflicts of interest
[148]
she should recuse herself
[150]
from any decision involving the
[153]
affordable care act
[154]
and its protections and any decision
[158]
related to the election that we will
[160]
have on november third
[163]
let me um let me go for
[167]
through those things what we know about
[170]
judge barrett two things among the slew
[172]
of the others stand out
[174]
first she has clearly said she'd strike
[176]
down the affordable care act
[178]
and is delivered that has delivered
[180]
quality
[181]
and affordable health care to millions
[183]
of americans
[185]
second president trump has said that he
[188]
needs to put her on the high
[190]
court to possibly help him win
[193]
reelection in suits that would come
[195]
before the court after november third
[199]
with these serious conflicts judge
[201]
barrett should immediately do the bare
[203]
minimum
[204]
and pledge to recuse herself from the
[207]
decisions involving the aca
[209]
and the 2020 elections in november
[213]
i believe it is november 10th the court
[216]
will hear all
[217]
oral arguments in a challenge to row in
[220]
a challenge rather
[221]
to the aca this is much too low mike
[224]
can we make it a little higher
[233]
okay yep that's good okay
[237]
so on november 10th the court is going
[239]
to hear arguments about whether the aca
[242]
with all its protections is
[243]
unconstitutional
[245]
unfortunately the trump justice
[247]
department republican appointed lower
[249]
court judges
[250]
have sided with this republican attorney
[253]
general argument
[255]
to end aca and strip away health care
[257]
and pre-existing condition protections
[260]
for tens of millions of americans
[263]
president trump's self-imposed litmus
[265]
test and judge
[267]
barrett's own past statements
[269]
criticizing the law and the court's
[271]
decisions as to whether
[273]
raise serious questions as to whether
[275]
she can rule fairly at all
[277]
for that reason judge barrett should
[280]
pledge to recuse herself
[282]
from the case involving aca a week after
[285]
the election
[286]
if she is confirmed judge barrett's
[289]
record on
[290]
aca is filled with evidence
[292]
demonstrating the need for recusal
[294]
in a 2017 law review article she
[297]
suggested
[298]
she reviewed the ill as illegitimate
[302]
the supreme court decision that upheld
[305]
large portions of the aca
[307]
she directly criticized justice roberts
[311]
in 2015 she criticized the court's
[314]
decision in king v
[315]
burwell in which it affirmed the aca tax
[318]
credits for millions of families
[320]
she praised the dissent which would have
[322]
resulted in catastrophe
[325]
for millions of americans and
[328]
the views reflected that she would favor
[333]
eliminating the aca strongly so she
[336]
doesn't come unbiased
[338]
and that's why she should recuse herself
[341]
and
[341]
it's no surprise that president trump is
[344]
looking
[345]
to rush this nomination through
[348]
to the highest court in the land because
[350]
based on her record it's clear
[352]
that judge barrett has passed the trump
[354]
litmus test
[356]
which is he only will appoint justices
[358]
who will repeal the aca
[360]
only appoint them and it appears also
[364]
the president thinks judge barrage
[366]
would support him should the 2020
[368]
election become
[370]
contested in the high court he has said
[373]
that i think this will end up in the
[375]
supreme court
[376]
and the president's all but shouting
[378]
from the rooftops that he needs judge
[380]
barrett
[381]
on the court for his own self-interest
[383]
this statement alone
[385]
and the possible confirmation of judge
[388]
barrett signaled a dire need for recusal
[390]
because it is blatantly political so
[393]
here's what the president said on 2020
[395]
election
[396]
just in case it would be more political
[399]
than it should be it's very important to
[401]
have the ninth justice
[402]
he didn't care when merrick garland was
[404]
there that there were only eight
[405]
justices
[406]
but of course he cares now so the bottom
[409]
line is very simple there's only one
[412]
one conclusion when it comes to justice
[415]
barrett
[418]
in regard it's clear there's only one
[421]
conclusion
[422]
when it comes to justice barrett in
[425]
regards to
[426]
her voting on repealing aca
[429]
and on deciding the legitimacy of the
[431]
presidential election
[433]
recusal recuse this is what she should
[437]
do
[437]
there is no question about it here's
[440]
what it says
[441]
to disqualify oneself as a judge in a
[443]
particular case
[445]
that's what she should do and i believe
[448]
that's what the canons of ethics and all
[450]
the other legal writings would call for
[453]
okay
[460]
right the process is already a
[462]
legitimate dangerous and unpopular
[465]
all the more reason she should be
[467]
recused she's being rushed through
[471]
to decide decisions that she's already
[473]
seems to have made up her mind on
[476]
okay questions on this subject
[488]
well they're going to the hearing and i
[491]
will say this
[492]
democrat we will talk about when the
[494]
actual vote occurs in committee
[497]
and on the floor democrats will not
[500]
not supply the quorum period
[512]
don't know okay thank you everybody
[515]
you're all close together now i'll come
[516]
talk to the people from the hotel
[520]
thank you
[528]
here good rochelle what yes thank you so
[532]
much
