And now after the closing, she refuses to let聽 him sign anything that acknowledges my money聽聽

that I gave them for their new home. She says it聽 was a gift and that they reported the money as a聽聽

gift to their mortgage company. I am so angry and聽 so concerned about my money. What can I do here聽聽

Yeah, it's really unfortunate.聽 I do want to, you know,聽聽

I'm going to keep going back to that聽 earlier question about like the attorney聽聽

and free consultations. Here's an example that聽 like, if somebody called me with that question,聽聽

you know, I would, of course be very empathetic,聽 but at the same time, I'd have to say,聽聽

Hey, can you do me a favor? We're going to need to聽 see the documents that were signed and we're going聽聽

to need to see the information, you know, showing聽 me that you conveyed the 75,000. How was it聽聽

conveyed? Was it a deed? Was it wired? Did you put聽 a memo in the memo? Did you write the word gift?聽聽

Did you give a gift letter to the mortgage聽 company? I mean, there's all these questions聽聽

I have, but in general, let's, let's just聽 hypothetically say that pretend that she never聽聽

Okay. And they had an agreement between each聽 the family members. Hey, I'm going to give聽聽

you the 75 as a down payment. If there's no gift聽 letter, if there's nothing, that references gift.聽聽

But there's conversation, there's聽 something called promissory estoppel or聽聽

yeah, promissory estoppel where the聽 family moved forward and took the 75,000.聽聽

And so it's evidencing some type of arrangement聽 between the parties. So I believe, you know, if聽聽

she says I gave the 75, it wasn't supposed to be聽 a gift. It was alone. Okay. If I can show the wire聽聽

and I can show the 75 and I don't say anything聽 about a gift letter, I'm going to assume that that聽聽

is most likely true than the other thing is to聽 to this question, which was that the wife doesn't聽聽

want this or this lady's son to sign anything. Speaker 2: 聽

Well, that's a problem. Okay. because there's two聽 people on that deed and she has certain rights聽聽

this, the, the daughter-in-law sounds like he has聽 certain rights. She doesn't have to be compelled聽聽

initially to sign over like a deed or some type聽 of acknowledgement of this lady's interest.聽聽

Here's the thing. It sounds, you know, I I'd聽 like to know the attorney who reviewed their聽聽

documents before they closed on this property.聽 I have a feeling there was no attorney. Okay.聽聽

the other thing is, you know, it does happen lot聽 in family situations where people want to be good聽聽

to their family members. They want to help their聽 children. You know, I wrote a book called shady.聽聽

It's about doing business with family and friends聽 and how to protect yourself. And this is a perfect聽聽

example of what you need to do when you're about聽 to allocate huge sums of money to help your family聽聽

members, whether it be for a business or home,聽 or what have you, you need to have the, you know,聽聽

Okay. So in the end, I'm kind of聽 getting off topic a little bit聽聽

but she does have rights. We just have to see聽 how she signed the paperwork. I also want to聽聽

suggest that this daughter-in-law's said something聽 about that the money was a gift and they made a聽聽

statement to the bank that there was a gift it's聽 problematic because if there's a gift letter,聽聽

usually these gift letters that banks use聽 have some language in there that says, Hey,聽聽

this is a gift letter. We're relying on you not聽 to have to come back against the borrowers because聽聽

we're making a loan to these borrowers. And we're聽 going to assume that they don't have to pay any聽聽

And so the bank is kind of聽 relying on that letter as well.聽聽

you know, you're, you're only so financeable, and聽 perhaps the reason why they needed that 75,000 I'm聽聽

just speculating is because they weren't financial聽 above and beyond. So that, that, that would be a聽聽

I, you know, Blair just like the mechanics of, of聽 doing intake and dealing with people with these聽聽

type of issues is we would want to see a complete聽 loan package, a closing package I'd want to see聽聽

the transaction, how the closing settlement聽 statement, I'd also want to see any emails聽聽

taxed or anything like that, because you'd聽 be shocked. I mean, we've gone in many cases聽聽

where we're going down one route, and then聽 all of a sudden we get a text we find in that聽聽

has some language in there that changes the whole聽 case. In fact, it's happened twice in the past.聽聽

Today's only Monday, but last week, well, no last聽 week it happened twice to us where, you know, it's聽聽

constantly litigation, you know, one minute you're聽 up at the next minute you're down. And, you know,聽聽

we have, we have so many instances where just one聽 tax will completely change the outcome of a case.聽聽

So I'll tell this lady not to despair, but聽 it's too soon to speculate what she hasn't,聽聽

unless we saw the paperwork. But yeah, there聽 are things that we can do to help protect聽聽
