So guys, these new rules say
[35]
that GST will be levied on residential properties also
[37]
are effective from 18th July 2022
[39]
But before understanding these new rules
[41]
you have to understand the existing rules
[42]
That means those rules that were applicable till June
[44]
Till now GST was not levied on residential properties
[48]
Whether the landlord was GST registered or not
[50]
Or whether the tenant was GST registered or not
[53]
So till now, GST was only levied on commercial properties
[56]
It will still be taxed,
[57]
It is not like GST will not be
levied on commercial properties
[59]
"Current rules are still applicable."
[62]
So when is GST levied on a commercial property?
[65]
It is levied when the landlord is GST registered.
[68]
And when GST registration
becomes compulsory for the landlord?
[72]
If their turnover is more than Rs.20 lakhs
[74]
If they are providing services
[76]
If their total income including rent is more than Rs.20 lakhs
[81]
Then they have to take GST registration
[83]
Or if they have Goods business
[87]
In that case, if their turnover is more than Rs.40 lakhs
[90]
Then they have to take GST registration
[92]
This value is a little less for the North Eastern States
[95]
If the services turnover is more than Rs.10 lakhs
[97]
Then they have to take GST registration
[99]
Or if the goods turnover is more than Rs.20 lakhs
[102]
Then they have to take GST registration
[103]
So, if any landlord is GST registered
[106]
And they have given commercial property for rent
[108]
Then they will charge GST to the tenant
[111]
Whether the tenant is GST registered or not.
[114]
He has to pay the GST
[116]
And 18% GST is levied on rent
[119]
So we've talked about
commercial properties & existing rules.
[122]
Now let's talk about,
[123]
How will residential properties be taxed with GST?
[126]
Firstly it doesn't matter whether
the landlord is GST registered or not
[131]
If the tenant is GST registered
[134]
Then he/she has to pay GST
[136]
The payment of GST
[138]
is according to the Reverse Charge Mechanism.
[140]
That means the tenant will pay
the GST directly to the government.
[142]
He will not pay the GST to the landlord
[144]
But some people may have a doubt here that,
[146]
All the salaried people who take
a home or any property on rent
[151]
Or any residential property
[153]
Will they have to pay the GST?
[155]
So let me clarify here
[156]
That salaried class don't have to pay GST
[159]
Only those who are GST registered
[161]
Only they have to pay GST
[163]
But who are GST registered?
[165]
We've already talked about this
[166]
Those who have business income
& are above the threshold
[169]
GST registration is compulsory for them
[171]
So the big question is,
[173]
Who all will get affected by these new rules?
[176]
For example, many companies take guest houses for rent
[180]
They have to pay the GST on this rent
[182]
Or if any company is taking any residential property
[185]
Even if for their employees
[187]
Then they have to pay GST on rent
[189]
But if the employee directly takes that property on rent
[193]
Then that employee doesn't have to pay GST on rent
[195]
But as the company is GST registered
[198]
So they have to pay the GST
[200]
You might have seen in many residential properties
[202]
There are small shops or businesses
[206]
Someone may have shops on the ground floor & people are living above
[209]
In such cases where any business is operating
[212]
And if the tenant is GST registered
[215]
Then they have to pay the GST
[217]
Or if there is any online creator
[219]
If they have taken a flat on rent
[221]
And they shoot their videos there
[223]
And if they are GST registered
[225]
Then they also have to pay GST.
[227]
Other than these, there are many business professionals
[229]
Like CAs, Architects, Lawyers
[231]
Or any business consultant
[233]
If they are operating from any rented residential property
[237]
And if they are GST registered
[238]
Then they have to pay GST.
[241]
Many people operate through
such rented residential properties
[245]
Who were not in the ambit of GST till now
[248]
Because many landlords are not GST registered
[251]
As they might not have that much rental income
[254]
Or business income
[255]
So in short, if any GST-registered person
[259]
Has taken any residential property on rent
[262]
Then they have to pay the GST
[264]
In your situation, is the GST applicable for you or not?
[267]
Consult your CA or Tax consultant about that
[271]
I think these new rules can affect many people
[274]
And might be relevant to many people

[279]
If you think these new rules might affect someone
[282]
Then do tell them
[283]
Because GST applicability has been immediately done
[286]
And they have to pay GST
[288]
If they have taken any residential property on rent
[291]
And if they have a GST registration.
