licensed to practice law in California as well as聽 New York. In this video we're going to go over a聽聽

California-specific form and it's specifically a聽 proof of service unique to California family law聽聽
[29]
cases. It's the form FL-335 proof of service by mail.聽 So a proof of service, if you've never kind of dealt聽聽
[37]
with one or kind of seen one, uh, a proof of service is聽 basically a receipt showing that a particular聽聽
[44]
document was sent from one party to another, or聽 from one party to the court, etc. So a proof聽聽
[49]
of service is very, very important to fill out聽 because it's sort of a trail about what documents聽聽
[53]
were delivered to who when. And as you can probably聽 imagine in court, if you've ever been to court, or聽聽
[58]
if you're, you know, if you found this video you're聽 probably involved in a court case right now, dates,聽聽
[63]
you know, you know, when stuff was sent to who and stuff,聽 that can actually be very, very important because,聽聽
[68]
in law, there's a lot of, like, fixed deadlines, like聽 30 days to do this, two weeks to do this, etc.聽聽

So dates, very, very important. In traveling the聽 kind of like northern part of California, I guess,聽聽

doing family law cases in various counties, what聽 I've noticed is that a lot of people, particularly聽聽
[85]
if they're doing it themselves, actually, especially聽 if they're doing their family law case themselves,聽聽
[89]
they often don't know how to fill out a proof of聽 service, where to get it, why it's important, etc. So聽聽

hopefully this video is going to go over all those聽 questions for you, so if you have a family law case聽聽
[100]
of your own that you're dealing with, hopefully聽 after seeing this video, you'll know why the proof聽聽
[104]
of service is so important. So the FL-335聽 form, which I'm going to go over here, the proof of聽聽
[109]
service by mail, also has a counterpart. It's the聽 form FL-330. That's proof of service聽聽

by personal service. The forms are very, very similar. I'm going to shoot a companion video to this one聽聽

in which I go over the form 330 the personal聽 service one, but the forms are very, very similar so,聽聽

you know, if you see this video and you see and you look at the other one, you'll kind of realize聽聽

that both of them are kind of same so, but some people want the聽335, the, the mail one, and then some people need聽聽

the 330, the personal one. I'm going to聽 go ahead and shoot them both. So anyway, that聽聽

said, that's kind of the introduction, I guess.聽 So as you can probably imagine, these forms are

probably going to be on the computer for the聽 most part. So if you guys will hop online with 聽

me right now, I will show you how to fill it out.聽 You can always fill these forms out by hand, but I聽聽

personally type everything that I send to court聽 because they're, I kind of know that my handwriting聽聽

is kind of bad, but yeah, so, guys, hop online聽 with me right now and I will show you how to do聽聽

it. Okay everybody, welcome to the form FL-335 proof聽 of service by mail for California family law cases.聽聽

As I described in the intro video, there is also a聽 companion form to this for personal service, it's聽聽

the form FL-330 and I have a video on that聽 as well. So that said, this stuff right here should聽聽

actually look fairly familiar to you if you have聽 seen any of my other videos or have filled out聽聽
[195]
any other court forms before. So I'm gonna go聽 over this quickly. Name and mailing address of聽聽
[203]
either the attorney who represents you or your聽 information if you don't have an attorney. Name,聽聽
[207]
mailing address, phone number goes there. If you聽 have a fax, go ahead and put it down if you want聽聽

the court to fax you anything, I suppose. I聽 usually don't put down my fax number here. There's聽聽
[217]
no point because it's, you know, optional anyway,聽 but fax number, email address, if you want to put聽聽
[224]
that down, again it's also optional, but if you have聽 an attorney, your name should go here. If you don't聽聽
[229]
have an attorney, you can put down here "in pro per"聽 which is actually just a fancy way of saying that聽聽
[236]
you're representing yourself. So over here in the聽 next kind of area, right here, this is where you聽聽
[245]
need to put down the address of the courthouse聽 where your case is. You need to indicate the聽聽
[250]
county, first of all, so right there, but as long聽 as you have the address number, the street name,聽聽
[255]
the city, state, and zip code for the courthouse,聽 you should be fine. And next, right here, this is聽聽
[263]
where you identify the parties. So the plaintiff聽 or the defendant, petitioner, respondent, whoever聽聽
[268]
it is, put them in the appropriate box. So plaintiff聽 goes there, defendant goes here. If there is a third-聽聽
[275]
party involved in your case for some reason -- most聽 often it is the county department of child support --聽聽
[280]
you can go ahead and put them there as well. So聽 over here on the right, case number. If you're聽聽
[286]
looking at this video, hopefully you know what your聽 case number is or you have a good idea of where聽聽
[290]
you can go get that information. Case numbering聽 is not kind of uniform or standardized throughout聽聽
[296]
California so each county does it differently. Over聽 here if you know, if you, whatever it is that you're聽聽
[302]
serving is related to a hearing that is upcoming,聽 I would go ahead and put the date of that hearing,聽聽
[308]
the time, and the courtroom or Department. Having聽 that information sometimes can be helpful, but if聽聽
[314]
you don't know what it is or if it doesn't apply聽 to your situation, you can go ahead and leave this聽聽
[318]
blank. So that said, this is like the standard聽 stuff on every or almost every California聽聽
[325]
court form so hopefully this is not new to any聽 of you. So moving on, there are certain things in聽聽
[333]
California that by law have to be served in person.聽 So temporary restraining orders are one of those聽聽
[339]
things so if you actually are trying to serve a聽 temporary resorting, restraining order by mail, you聽聽
[344]
actually can't. So don't use this form. Go ahead聽 and use the form 330, like I said, I have聽聽
[349]
a companion video detailing how to fill in that聽 form. So, the next part actually is where a lot of聽聽
[357]
people have problems and it's, I guess, it's like聽 a misunderstanding type of thing. So in order to聽聽
[363]
serve documents in a legal case, you generally聽 have to satisfy three criteria. So the first is聽聽
[368]
that you have to be at least 18 years old. That's聽 usually not a problem. I've never run into a case聽聽
[373]
where a child was trying to serve something.聽 So number three, I guess, is that you have to聽聽
[378]
be a resident or employed in the county where the聽 mailing took place. Generally this isn't a problem聽聽
[383]
either. The problem usually is this one - so not a聽 party to the action or case. A lot of times people聽聽
[391]
have never been to court before, they've never,聽 you know, had to, you know, sue somebody before,聽聽
[395]
etc., so they don't really understand that, you know,聽 they can't serve papers themselves. So plaintiffs聽聽
[401]
cannot serve defendants, defendants cannot serve plaintiffs, etc. Yeah, that's usually the biggest聽聽
[408]
stumbling block. So the thing is, I usually take a聽 much broader view and I say "okay, the plaintiff's聽聽
[413]
spouse can't serve either, the plaintiff's children聽 can't serve, the plaintiff's parents can't serve, etc.,聽聽
[419]
etc. I usually get somebody who is not related聽 to the parties at all by blood, marriage, etc. to聽聽
[427]
actually do the service. That's usually the safest聽 thing and generally people like that are not too聽聽
[431]
terribly hard to find with a little bit of effort.聽 So that said, next part here is whoever actually聽聽
[438]
does the service, they need to put down a mailing聽 address that they can be reached at. So I mean, it聽聽
[444]
says residence and, and/or business, but, you know,聽 some people don't want to put down their residence聽聽
[449]
address, some people don't want to get court papers聽 at their work because, like, you know, it begets a聽聽
[455]
lot of rumors and stuff. So as long as you put down聽 a mailing address here that you, the person who did聽聽
[460]
the service, can be contacted at later if need聽 be, that's generally sufficient. So, next part I聽聽
[468]
personally think is the most important part of the聽 document and it's where you actually put down the聽聽
[472]
description of what it was that you served. So my聽 recommendation here is to put down something that聽聽
[477]
is sufficiently detailed where several months聽 down the road or maybe a year later when you聽聽
[483]
look at this document, you can read whatever it was聽 that you typed here and instantly sort of remember聽聽
[489]
what it was. So the thing is if you just put down聽 something general where it's like, you know, "letter聽聽
[493]
to opposing party," I mean, unless your memory is聽 way better than mine, I personally would not be聽聽
[499]
able to remember what "letter to opposing party"聽 meant. So I usually will put down dates, names, etc,聽聽
[507]
to kind of, you know, make it, make the description聽 more specific. So the next part, most people who do聽聽
[514]
proofs, or who do proofs a service like this, they聽 usually will have mailed the envelope themselves.聽聽

So, you know, taking it to a post office, dropped it聽 in one of those blue mail boxes that are kind of聽聽
[525]
scattered around town. That's usually what happens聽 and, you know, if that's the case in your situation,聽聽
[530]
then go ahead and check box a here. However, if you聽 mailed the envelope in question from your work聽聽
[537]
and your office has like a mail room and there's聽 like, you know, employees who just kind of, you know,聽聽
[542]
process mail all the time, a lot of times they'll聽 have a basket or something where it's like, you know, the mail聽聽
[546]
is picked up at three. You know, if you have mail聽 that has to go out, just toss it in the basket聽聽
[550]
and then at three o'clock the postman comes and,聽 you know, takes, you know, the whole bag with him or聽聽
[554]
something. If that's the case in your situation, go聽 ahead and check b like that. So number four, number聽聽
[561]
four is also important, but the the basic idea聽 here is, I think it's self-explanatory. Whoever聽聽
[566]
the envelope was addressed to, you put that there.聽 The address where the envelope was mailed to, put聽聽
[573]
that there. And lastly, you put the date that the聽 mailing took place and then the city and the state聽聽
[577]
where the mailing was made. So this is probably聽 gonna be the, you know, second most important bit,聽聽
[584]
I guess, of the proof of service. You need to show聽 that the, the date was, like you need to show what聽聽
[589]
the date was, I guess. Don't leave that blank. And聽 second-to-last, if you're serving some document聽聽
[597]
that has a connection to children, so child聽 custody, visitation, or anything like that, go聽聽
[605]
ahead and check this box also. California courts聽 generally tend to be, like they tend to be more聽聽
[609]
cautious, I guess, treat cases involving children聽 more, they tend to give them more consideration,聽聽
[616]
I guess, and that box is how you tell them that聽 "hey, you know, let's, you know, take a minute and聽聽
[621]
do this properly because there are children聽 involved here." Lastly, what you need to do here聽聽
[628]
is date it, put the date here, type your name and聽 then sign over on the right. This part is pretty聽聽
[634]
self-explanatory also, except I do need to kind聽 of describe one thing about the date. You cannot聽聽
[639]
declare under penalty of perjury something that聽 will happen. You can only do so for things that聽聽
[643]
have happened. So the date of mailing back here聽 and the date down here, they can be the same date.聽聽
[650]
However, this date cannot come after this one. So,聽 for example, you can't put down June 1, 2015 and聽聽
[658]
up here put down June 10, 2015. That doesn't make聽 any sense because you're declaring under penalty聽聽
[664]
of perjury on June the 1st that on June the 10th聽-- sometime in the future -- something was mailed.聽聽

That doesn't make any sense. You can put it as June聽 the 1st, that's fine, like that or you can put down聽聽
[677]
May 31st, that's fine too, but you just can't do聽 it where this date right here is in the future聽聽

from this one, that's all. So hopefully that made聽 sense. This is the form FL-335 proof of service聽聽
