unprecedented leak from the supreme

court

politico has obtained what they say is

an initial draft majority opinion

written by justice alito showing the
[21]
supreme court striking down roe versus
[25]
wade

overruled he writes in the document

labeled as the opinion of the court

again i'm reading from the political

article it is time to heed the

politico mentions this piece

this has never happened before as far as

i know a draft opinion the court leaking

50 years most likely a a

earthquake in the lives of america's

women in our legal culture in our

political culture

that was going to be about how it seemed

likely row was going to be overturned

that it seemed like maybe there was a

little like

failure to price in that reality in the
[92]
political class and then this literally

crossed

two minutes before you came on air what

is your reaction

chris i'm gobsmacked for the same
[102]
reasons that you are in the sense that
[104]
politico has posted a 98-page opinion
[107]
again it is a draft we do not know if it
[110]
will change between now and when we
[112]
expect the court to hand down its
[113]
opinion in june but nonetheless it is a
[116]
detailed seemingly authenticated draft
[118]
written by samuel alito that would make
[121]
abortion illegal in at least half the
[123]
country the day that it goes into effect
[126]
what's shocking is that we have it
[128]
what's shocking is the impact that it
[130]
will have on real people's lives
[132]
unfortunately anybody who listened to
[134]
the justices deliberate in december is
[137]
not going to be shocked by this outcome
[139]
what what does seem still to be up in
[142]
the air is what will chief justice
[144]
roberts do because according to
[146]
politico's reporting at least
[149]
his vote is still up for grabs we heard
[151]
him in december clearly say that he was
[153]
interested in undoing the viability line
[156]
which is a way of overturning roe
[158]
without actually saying we are
[160]
overturning roe what's striking about
[162]
what i've been able to read from justice
[164]
alito's opinion is that he says very
[166]
clearly we are overturning rogue we are
[168]
overturning casey with strengthened roe
[171]
and the impact of that would be
[172]
absolutely devastating on millions of
[174]
people who can become pregnant who live
[176]
in hostile jurisdictions and it would
[178]
certainly open the door to what we were
[180]
originally going to talk about today
[182]
which is a proposed national ban passed
[184]
by republicans so this would enormously
[186]
change people's lives again if this
[189]
opinion can get to a majority um so
[193]
we know that people often will leak
[195]
deliberations by the court after the
[197]
fact we don't usually hear or get to
[199]
read the details it is still possible i
[202]
don't know how likely it is it is still
[203]
possible that between now and the end of
[205]
june there will be some haggling some
[208]
like change in the opinion but we do
[210]
know that the votes are apparently there
[213]
from conference for justice alito to
[215]
have gotten at least an initial sign off
[218]
to write a majority opinion that cleanly
[220]
unmistakably overturns roe v wade yes
[223]
just to be clear the reporting from
[225]
politico is that there are five votes
[226]
for this majority opinion so whether you
[228]
know there's there's there's five votes
[230]
there then there are the three liberals
[232]
um and then uh and then
[234]
roberts in opposition or am i wrong on
[236]
that erin um you know i think he was
[239]
assigned to a majority which means that
[240]
when they took their votes on friday
[242]
after the oral argument there would have
[244]
been votes for at least this outcome
[247]
right but when justices then circulate
[249]
the opinion they still need to get the
[251]
the other justices to fully sign on so
[253]
there have been times that in the
[255]
process of writing uh justices changed
[258]
their mind case planned parenthood
[259]
versus casey was actually an example of
[260]
this in which in the court in the course
[263]
of writing it there was negotiations so
[265]
i would i would say that the fact that
[266]
somebody is leaking this is telling us
[269]
that that person hopes that they can
[271]
sway perhaps chief justice john roberts
[273]
to split the difference a little bit
[275]
again i'm totally speculating but this
[277]
extraordinary leak i think needs to be
[279]
read on its own as somebody really
[281]
trying to draw attention to what the
[282]
court is about to do to the lives of the
[284]
american people yes i mean that's part
[286]
of what's so shocking about it is that
[288]
it seems like a
[290]
a signal flare right i mean a complete
[293]
moment of break glass desperation right
[296]
50 or 50 years that has built up to this
[299]
moment in which a sustained attack on
[301]
reproductive rights in this country by
[302]
the by the political forces that that
[305]
lost in row and then again in casey to
[307]
gut it to whittle it away to try to like
[310]
this you know sort of eviscerate it
[312]
everything but overturn that this is the
[314]
moment is here the wolf is at the door
[316]
and they're going to overturn row
[318]
this guy has fallen
[321]
that's the message uh of this and again
[325]
whoever leaked this and i have no zero
[327]
insight i am i'm just responding in real
[329]
time to this um iran to your point and

again this is going to drive our news i
[334]
think quite a bit uh in in the aftermath
[336]
of it but it doesn't this is the
[337]
beginning of something and not the end
[339]
in a million different ways both
[342]
not that this opinion is has
[344]
is law we don't know that but but there
[346]
is a lot to wrestle with in the
[347]
aftermath of this and hopefully you can
[348]
come back as we wrestle with it or in
[350]
