whether one lawyer or one defense law

firm like ours can represent two

different peoples so two separate

individuals also charged with crimes

they may be from the same incident they
[14]
may be from separate incidents and the
[16]
short answer is to whether or not that's
[18]
a good idea is that no it's not really a
[20]
good idea to represent two people
[21]
because there's an inherent possibility
[25]
that one person may take some advantage
[28]
of the other person or that the law firm
[30]
or the attorney can use information by
[32]
one person against the other person and
[34]
so you just want to make sure that
[36]
there's no conflict of interest the firm
[38]
the lawyer owes the same duties the same
[41]
responsibilities the same rights the
[43]
same level of representation to both
[46]
individuals and so when you have two of
[48]
them there's a possibility that one
[49]
person may be a favor to one be
[51]
benefited against the other so it's
[53]
called a conflict of interest generally
[56]
it's not a good idea to represent two
[58]
people but you can do it you can do it
[60]
in a situation where both of these
[61]
people have interests that are aligned
[63]
and they both have informed and there's
[66]
written consent that they know that this
[68]
is happening in other words they are
[69]
agreeing and they are allowing the law
[71]
firm to do that they're saying we
[73]
understand there is a potential for a
[74]
conflict here that being said we're
[77]
going to acknowledge that we're gonna
[78]
waive any any problems with that and
[81]
we're gonna allow the firm or the lawyer
[83]
to represent us both and there may be
[85]
situations where that's to their benefit

that's the both of their benefits so

let's take a quick example let's say

that in a hypothetical situation there's

this delicious candy bar and it was
[95]
stolen the police come around they're
[97]
investigating who stole the candy bar
[99]
and now they're looking at a and B they
[102]
pull them aside they question a and B
[104]
and they say we believe that you both
[106]
stole this candy bar and so we're gonna
[108]
charge you both with a crime so now a
[110]
and B they come to our law firm and they
[112]
say hey look we were both charged with a
[114]
crime we want the best representation we
[116]
want the best criminal defense lawyer so
[118]
naturally we came to the R in our law
[119]
group and we need help with this we say
[122]
look we can only represent one of you
[124]
because there is a possibility that the
[126]
government may want one of you to go
[128]
against the other one therefore we think
[130]
there's a conflict of interest we can't
[131]
represent you well if both a and
[133]
say we understand that there is a
[135]
potential for a conflict but we are 100%
[138]
certain were 100% in alignment we did
[141]
not do this I did not do it as a B I did
[144]
not do it as B there's nothing there's
[146]
no reason why there's gonna be us
[148]
pointing our fingers at one another in
[150]
that case if they sign some informed
[153]
consent and we all agree to it and it
[156]
seems like it's a good fit and the facts
[157]
of the case are reviewed by our
[159]
attorneys and we decide this is
[161]
something we want to engage in we can
[162]
decide we'll move forward and will
[164]
represent them both the downside to this
[166]
would be if at a later time a and B they
[171]
get plea offers or the the prosecutor
[174]
comes to our office and they say well
[176]
we'll give B a deal so long as a takes
[180]
the fall for this thing so if B that
[182]
agrees that he's going to testify
[184]
against a and B is gonna get a good deal
[187]
now our firm as the defense attorneys we
[190]
have to get off both cases we now know
[193]
that there's a conflict that has been
[194]
developed and so we have to get off both
[196]
cases so that's where it becomes kind of
[199]
an issue for defense lawyers if you know
[200]
or foresee that that is going to be a
[202]
possibility you want to make sure that
[203]
you're not even going down that road but
[205]
in the event that they the government
[207]
comes and they offer be a plea deal and
[209]
we can say B says 100% did not do it I'm
[212]
not taking any deal and they're going to
[214]
be in full alignment and there's not
[216]
going to be any conflicts there because
[218]
their interests are aligned both a and B
[220]
are saying that C did it their interests
[223]
are not going to be conflicting with one
[224]
another that representation might be
[227]
okay but if that if that perceived
[229]
conflict if there is a conflict if
[231]
there's any whatsoever any potential of
[234]
a and B pointing their fingers at one
[236]
another and not pointing it towards C
[238]
that attorney is going to have to get
[240]
off both cases and both attorneys are
[242]
going or both individuals both a and B
[245]
are then going to have to go and get
[247]
their own separate counsel so it's not
[250]
something that we do frequently but
[251]
sometimes the interests are aligned it
[252]
may be beneficial to have one attorney
[254]
on both cases if both a and B are saying
[256]
look we both have evidence and we know
[259]
that C did it we know that this happened
[261]
and here's why here's the evidence we
[262]
want to work together on this thing
[264]
because we are being wrongfully accused
[266]
we're being wrongfully
[266]
convicted or simply they don't know who
[269]
did it but it wasn't either one of them
[270]
there may be some strength there but the
[272]
government will see that and what
[274]
they're going to try to do is create
[275]
that conflict or force one to go against
[278]
the other one so this is a simple candy
[280]
bar case okay in reality these can be
[282]
very complicated there can be multiple
[283]
different levels of conflicts there can
[285]
be multiple other parties you can draw
[287]
out the entire alphabet in big
[288]
complicated cases that are involving
[290]
multiple defendants but generally this
[292]
is the principle it's usually a good
[294]
idea to have your own attorney but there
[296]
are some situations where both people's
[298]
interests are aligned and the likelihood
[299]
of a conflict is just not going to come
[302]
up due to the facts
[303]
due to the criminal charges and those
[305]
