2021 Tax Law Changes Part 2: earned income tax credit - YouTube
Channel: unknown
[0]
the first one we want to talk about聽
is the earned income tax credit
[6]
the first big change that's occurred with the聽
earned income tax credit is that historically聽聽
[13]
you cannot collect the earned income tax聽
credit if you have a certain dollar amount聽聽
[18]
of investment income last year that amount was聽
three thousand six hundred and fifty dollars聽聽
[25]
i and this amount gets increased every year聽
because it's indexed and it'll go up based on聽聽
[32]
changes to the consumer price index starting in聽
2021 this investment income limitation has been聽聽
[40]
increased to ten thousand dollars and this is a聽
permanent change to the earned income tax credit聽聽
[47]
and starting in future years starting in 2022聽
that ten thousand dollar amount will be adjusted聽聽
[53]
upwards uh based on changes in in the consumer聽
price index this is going to be a big change for聽聽
[59]
some taxpayers that previously were unable聽
to collect earned income tax credit because聽聽
[64]
maybe they had something like a capital gain that聽
exceeded the 36.50 amount or they could have had聽聽
[70]
rental income or maybe they had some income coming聽
from an s corp and those those were the items that聽聽
[77]
kept them from getting the earned income tax聽
credit so now the amount is much larger 10 000聽聽
[84]
so this should open up uh the credit to聽
some taxpayers that previously didn't get it聽聽
[90]
the next thing is it's also historically one of聽
the disqualifiers for the earned income tax credit聽聽
[97]
was being married and filing separately a married聽
filing separate tax return rendered that taxpayer聽聽
[104]
ineligible for the earned income tax credit聽
uh they could if you were separated from your聽聽
[110]
taxpayer if you had a qualifying child and you聽
didn't live with your spouse you have the ability聽聽
[115]
to file as head of household and you would聽
be able to claim the earned income tax credit聽聽
[120]
but married filing separate was an automatic聽
disqualifier going forward there are under certain聽聽
[127]
limited situations there will be times when a聽
married but separated taxpayer will now be able聽聽
[136]
to claim the earned income tax credit you can't聽
live with their they can't live with their spouse聽聽
[143]
for the last six months of the year uh they or聽
they would have to have a separation agreement聽聽
[149]
and they have to have a qualifying child聽
that they lived with for some point聽聽
[154]
for some time during the year for six months they聽
don't have to claim the child on their tax return聽聽
[159]
but they just simply have to have a qualifying聽
child that they lived with for six months聽聽
[166]
at some point during the year it doesn't have to聽
be the last six months just be any time during聽聽
[170]
the year there's going to be a new question that聽
you're going to have to deal with on the earned聽聽
[175]
income tax credit and that's going to be with this聽
whenever you have a married filing separate return聽聽
[181]
and you're going to have a box that you'll be聽
able to check off if they meet this credit as聽聽
[186]
you can see down here in the right corner of聽
the on this on the side that they're on the 2021聽聽
[193]
eic uh questionnaire that there is a box that聽
they'll be able to check and once they check that聽聽
[199]
then that will allow them to collect uh EITC if聽
they're otherwise eligible the next change which聽聽
[207]
i think is a pretty big change for 2021 is the age聽
requirements historically if you are a taxpayer聽聽
[215]
and you do not have a qualifying child you have聽
to meet certain age requirements you have to be聽聽
[221]
at least age 25 and you have to be under age 65.聽
this was designed so that you know folks you know聽聽
[230]
young folks with with with no children uh聽
couldn't claim EITC and older folks start聽聽
[237]
going into retirement years with certain you know聽
maybe part-time jobs also would no longer be able聽聽
[243]
to collect uh earned income tax credit well this聽
has changed uh in 2021 if you're a younger person聽聽
[251]
and you're single you the age requirements with聽
if you're a taxpayer with no uh qualifying child聽聽
[258]
uh single or married uh but if you're a younger聽
i mean if you're you're a taxpayer with no聽聽
[264]
qualifying child and your age is 24 you you know聽
and you're a student that's what that's that's聽聽
[271]
the requirement but if you're not a student you聽
can be 18 and if claim earned income tax credit聽聽
[279]
if at any time after you turned 14 you were either聽
in foster care or if any time in your life you've聽聽
[286]
been homeless then you'll be eligible for EITC聽
at 18. if you're not a student not homeless or聽聽
[295]
ever been in foster care the age requirement's聽
now 19. so younger folks will be able to collect聽聽
[303]
earned income tax credit another big dramatic聽
change is the age 65 requirements no longer exist聽聽
[311]
there is no upper age limit you simply just聽
older folks with earned income you know older聽聽
[317]
folks that maybe are retired and collecting聽
some um you know doing some you know part-time聽聽
[324]
job getting some earned income are now going聽
to be eligible for the earned income tax credit
[332]
something else that has changed is the dollar聽
amount that these folks these single taxpayers聽聽
[337]
are going to be eligible to receive last year聽
the maximum benefit for a single taxpayer with no聽聽
[344]
child was 538 dollars this year it's almost triple聽
that amount it's fifteen hundred and two dollars聽聽
[351]
and the income requirements are much higher聽
they've increased the income requirements聽聽
[357]
to still get on them uh get earned income tax聽
credit is twenty one i'm sorry 21 430 dollars聽聽
[365]
which has increased by almost you know forty聽
eighty six hundred dollars over last year so聽聽
[372]
again more folks are going to be eligible聽
to collect the earned income tax credit聽聽
[377]
this year another wrinkle with the earned聽
income tax credit is we can continue to use聽聽
[385]
prior year income to calculate the earned income聽
tax credit and this is a result of the coronavirus聽聽
[393]
uh pandemic uh but a wrinkle on all of this is is聽
that you have to use your 2019 earned income you聽聽
[403]
cannot use when you're when you're calculating it聽
based on prior year earned income you cannot use聽聽
[409]
the 2020 amount that's not going to be relevant聽
it will go back and we will look at the 2019聽聽
[418]
amount now there's a new line on actually on the聽
1040 and we're actually going to have to enter it聽聽
[425]
on the 1040 it's actually going to be on our forms聽
where we will enter it in previously whenever we聽聽
[431]
use prior year income to calculate the earned聽
income tax credit it was something that was聽聽
[437]
reported in the margins so that's that's聽
all i have on the earned income tax credit
