this is Alan Rothstein the man who wrote
[35]
the sex contract court records show he
[38]
forced a prospective tenant to sign it
[40]
in November 2018 in order to rent this
[43]
four-bedroom home on wedgebrook Street
[45]
near Las Vegas Boulevard and Saint Rose
[47]
Parkway at the time Rothstein was the
[50]
property manager and also a real estate
[52]
broker he lost both licenses after a
[55]
Nevada real estate division
[56]
investigation he now stands to lose a
[59]
lot more if a federal judge finds him
[61]
guilty he's currently on trial for
[64]
violations of the fair housing act and
[66]
this lawsuit filed by his former tenant
[68]
and the facts are unlike anything this
[71]
experienced housing lawyer has ever seen
[73]
my reaction was you had to be putting me
[76]
on that nobody in their right mind would
[79]
go to the trouble to drop a contract
[81]
like this no one involved would talk to
[83]
us as the trial is ongoing we asked
[86]
legal expert Bruce flammy to analyze the

case have you ever seen anything like

this no not even on bar exams in law

school nobody has ever put something

like this together that I've ever seen

although in all Candor I think there's

Rothstein himself admitted to the real

estate division that he wrote the sex

contract and required the tenant to sign

really saying is I don't want to talk

about it we're talking about it to the

extent that we can we'll begin with the

title it's direct consent for sexual

intercourse and or

or switches and italics who names a

document that it goes on to say please

read this legal contract carefully and

that's where I started laughing because

this is a legal contract the way the
[147]
actors on Gray's Anatomy are real

doctors okay this is literally not worth

the paper it's printed on the term the

terms of the so-called contract are even

crazier than the title the tenant had to

swear she wasn't signing under the

influence of any intoxicant including

alcohol drugs oysters truffles

sea cucumber strawberries Lobster I've

never known anybody to be under the

influence of lobster dark chocolate

cocaine LSD and cannabis I don't know

where you get a list like that another

does not currently have a boyfriend

girlfriend or parent who is larger

meaner and more physically aggressive

owns firearms and or is more possessive

than Rothstein she was told if she

didn't sign this she was not going to be

able to get the unit so in all for all

intents and purposes it's exactly sex

for a place to live it's exactly what it

is and it's almost Sex On Demand what do

we make of the fact that she initialed

this thing nothing people sign things

all the time and the popular myth is

well you signed it so it's binding yeah

there are a variety of things you can

sign that are not binding any contract

that is against the law or public policy

is not binding so why would anyone sign

anything like this court documents say

in August 2018 the tenant and her five
[231]
children were homeless living from week
[233]
to week in a residential Hotel the
[236]
Southern Nevada Regional Housing
[237]
Authority threw them a Lifeline
[239]
approving them for Section 8 a federal
[241]
program that funds local public housing
[244]
authorities to help low-income families
[246]
rent from private landlords but one of
[249]
the provisions of Section 8 is that once
[251]
you're approved you have to find a
[253]
residence that will be covered by the
[254]
program within about 60 days of when
[257]
you're approved now depending on where
[259]
she was in that 60-day window when this
[261]
thing came up she may not have had other
[264]
options court records say she'd been
[266]
allowed to move in and paid out of
[268]
pocket to fix up the house so HUD would
[271]
approve it so when you slap this
[272]
document down in front of her and say
[274]
sign this or you have no place to live
[276]
that's coercion that's duress and I
[279]
believe it's a violation of federal law
[280]
the tenants lawsuit alleges several
[282]
other violations including charging
[285]
illegal fees and wrongful eviction after
[288]
she refused any sexual encounters in
[291]
court records Rothstein disputes any
[294]
fair housing violations attorney philami

says no matter the outcome of the Civil

Trial accountability shouldn't stop
[302]
there there may or may not have been
[304]
crimes committed here the word extortion
[306]
flashes in my mind in this kind of
[309]
situation but that's not what this trial
[311]
is about that's going on in federal
[312]
court right now
[314]
but this is a good example of a case
[316]
where maybe somebody ought to go to jail
[319]
when the real estate division revoked
[321]
rothstein's licenses State investigators
[324]
found he listed a fake address for his
[326]
brokerage the state also found he
[328]
repeatedly made unwanted sexual advances
[331]
when he had the tenant come to his home
[333]
to sign documents he was fined ninety
[336]
four thousand dollars in that and we
[338]
will update this story with the outcome
[340]
of the federal case this is absolutely
[343]
wild Darcy but you know you kept
[345]
mentioning a property manager was there
[346]
any landlord that was involved in this
[348]
well he was the landlord but there was
[350]
also a home owner the homeowner
[353]
contracted with Rothstein as the
[355]
property manager to execute the lease
[357]
he's the only one who met with the
[359]
tenant the homeowner was originally
[361]
named in the lawsuit but then was later
[362]
dropped from it and we should mention
[364]
that the homeowner who has since sold
[366]
the home is the one who filed the
[368]
complaint with the real estate division
[370]
in 2020 which led to rosting losing his
[373]
licenses so that he can't continue doing
[374]
