On our channel daily we receive tons of comments
[3]
And through which we get to know what you know
[7]
And by which we get to know that most of the PF members doesn't know that.
[11]
After withdrawing from employee pension scheme, how much amount they should get
[18]
If they get retired that what will be their pension
[21]
And that never comes through a standard formula. That's why we made EPS Series
[28]
In episodes 1 and episode 2 we covered withdrawal and members' pension.
[34]
And today in episode 3 we will covering
[37]
that most of the people don't have an idea
[42]
In today's case, we will be talking about,
[44]
After a member's death or member's disablement,
[48]
what will be the pension of a widow and orphan, and how it's calculated.
[53]
Today I will be explaining this in very easy language.
[56]
My name is Rishabh Jain, I am your labour law decoder
[59]

[75]
[ INTRO ]
[94]
To understand EPS pension we need to understand 3 cases.
[97]
case 1. either pension comes at retirement
[101]
case 2 at the time of death
[103]
case 3 pension can be at the time of disablement
[106]
The pension at the time of retirement is called member pension.
[110]
Which we have talked about earlier and it's highly recommend if you haven't seen that video.
[115]
So I am giving a link to that video watch it before this video because.
[117]
members pension reference will be coming again and again.
[119]
Here is your member pension, which we had already talked in episode 2.
[126]
Now we will talk about death case, in the death case, there is 4 scenario.
[129]
let's understand all 4 scenarios and what will be our pension in them?
[133]
Member's death occurs in less than 10 years of service.
[143]
Means he wasn't eligible for pension at the time of death
[145]
In grace period, what's grace period ? Grace period means.
[150]
This rule is added just now in EPS it wasn't earlier .
[154]
If you are a member of EPS and didn't withdraw your money at the time of leaving.
[160]
And after leaving job death occurs within 36 months.
[163]
Then you will be considered as an active member of EPS.
[166]
That means your death occurs in in service or in 36 months.
[172]
Then it's called the grace period, and In this particular case what will be the pension.
[176]
we need to calculate by table C,
[179]
because till now this member wasn't eligible for pension.
[183]
So in table C, a whole table is given through which we can find out.
[187]
According to its wages in it's last service
[191]
what should be his pension and here is also a minimum cap
[196]
of 1000 RS and if you look at the table C maximum pension comes about 2901
[202]
So between 1000 and 2901 pension will comes out and that will be widow pension.
[208]
At every place, I am telling widow pension and using it we will find children pension.
[214]
dependency and others we will find out
[217]
So you have to remember this widow and member pension concept.
[223]
2nd concept is less than 10 years means not eligible for pension.
[228]
Left job and after 36 months of leaving,
[232]
death occurs, in that case, no pension will be given.
[236]
No pension there will be only withdrawal benefit.
[244]
Only withdrawal, the amount in EPS could be withdrawn.
[247]
You can only withdrawal can't get any pension, this rule was added recently.
[251]
If your EPS account is running
[253]
And left the job, then within 36 months you can put money in it.
[257]
And after 36 months you didn't join any new service.
[260]
Where EPS money could be deducted so, it's better to withdraw that EPS amount.
[266]
Now let's talk if we had a service of more 10 than years.
[270]
And death before starting pension
[273]
In any case, if he had 10 plus service and had in-service death.
[277]
Or had 10 years plus service and exits and then death
[283]
So then what will happen in that case,
[285]
so in that case we had to calculate members pension.
[288]
If he had more than 10 years service
[291]
than obviously there will be some member pension.
[293]
You will be saying its date of retirement isn't there.
[297]
So the date of retirement
[300]
will be consider as date of death
[304]
Now we will calculate the pension on the basis of date of death.
[309]
Then the member pension comes, there here also a limit of 1000 is applied.
[312]
So the actual pension, which we understood in video 2 will be.
[319]
And the last scenario is if the members' pension is already started.
[323]
It could be retirement pension, early pension, deferred pension before 58
[328]
In that particular case the pension after the death of this employee death.
[333]
The pension to the widow will be 50 %
[337]
of the members pension.
[339]
So, assume that the pension to the member is RS 3000
[342]
Then the pensioners die then
[344]
the widow will be getting 50% means 1500 Rs.
[348]
Now let's talk about last case
[351]
From widow to children pension, we will come later let's talk about the last case.
[355]
What will happen in case of disablement?
[357]
So in case of disablement we need to check these 3 cases.
[360]
If he had already completed more than 10 years of service.
[362]
Then find member pension, if 10 isn't completed.
[366]
Then check table C, in the employ pension scheme
[370]
, or minimum 1000 Rs
[372]
In this 3 which ever is maximum
[375]
According to that, in case of disablement pension will be coming.
[378]
I also had a doubt in the case of disablement.
[381]
That the disablement should occur during the service
[385]
or it could after the service also.
[387]
As soon as I get to know about it, I will pin it in the comments.
[390]
And please tell me how's the video in the comments.
[394]
So that we could also get motivation
[396]
Now let's talk about, as every person is not married.
[401]
So what will happen in that case
[402]
So, in that case, we should understand the definition of family.
[405]
So who comes in his family.
[407]
If there a male in the family,
[410]
Then his wife and up to 2 children will be included.
[416]
And similar if there's a female.
[418]
In that case her husband and up to 2 children will be included.
[423]
So now let's see if there widow pension what is it,
[428]
and besides widow who all are getting pension
[431]
Here could be 2 types of cases.
[436]
2 cases could be that the diseased employee was married or not married.
[446]
In case of married the pensioner's wife is surviving.
[453]
Then wife is getting 100% widow pension
[458]
that will be, you already know widow pension is all these cases.
[461]
In that all, the wife will get 100 %
[464]
And 2 children will also be getting pension That will be 25%-25% of the widow pension
[471]
So In this case widow pension was coming 3000 Rs
[475]
Then widow will be receiving 3000 Rs
[477]
Then the kids will be receiving it's 25% means 750Rs - 750Rs.
[483]
Until these kids didn't reach the age of 25 they will be receiving this pension.
[487]
Then you will ask what if there are 3 children.
[490]
In that case, the order will be oldest to youngest.
[493]
So until first 2 kids cross age of 25
[498]
this then pension will be of eldest and middle one.
[502]
and after that middle and younger will be receive.
[505]
This pension will only over when all the children cross 25
[509]
Then this pension will be overall over for children.
[511]
2nd case if he doesn't have a wife
[514]
And kids are orphan
[517]
2 kids upto 75 % of widow pension
[522]
Or 100 % of member pension in different cases.
[525]
Widow pension will be getting upto 75%, to two children.
[530]
And order will be same from oldest to youngest.
[533]
Now, assume that not married, in case of not married there are also 2 scenarios.
[537]
1st. nomination form is filled
[540]
and nomination form is not filled up
[543]
If the nomination form is filled then, whoever is the nominee.
[547]
Will get 100% of member pension for life long
[553]
And in all this cases when ever is widow pension is coming.
[556]
The widow will get life long widow pension.
[559]
In case of nominee, nominee will get 100% of nominee pension life long.
[563]
If nominee is not mentioned and didn't married
[567]
Then first father and then mother
[571]
Will be given 100% of the widow pension
[577]
That why it's very important to fill your nomination.
[581]
If you haven't filled your nomination
[584]
then your family will face too much problem to receive your pension.
[588]
