and we're going to talk about this type

of insurance right now

the first time so in today's real estate

exam prep video we're going to discuss

a type of insurance that you have to
[34]
have to have as a real estate
[35]
professional in most jurisdictions in
[37]
the united states it's called errors and
[39]
emissions insurance
[40]
commonly referred to is eno insurance

now

what this is is basically your
[46]
malpractice
[47]
insurance not unlike a doctor or a
[50]
lawyer who'll have their
[52]
their malpractice insurance that's what
[54]
errors in admissions insurance is
[56]
so if you make a mistake you screw
[59]
something up in a real estate
[60]
transaction you have that insurance
[62]
coverage
[63]
to protect you financially and it does
[66]
provide
[67]
for in most policies it does provide for
[70]
legal counsel so the arizona emissions
[72]
insurance company will go out and hire a
[74]
local attorney
[75]
to represent you uh in case you get sued
[78]
so

but there are some things that you have
[81]
to know for the real estate exam and you
[82]
also have to know as a practitioner and
[84]
i'm going to discuss both here

number one is errors and emissions
[88]
insurance
[89]
may not be required for every licensee
[91]
in every state
[92]
some states very few but there are some
[94]
states that only the designated
[96]
broker is required to carry errors in
[99]
emissions insurance and then if one of
[101]
their salespersons or
[103]
associate brokers get into some kind of
[105]
legal trouble then their eno insurance
[107]
covers that licensee and in most states
[110]
though every licensee including the
[112]
designated broker
[114]
has to have errors and emissions
[115]
insurance and why this is important is
[118]
each state is specifically different so
[120]
you have to know
[121]
for your state portion of the real
[123]
estate exam which your state eno
[126]
insurance coverage coverages and
[127]
requirements are so make sure you you
[130]
look into that when you're preparing for
[132]
your real estate exam

from a practitioner point of view there
[136]
are a few things i really want you to
[138]
know about because i see this a lot in
[140]
where i'm at here in nebraska and it
[142]
extends across the united states and
[144]
that is you need to make sure
[146]
that you have the appropriate amount of
[148]
coverage very important because most of
[150]
these
[151]
policies have a a basic minimum and
[153]
quite frankly that's what most
[155]
real estate professionals do let's go
[157]
get the basic package and that's it i
[159]
gotta have the insurance
[160]
so i'm gonna get the bare minimum but
[163]
that may not be adequately
[165]
protecting you so for example if your if
[168]
your base coverage is
[169]
250 000 in liability coverage
[172]
but yet you're dealing in million dollar
[175]
homes
[176]
uh large commercial transactions or
[178]
large uh
[179]
agriculture transactions million plus
[181]
those type of things you don't have
[182]
enough insurance coverage
[184]
so you need to make sure that you have
[187]
the appropriate insurance coverage
[188]
because
[189]
if anything above your insurance
[191]
coverage if there's a judgment against
[192]
you
[193]
especially in states that have punitive
[195]
damages
[197]
they're going to come after your
[198]
personal finances so you need to make
[199]
sure you have the appropriate coverage
[201]
the other thing is
[202]
not every insurance carrier provides
[206]
uh carte blanche type coverage so they
[209]
may protect you on a sales transaction
[211]
but not in a leasing or a management so
[213]
you have to have that discussion with
[214]
your insurance carrier to find out if
[216]
you're doing property management and
[217]
you're doing leasing
[220]
are are those activities covered a lot
[223]
of
[223]
errors and emissions insurance coverage

does not cover things like fair housing
[227]
complaints
[228]
unless you have an additional rider that
[230]
you've paid for so you have to ask
[231]
questions
[232]
environmental writers so if you're in
[235]
commercial you're industrial or maybe
[237]
you're
[237]
managing those pre-1978 homes where
[241]
lead-based paint issues are prominent
[243]
you have to find out whether or not
[245]
you're required to have an environmental
[247]
writer
[248]
that's an additional amount of coverage
[250]
and the other thing is with so many real
[252]
estate professionals uh buying and
[254]
selling their own investment properties
[256]
understand that almost i in fact i can't
[258]
think of one in errors and emissions
[260]
insurance coverage where i've seen where
[261]
they cover
[262]
a transaction where you're representing
[264]
yourself self as a buyer or a seller so
[267]
you have to ask that question

you know if i'm doing my own deal will
[272]
errors and emissions insurance coverage
[275]
protect me
[276]
and so those are not so much things
[278]
you're going to need to know for the
[279]
real estate exam but definitely as a
[281]
real estate
[282]
