in this video we're talking about a very

common crime in Arizona it's called
[4]
driving on a suspended or revoked
[5]
license it happens all the time and it's
[8]
a lot more serious than people think so
[11]
let's discuss what the law says we'll
[13]
discuss how your license can be
[15]
suspended or revoked then we'll discuss
[17]
what the penalties are so first and
[19]
foremost the law is pretty simple
[21]
it says under a RS 29 30 473 a that you
[27]
cannot operate a motor vehicle if the
[29]
privilege to drive that motor vehicle
[32]
has been suspended revoked cancelled or
[35]
refused so it's pretty simple the law is
[38]
not real complicated a lot of statutes
[40]
or multiple pages this is about a
[42]
sentence or two sentences and it says
[44]
that if your license is suspended or
[46]
revoked and their different meanings
[48]
there or it's canceled you cannot
[51]
operate a motor vehicle it's pretty
[52]
simple but how can that happen so how
[55]
can somebody's license actually be
[56]
suspended or cancelled well there's a
[58]
number of different ways and so let's
[59]
talk about them the first and foremost
[61]
that we see kind of most common one of
[64]
them is what's called having a criminal
[66]
warrant so if you've been charged with a
[68]
crime and you miss your court date
[69]
whether it's a very serious offense like
[71]
a felony offense or it's something minor
[73]
like criminal speeding and you miss your
[75]
court date I mean you know that you had
[77]
court and you do not go to court and
[79]
they issue a warrant for you the court
[81]
is also going to notify the motor
[84]
vehicle department that you have a
[86]
warrant out for your arrest and the
[88]
motor vehicle department is going to
[89]
suspend your license so until you
[91]
rectify that warrant your license is
[93]
going to be suspended they do that so
[96]
that you lose some privileges if you
[97]
have an outstanding court date you're
[99]
not allowed to drive the car until you
[100]
deal with that court date so having a
[102]
criminal warrant is one way your license
[104]
can be suspended another one that's
[106]
probably even more common is when you
[109]
have unpaid tickets so this can be
[111]
parking tickets civil speeding tickets
[113]
photo radar tickets stuff that's not
[116]
criminal but it still is a moving
[118]
violation if you do not pay those the
[121]
court will put you into what's called
[122]
default judgment they will also notify
[125]
the motor vehicle department this can
[128]
happen if you're out of state as well so
[130]
Arizona is part of what's called an
[131]
interstate compact which
[133]
means Arizona communicates with all of
[135]
the other states so if another state
[137]
like California or New Mexico or Florida
[140]
if you have a suspended license there
[142]
and they send it over to Arizona Arizona
[145]
is gonna honor that it's a little bit
[147]
more nuanced than that because the
[148]
states have different ways that they
[150]
operate but Arizona will honor that
[152]
Arizona will also notify the other
[154]
states as well so if you get a suspended
[156]
license in Arizona Arizona is gonna
[158]
transmit notice of that suspension back
[161]
to your home state so if you have an
[163]
unpaid ticket the court will suspend
[166]
your license they'll notify the MVD DMV
[168]
will suspend your license and you can be
[169]
liable if you're driving for driving on
[172]
a suspended license another thing that
[174]
we see is people will often get too many
[175]
points accumulated on their license so
[178]
too many traffic tickets multiple
[179]
speeding tickets multiple photo radar
[181]
violations and in that event depending
[184]
on the number of points you have Arizona
[187]
will suspend your privilege to drive
[188]
that's kind of the whole point of having
[190]
points if you get too many violations
[192]
your privilege is suspended and no it
[196]
depends on how many points but from
[198]
three months all the way up to a year or
[199]
longer than that also revocation as I
[203]
said earlier revocation is different
[205]
than a suspension the suspension means
[207]
your license is suspended after that
[209]
period of time is up you can get your
[211]
license back a revocation means it's
[213]
revoked your license is gone they are
[215]
taking it away from you it is gone
[217]
unless you go through a process that's
[219]
called a revocation packet you're
[221]
basically having to appeal to the MVD to
[224]
say I've dealt with all the stuff that
[226]
caused the revocation and now I'd like
[228]
my license back but it is gone you do
[230]
not have a license anymore
[231]
we see that most commonly when somebody
[234]
is convicted of a second offense DUI so
[236]
the first offense you get a suspension
[238]
the second offense they actually revoke
[241]
your license it's gone same with other
[243]
criminal traffic violations things like
[245]
reckless driving if you get multiple
[247]
violations or exhibition of speed like
[249]
racing drag racing
[250]
they will also revoke your license if
[252]
you get two of those so this can happen
[254]
in other more serious felonies things
[256]
like manslaughter or that involve an
[258]
accident or aggravated duis will be
[260]
revocations as well but it is something
[262]
that's common it's different it's a
[263]
revocation it's not a suspension so if
[266]
your license has been
[267]
you obviously don't have a license you
[268]
can't drive a car we also see it and
[270]
this is less common but if you have a
[272]
civil judgment that's against you so
[274]
let's say that you will rear-end
[276]
somebody cause a lot of injury they sue
[279]
you personally and the court enters a
[281]
judgment against you for some monetary
[283]
penalty and and you do not uphold those
[287]
payments meaning you basically go into
[289]
default on those payments the court has
[291]
the power is suspend your license same
[293]
with child support issues again less
[295]
common not one that we see a whole lot
[297]
but if you are not paying your child
[299]
support the judge could order that the
[301]
NVD suspend your driving privileges so
[303]
these are really the main ways that we
[305]
see people's a license actually get
[307]
suspended sometimes people do not know
[310]
that their license is suspended we'll
[311]
talk about how that can be a defense but
[314]
these are the ways that it happens and
[316]
if you're driving and you get cited and
[319]
you get stopped and an officer runs your
[321]
driver's license they run your plates
[323]
and they see that your license is
[325]
suspended they're gonna charge you with
[327]
driving on a suspended license as I said
[329]
it's more serious than a lot of people
[331]
would think it's actually a class 1
[333]
misdemeanor this is the highest class of
[336]
misdemeanor offenses that we have in
[338]
Arizona same as a DUI same as most
[341]
domestic violence offenses it's a class
[343]
1 Arizona has a class 1 at the top two
[346]
in the middle and three at the bottom
[347]
three is of the least serious number one
[349]
is the most serious
[350]
so not paying a parking ticket can turn
[354]
into a suspended license can turn into a
[356]
class 1 misdemeanor crime so it's
[358]
important you understand that this is
[360]
not a minor thing
[362]
technically the statute says that you do
[364]
not have to go to jail for this offense
[366]
but you could you could go to jail for
[368]
six months you could have to pay fines
[370]
and fees of $2,500 plus a surcharge on
[373]
top of that could be three to four
[375]
thousand dollars it could be placed on
[376]
probation for five years so there are a
[379]
lot of significant penalties it's
[380]
important to also know that depending on
[382]
what prosecutor's office is handling
[384]
your case it's a criminal case it's
[385]
going to go through the same process as
[387]
a DUI they may ask for jail time if you
[390]
have multiple offenses so I wrote on

here multiple offenses equals jail so
[396]
you want to be sure that it's not
[397]
something that you're taking lightly
[400]
can turn into a big deal and certainly
[403]

Arizona it's a class 1 misdemeanor
