the Homeland Security recently issued a
[8]
new public charge rule that our
[10]
customers have been asking about so we
[12]
wanted to briefly go over this a public
[15]
charge is defined by the USCIS is a
[17]
person who is likely to become primarily
[21]
dependent on the government for
[22]
subsistence as demonstrated by either
[25]
the receipt of public cash assistance
[27]
for income maintenance or
[29]
institutionalization for long term care
[31]
at government expense in other words a
[35]
public charge is a person who cannot
[37]
support themselves financially and
[40]
depends on certain welfare benefits
[42]
people who are likely to become a public
[44]
charge are not admissible to the US and
[47]
are not eligible to receive a permanent
[50]
resident card this has been the rule for
[53]
so many years there are two major
[55]
factors that concern our customers about
[58]
this new rule the first major factor is
[61]
the use of certain public benefits by
[64]
the applicant now any non-immigrant
[67]
alien who is intending to adjust status
[69]
and has used any public benefits in the
[72]
USA they would be denied a visa the
[76]
language of the new rule specifically
[78]
mentions the alien and not the US
[80]
citizen sponsor in this case the public
[83]
benefits must have been received
[86]
directly by the applicant for the
[88]
applicants own benefit the new rule
[91]
which goes into effect on October 15
[94]
2019
[96]
mentions the following benefits
[97]
considered in a federal state local
[99]
tribal cash assistance for income
[103]
maintenance Supplemental Security income
[105]
or SSI Temporary Assistance for Needy
[108]
Families stay in TANF federal state or
[112]
local cash benefit programs for income
[115]
maintenance of in cold general
[117]
assistance in the state context but
[119]
which may exist under other names
[122]
Supplemental Nutrition Assistance
[124]
Program or snapped or formally called
[127]
food stamps section 8 housing assistance
[130]
under the Housing Choice Voucher program
[133]
sec
[134]
a project-based rental assistance
[136]
including moderate rehabilitation public
[140]
housing under section 9 of the Housing
[142]
Act of 1937 federally funded mitigate
[146]
with certain exclusions so in general is
[150]
fairly uncommon for a non-immigrant to
[152]
receive any of these benefits so the
[157]
second major factor related to this new
[159]
rules the property threshold of the
[161]
sponsors income the sponsor is required
[164]
to meet at least 125 percent of the
[166]
poverty guidelines this has been the
[169]
rule for some time and is not changing
[171]
per se but what is changing is that the
[174]
Department of State is setting the bar
[176]
higher explicitly stating that if your
[179]
income is below 250% of the poverty
[182]
guideline your case is going to receive
[185]
more scrutiny that means they're going
[187]
to review it and they're going to look
[189]
at the supporting documents and they
[190]
want to ensure that you meet this
[193]
guideline and just to give you an
[195]
example of what 250% of the guideline is
[198]
for a family of four you're looking at
[200]
approximately sixty four thousand three
[202]
hundred and seventy four dollars so
[204]
that's considerably higher than it was
[207]
before now this is it's kind of a gray
[209]
area on how they're going to scrutinize
[211]
this because as many of you probably
[214]
know income and supporting documents are
[217]
very subjective meaning it's going to
[219]
come down to the discretion of the
[221]
officer reviewing the case so they're
[224]
going to you're going to need to provide
[225]
more documents they're going to look at
[227]
your finances and we anticipate that
[232]
we're going to see quite a few more our
[234]
Effy's that's request for evidence
[235]
letters we also anticipate we're
[239]
probably going to see more denials so
[241]
there's going to be a lot more
[243]
information on this to come after the
[245]
rule goes into effect but what we can
[246]
recommend right now is to submit your
[249]
application or your petition as soon as
[251]
possible if you'd like to get started
[253]
immediately give us a call and we'll

help you out with us because we do

expect this to have a major impact okay

next question is from Michael and Heidi

do the new October 15 income rules of
[265]
250% apply at the time
[268]
filing the affidavit of support or at
[271]
the time of filing of the 1 p0 I have a
[273]
pending CR 1 1 3 0 waiting for a no a 2
[277]
so the the new rule will take effect on
[282]
October 15 and that would be all
[284]
petitions that are will be filed at
[287]
October 15 onwards so if you have
[289]
already pending SCR 1 it doesn't affect
[293]
your it doesn't affect your petition
[296]
because it doesn't have a retroactive
[298]
effect it will only affect petitions
[299]
filed on October 1 onwards and the other
[304]
concern here is are there a question
[306]
that we may not know about yet is
[309]
whether or not this is going to affect
[312]
the affidavit of support filed with the
[316]
consulate that's overseas right now what
[319]
we're looking at is adjustment of status
[321]
packages filed with the USCIS it's
[325]
unclear at this moment how this is going
[329]
to impact the i-130 s and i-485 s are
[332]
the i-864 s which is the affidavit
[335]
support filed with the National Visa
[337]
Center which in turn sends it over to
[339]
the embassy but for your case you should
[342]
be fine you've already filed and you're
[344]
well ahead of the game but as I stated
[348]
earlier for anyone else out there you
[350]
really should apply as soon as possible
[352]
because once this goes into effect we
[355]
anticipate quite a few more RFPs request
[358]
for evidence as well as denials we're
[361]
not sure if they're going to request
[363]
that you get a joint sponsor or we're
[366]
not exactly sure if you can use assets
[368]
you know so there's a lot of unanswered
[371]
questions regarding this new rule that
[373]
goes into effect in October
[375]
well the k1 visa income requirements
[377]
going up in October 15 or is it just
[380]
adjustment of status 250%
[383]
are you able to get a co-sponsor of ones
[386]
in the United States Oh another 250%
[389]
question in conformance yeah just just
[394]
to let everyone know out there the
[397]
income requirements are not going up
[399]
okay if you'll look at the HHS poverty
[402]
guidelines the income requirements have
[404]
stayed the standard
[405]
okay the only thing that came out with
[408]
the new rule from the US Department of
[410]
State is stating that they are looking
[413]
at incomes in between a hundred and
[416]
twenty five percent and two hundred and
[418]
fifty percent those are the ones they're
[419]
gonna scrutinize more okay so if your
[421]
income is over two hundred fifty percent
[423]
say it's over sixty five thousand you're
[425]
gonna fly through with no issues okay
[428]
but if you're below that two hundred
[430]
fifty percent level they're going to
[432]
scrutinize it more so they're gonna look
[434]
for more evidence they're gonna look at
[436]
several factors they're gonna look at
[438]
your age your health your you know your
[441]
employment okay whether you're retired
[444]
whether you're receiving you know Social
[447]
Security they look at a lot of different
[449]
factors
[451]
there's the USCIS actually has a
[453]
document out there that lists all the
[455]
factors that they look at and they take
[457]
all this into consideration and they
[460]
just want to ensure that the beneficiary
[463]
is not going to collect means-tested
[464]
benefits okay food stamps welfare things
[468]
like that but if you are below that 250%
[472]
income level in some countries it some
[475]
embassies you may use a joint sponsor to
[478]
meet these income requirements but if
[482]
you're from the Philippines not so much
[485]
they do not accept joint sponsors for
[487]
the k1 fiancee visa they do for the
[489]
spousal visa but not for the fiance visa
[492]
so again we don't have all the answers
[495]
on this new rule yet there's a lot more
[497]
information that's gonna come out
[499]
especially once we start receiving RFPs
[502]
and denials because usually in those are
[505]
Effie letters the request for evidence
[506]
letters they'll tell you exactly what
[508]
they're looking for they'll tell you you
[510]
need joint sponsor or we need to see
[512]
your IRS tax transcript from the
[515]
previous year or the last three years so
[519]
what we expect or anticipate is that
[521]
they're going to be looking for more so
[523]
I can tell you usually to prove your
[525]
income they want to see the your last
[528]
year's tax returns and they want to see
[529]
your w-2s
[531]
they we also recommend providing three
[533]
to six months of your pay statements if
[536]
you're a business owner or independent
[537]
contractor a lot of times you're going
[539]
to want to provide six months of bank
[541]
statements including all your tax
[543]
schedules so again with this 250 percent
[547]
rule there's a lot more to come on that
[549]
but right now just know that the income
[551]
requirements have not gone up it's just
[553]
this is giving them some more leeway I
[555]
think to to scrutinize petitions more so
