Channel: unknown
[0]
r kelly is back in a new york city
[2]
federal courtroom today as opening
[4]
statements get underway in one of the
[6]
criminal trials he faces this case stems
[9]
from years of allegations of sexual
[11]
abuse kelly faces racketeering and other
[14]
charges for an alleged plot involving
[16]
illegal sexual activity with women and
[19]
underage girls jerika duncan is at the
[21]
brooklyn courthouse with details
[24]
you know laura some people will say this
[26]
trial was years in the making we've
[28]
heard from numerous women who say they
[30]
were abused by r kelly but his legal
[32]
team says there's another side to this
[35]
story and that that side will finally be
[37]
heard starting today
[45]
[Music]
[47]
r kelly's music topped the charts for
[49]
decades and at times he seemed
[52]
unstoppable
[53]
[Music]
[56]
the r b star won three grammys just a
[59]
few years after he married then
[61]
fifteen-year-old singer aaliyah
[66]
at the time of their marriage kelly was
[68]
twenty-seven
[73]
then in 2002 kelly was charged with
[76]
making a sex tape with a 14 year old a
[78]
jury found him not guilty six years
[81]
later kelly continued to make more music
[84]
and more money i feel like justice for
[87]
me is just
[89]
it's just been about me being a silence
[90]
breaker in this on the radio i'm gonna
[93]
hook you up former radio dj kitty jones
[96]
says kelly physically emotionally and
[98]
sexually abused her when they dated back
[100]
in 2011. was there a part of you that
[103]
was afraid to say something yeah that's
[105]
a part of it i didn't fit the profile
[107]
people that knew me knew that i would
[110]
never
[110]
have been in a situation like that
[112]
because i had so much going for me
[115]
jones was among a handful of women who
[117]
described life under kelly's control in
[120]
the 2019 docu-series surviving r kelly
[123]
being on punishment could be
[126]
either you're not getting food or
[129]
you took a beating people betrayed me
[131]
and i keep forgiving them that same year
[134]
kelly sat down with gayle king have you
[137]
done anything wrong
[139]
lots of things wrong
[140]
when it comes to women that i apologize
[143]
but i apologize in those relationships
[145]
at the time i was in the relationships
[147]
haven't broken any laws when it comes to
[149]
women absolutely not
[151]
four months after that interview kelly
[154]
was arrested for federal sex crimes in
[156]
chicago and new york in july the 54 year
[159]
old was transferred to brooklyn where he
[161]
will now stand trial for allegedly
[163]
running a criminal enterprise for two
[166]
decades involving sex trafficking of
[168]
women and underage girls kelly's legal
[171]
team tells cbs news the enterprise is
[174]
based on a series of independent
[176]
relationships and events that the
[178]
government is trying to patch together
[180]
like different types of fabrics and
[182]
trying to pass it off as silk as for
[184]
jones she says her focus is on the
[187]
survivors my hope is just for everyone
[189]
to get
[192]
a peace of mind finally
[195]
process their hurts
[197]
kelly faces 10 years to life in prison
[199]
if convicted on all charges in the new
[202]
york case now several women are expected
[204]
to testify over the next month which is
[206]
how long this trial is expected to last
[209]
laura
[210]
tarika thank you and joining me now to
[212]
discuss this highly anticipated trial is
[215]
cbs news legal analyst ricky clemen
[217]
ricky what can we expect from today's
[220]
opening statements
[223]
i think you're going to hear from the
[225]
prosecution for approximately an hour
[227]
and a half and they are going to lay out
[230]
a sordid tale with shocking acts of
[234]
exploitation of women and young girls
[238]
they've charged him with the most
[240]
serious of crimes which is a rico
[242]
violation which means a racketeering
[246]
influence corrupt organization
[249]
and he's portrayed in simple english as
[252]
the ringleader of a group of people
[255]
including his employees and enablers who
[258]
would get these women and young girls
[261]
bring them to him after sometimes he
[264]
chose them at concerts and events
[267]
and these girls and women were then uh
[270]
allegedly kidnapped they were placed in
[275]
apartments for where he lived they were
[278]
put in rooms they had to wear baggy
[280]
clothes when they were not with him they
[282]
were not able to eat or go to the
[284]
bathroom without his permission
[287]
so in this way he's been charged with
[291]
being an a mastermind of exploitation
[295]
and trafficking so i expect a tale from
[298]
the opening statement of the prosecutor
[301]
to lay out each of the offenses and it
[304]
will really be something that uh will
[307]
shock any person who was in that
[309]
courtroom yeah shocking is right those
[311]
allegations something like a sex slavery
[315]
camp that he was holding in his home
[318]
uh we know that this is not his first
[320]
time in trouble with the law he was
[322]
acquitted
[323]
of child pornography charges back in
[325]
2008
[327]
what is different about this trial and
[330]
who will testify now
[333]
well the whole issue laura as you just
[335]
use the word is testify what happened in
[338]
the first trial back at the acquittal of
[340]
2008 was that the victim herself and her
[344]
parents did not testify
[347]
so they were in a position as
[349]
prosecutors to try to prove a case
[352]
without a victim
[354]
here that is not so we expect a number
[357]
of alleged victims to testify in this
[359]
case over a period of weeks and when you
[363]
hear the words from the victims about
[366]
what happened to them
[368]
that creates a very different atmosphere
[371]
to say the least
[373]
we also do have to remember that our
[376]
kelly as any defendant is presumed
[378]
innocent unless and until a verdict of
[382]
guilty would come forth and as jericho
[384]
mentioned in her piece before i came on
[387]
with you
[388]
the r kelly lawyers claimed to have a
[391]
very viable defense that they say that
[394]
the media has portrayed r kelly as being
[397]
this monster but that the facts about
[400]
who he is and was and who these women
[404]
were and uh and are will happen in the
[407]
courtroom you know we lawyers say that
[409]
the great engine of truth is
[411]
cross-examination
[413]
so whether the defense is uh giving us
[416]
facts that we will see come alive in the
[418]
courtroom or whether it's just spin in
[420]
bravado that remains to be seen
[423]
let's talk a little bit about the people
[425]
who are going to be determining our
[427]
kelly's fate the jurors
[429]
and
[430]
what
[432]
do we know about them
[434]
what do you think they're going to be
[435]
hearing as testimony begins
[438]
what we do know is that there are seven
[440]
men and five women what we also know
[444]
which may be surprising to many
[447]
is that most of these jurors if not all
[450]
of these jurors who were finally chosen
[452]
in a three-day process someone might
[454]
have thought with the person of r
[456]
kelly's fame that the jury selection
[458]
process would have taken three weeks
[460]
rather than three days
[462]
but most of these people really didn't
[464]
know much about r kelly even as a
[466]
musician and they certainly knew little
[469]
or nothing about these charges so you
[472]
have a jury that is fresh and new and
[475]
that may be a good thing ricky thank you
[478]
so much for your analysis
[481]
thank you laura
