[12]
hello and welcome to the second video in
[15]
our two-part series on rent court for
[17]
tenants
[18]
in this video you will learn what
[20]
happens if judgment for failure to pay
[23]
rent was entered against you
[25]
we will discuss how your landlord may
[27]
file a warrant of restitution and
[29]
schedule an eviction
[31]
you will also learn about your right of
[33]
redemption or how to pay and stay in the
[35]
property
[37]
finally we will discuss what happens on
[39]
eviction day let's get started
[45]
your landlord's next step after judgment
[47]
is entered is to request a warrant of
[50]
restitution
[51]
they must wait until at least the fifth
[53]
business day after trial to file the
[56]
warrant
[57]
copies of the warrant are mailed to all
[59]
parties and the sheriff or constable's
[61]
office
[62]
after the copies are mailed the landlord
[65]
may contact the sheriff or constable to
[67]
schedule an eviction
[69]
in baltimore city the landlord must
[71]
notify the tenant of the eviction date
[73]
once it has been scheduled
[75]
in all other counties the landlord and
[77]
sheriff may decide whether to let you
[80]
know the date and time of the eviction
[87]
you may stop the eviction by exercising
[89]
your right of redemption
[92]
this means you can pay your landlord the
[94]
judgment amount listed on the warrant of
[96]
restitution
[98]
the amount on the warrant will include
[99]
the rent the judge decided was due
[102]
plus court costs
[104]
if you make your payment in full your
[106]
landlord must contact the sheriff or
[108]
constable's office to cancel the
[110]
eviction
[112]
in some cases you may no longer have the
[114]
right of redemption
[116]
read a copy of your judgment or the
[118]
warrant closely to check if this is the
[120]
case
[121]
the court will only take away your right
[122]
of redemption if you have three
[124]
judgments for rent in the past 12 months
[127]
in baltimore city the number of prior
[129]
judgments required is four
[132]
if your right of redemption has been
[134]
taken away your landlord may still
[136]
accept payments but is not required to
[138]
cancel the eviction
[140]
[Music]
[144]
on the day of the eviction your landlord
[147]
will meet a sheriff or constable at the
[148]
rental property
[150]
the sheriff or constable will tell you
[152]
to step out of the property
[154]
the landlord may then change the locks
[156]
if you return to the property it may be
[159]
considered trespassing
[160]
in most counties the landlord must place
[162]
your belongings along the side of the
[164]
road
[165]
in baltimore city any belongings still
[168]
in the home at the time of the eviction
[169]
are forfeited to the landlord

let's review what you have learned
[202]
if judgment is entered against you in
[205]
rent court your landlord may request an
[207]
eviction
[208]
they will do so by filing a warrant of
[211]
restitution
[212]
a copy will be mailed to you
[214]
the landlord may then schedule the
[216]
eviction date with the sheriff or
[218]
constable
[219]
only in baltimore city is the tenant
[221]
required to be notified of the eviction
[223]
date
[224]
in most cases you will have the right of
[226]
redemption
[228]
meaning you can pay the rent plus court
[230]
costs to stop the eviction
[233]
it may be taken away if you have three
[235]
rent court judgments
[237]
or four in baltimore city within the
[239]
last 12 months
[242]
if you fail to exercise the right of
[244]
redemption before the eviction date the
[247]
sheriff or constable will remove you
[249]
from the property
