button honestly so you really want to

understand the rules and the fact that

pertain to your particular situation so

in many instances are in most cases you

will not be able to claim your

girlfriend children on your tax return

however there may be a few exceptions to

that if the your facts and circumstances

lined up so that's what we're going to

look at today the first thing I want to

point out to you guys is we're really

talking about qualifying I don't know if

you guys can see this we're really

talking about qualifying child rules

versus qualifying relative ruled now

qualifying child rules has its own set

set the rules now more importantly I'm

different examples including worksheets

to calculate a support test what the

qualifying relative rules are etc etc

being a tax accountant and it being a

lot of today april ninth and the tax

deadlines april eighteenth i am strapped

on time guys I am I don't even know how

i'm making this video I I probably

should do in taxes like right now I'm

not even joking anyway now let's let's

all fine relative rules a little bit all

right there's a lot more to consider

when you're trying to claim somebody who
[174]
is not related to you now if you were
[177]
married this would not be an issue you'd
[179]
be able to claim them no problem right
[181]
but because you're not married that
[182]
where you have some issues so there's
[185]
some things you really need to consider
[187]
because like I said this is a hot I Bush
[189]
IRS really looked at this stuff closely
[192]
because there's so much fraud around
[195]
people claiming people they're not
[197]
really supposed to be claiming and
[199]
chipper has has had his own encounters
[201]
with this okay the first thing I want

you guys consider before trying to do
[214]
too much research on this is ok you want
[217]
to claim your girlfriends kids my
[219]
question for you is can your girlfriend
[222]
already claimed her kids as a qualifying
[226]
child on her tax return now notice I
[228]
said can she I didn't say will she but I
[230]
said can she because if she can you're
[233]
at a lot you cannot claim her children
[235]
if she can claim them as her qualifying
[237]
children there's like I said there's
[239]
only a few few very rare exceptions
[241]
where that would not be the case and
[243]
that's where you would be able to blame
[244]
them so that's number one the second
[247]
thing for you guys consider is since
[248]
these are not your kids is their child
[252]
support agreement in place or their
[254]
child custody agreements in place in the
[257]
decree a lot of times if there is a
[259]
child custody agreement or support
[261]
agreement it will spell out who gets to
[264]
claim that child on our tax return so
[266]
these kids of your girlfriends their dad
[269]
might be able to claim them depending on
[271]
the circus the facts and circumstances
[273]
of your situation so you have to
[275]
consider that the third thing I really
[277]
want you guys to consider do have these
[279]
kids lived with you for the whole year
[281]
now under the qualifying child rules
[283]
they only have to live with you if
[285]
they're a qualifying child but only have
[287]
to live with you for more than half a
[288]
year well since these kids are not
[290]
technically related to you at least not
[293]
yet because you're not married they
[294]
would have to have live in your
[296]
household the whole year so if you if
[298]
they have not lived in your house the
[300]
whole year
[301]
you're not going to be able to claim
[302]
them number four a lot of people have
[304]
asked also asked me besides the whole
[306]
you know can I claim these kids type of
[308]
thing is you know can't can I look up
[311]
online to see if their social security
[313]
numbers then claims and the answer is
[315]
unfortunately knew if I could if people
[319]
could do that people will be claiming
[320]
people left and right so the IRS does
[322]
not allow you to see that however one
[325]
thing you can do if you're on if you if
[327]
you do believe you can claim your grill
[329]
French children based on the qualifying
[331]
relative rules and by looking at all the
[334]
rules then if you file are each other if
[338]
you prepare your return electronically
[339]
in tax software if if it will allow you
[343]
to do the check efile do the check efile
[345]
function and a lot of times the return
[348]
will not eat file if somebody else has
[350]
already claimed that child under their
[353]
social security number so if you can do
[355]
the check a file on your return it will
[358]
often tell you whether or not that
[359]
person has been claimed you might even
[362]
just ask if if you're thinking about
[364]
claiming them make sure nobody else is
[367]
otherwise you are going to get a letter
[369]
from the lovely IRS and 0 is not
[373]
wonderful all right another thing to
[378]
consider is you do not want to claim
[380]
head of household for these children if
[383]
you're going to try to claim them you do
[385]
not want to claim the filing status
[386]
because since these kids are not related
[390]
to you they're not technically your kids
[392]
you would not be able to claim the head
[395]
of household filing status so you want
[397]
to claim a single status or another type
[400]
of status the reason I bring that up is
[402]
because one of my viewers recently tried
[404]
to claim that status on his girlfriend
[407]
kids and now he's getting letters in the
[408]
mail from the IRS and that I told them
[410]
they're probably going to disallow it so
[412]
be prepared alright guys i'm gonna start

question which is what you really need

to do is go look an IRS website and

start applying your facts to those rules

and see if it lines up and see if it

makes sense this whether or not you can

claim them based on your

your life circumstances in situation
