So, today we will speak about the Minimum Wages Act, 1948.

This is a very important Act for all employers and employees.

Employees, so that they know

they are being paid above the minimum wages.

The enforcement agency of this law is Labour Ministry,

maybe State or Central.

And, if you are getting wages less than the limit,

And, employers should know this

So, you should not make a default under this Act,

and pay your employees the minimum wages,

which is prescribed in the Minimum Wages Act.

In 1948, the Minimum wages Act was introduced.

The purpose was to ensure that

the employees get a minimum wage

by which they can maintain a minimum living standard.

When it was introduced for the first time,

The government specified minimum wages for 12 tasks.

After this, gradually, many tasks started getting included.

Today, there are thousands of tasks.

Almost, all kinds of work, related to industry,

factory, shops, construction, etc,
[148]
all of these are specified here.

And minimum wages of all these is specified.

Before, we move ahead, let's discuss 2-3 things.

First, the governing body.
[159]
The work that you are currently doing,
[161]
you need to find out, which is your governing body.

Is it Central Government or State Government?

Example. if you are working in mining sector,

the governing body is Central Government.
[172]
If you are working in agriculture,
[175]
the governing body is State Government.

If any construction project is going on,

the governing body can be Central or State Government,

depending upon, under whom the project is being executed.

If it is being executed by the Central Government,

like national highways, etc

you will get the minimum wages of the Central Government.

If the project is of the State Government,

you will get the minimum wages of the State Government.

So, the first thing, that you need to do,

you need to find out, which act applies to you -

Central or State.

The second thing which is of use is,

the skill level of employee.
[208]
Employees are divided into 4-5 categories.

Unskilled, Semi-skilled, skilled,
[216]
highly-skilled and clerical work.

Let's understand these, with the help of an example.

Take an example of construction industry.

The lowest category of workers, who work as freshers,
[229]
are in the unskilled category,
[232]
and they generally do such work where,
[234]
they need not apply a lot of thought, skill and practice.

They do work like
[240]
shifting gravel from one place to other, picking the bricks, etc.

The second category of workers, which are semi-skilled,
[245]
they have a minimum of 3 years experience,
[248]
so they are in the semi-skilled category.

Semi-skilled workers do work like mixing the gravel and cement,
[255]
sieving the gravel, etc such work,
[257]
which can be done by a semi-skilled person,
[259]
are included in the semi-skilled category.

With this example, you can pick up various industries.

Third example is skilled workers.

Skilled workers are those who stack bricks for the wall,

who twist the bars, etc those are skilled workers.

The highly skilled workers include

people with a lot of practical experience like the POP workers,

people who do the plastering,
[286]
the people who take measurements, etc.

These are included in the highly-skilled workers.

The fifth category, which is not subscribed in all the states,

is clerical work.

The people who do office work or on-paper job,
[300]
data feeding, operator, etc,

all of these are included in clerical work.

First, you need to find out,

in which Act you are covered -

Central or State.
[309]
second, which is your category,

ranging from unskilled to clerical work.

The third is zone.

Generally, the Central and State government

have specified 2 or 3 zones

in their respective state or in India,

which is called Zone A, B or C.

And, your wages are different in all 3 zones.

For example, in Maharashtra,

Mumbai and other metro cities,

is called zone C.
[335]
The rural areas are called Zone A.

Similarly, Even the Central Government

has classified Zone A, B and C.

This is generally, based on the development of the city
[346]
and the living cost, it is decided,
[348]
which zone will be applicable amongst A, B and C.

In some states like Rajasthan, there is no zoning.

there is a single zone there.

So friends, let's understand the definition of wages,
[360]
which is mentioned in this law.

It is defined as Basic + HRA and
[365]
any other allowance which is fixed monthly.

This does not include any special allowances,
[372]
you get an extra allowance to work in rains,
[377]
or a travel allowance for travelling.
[380]
This will not be included in wages,
[382]
but all other fixed allowance like Basic, HRA, DA, etc,

these will be included in wages.

Generally, in some places, wages are specified,
[393]
but there are some Acts like Maharashtra or Central Government,
[398]
where there is specifically mentioned
[401]
about Basic + Special allowance.
[402]
In such a case, the basic minimum wage is specified,
[405]
and the minimum special allowance is specified separately,
[408]
that is mentioned in the Act.

But, in the case of Rajasthan, the overall wages are mentioned,
[413]
the distribution is not mentioned.

This is also to be taken care of, whether wages are mentioned
[419]
or Basic + Special Allowance.

For example, let's see the Minimum Wages Act of Rajasthan.

I am seeing this on a website,

there are a lot of websites

and many circulars of the Rajasthan Government.

It usually gets updated in every 6 months.

Here, you can see, it is valid from 1/1/2018 to 30/6/2018.

In every 6 months, this gets updated.

Let's speak about Rajasthan first.

Here, you can see schedules are mentioned like Agriculture,
[446]
Automobile, Bricks industries, etc.
[451]
And, as I had mentioned earlier, there is no zoning in Rajasthan
[454]
like A, B or C.
[455]
The workers are distributed in different categories.
[458]
There is unskilled, semi-skilled, skilled and highly skilled.

there is no clerical category in Rajasthan.

Here, as you can see, Rs 213 per day is the minimum wage
[468]
& per month is Rs 5538 for an unskilled labour in Agriculture.

Similarly, the wage of semi-skilled labour is a bit higher.
[476]
The wage for the skilled is a bit higher,
[477]
and the highly skilled have the highest wages.
[480]
These wages keep on changing as per the schedules,
[482]
and more or less, for all the schedules, the wages are the same,

The Rajasthan Government does not make a lot of effort.
[488]
If only the daily wages are mentioned,
[490]
and you want to convert it to monthly wages,
[493]
simply multiply it by 26,
[496]
and it gets converted into monthly wages.

And, towards the end of the schedule,

piece wages and all things are also defined.

Here, you can see,

washing clothes for 60 minutes, it costs Rs 757 per month.

For all the domestic work, minimum wages are prescribed.

When you see the full circular of Rajasthan Government,

you will even get piece wages,

For example, if you make a toy, how much should you get per toy.

Even those wages are defined in the circular for Rajasthan.

Next. let's speak about Maharashtra.

This is a bit old - 1/1/2017 to 30/6/2017.

But you can get an idea.

As I mentioned before, zones are allotted.

There are 3 zones 1, 2 and 3.

Here, let us speak about the Automobile sector - skilled labour.

Zone 1 - The salary is Rs 9381

Zone 2 - The salary is Rs 9081

Zone 3 - The salary is Rs 8781

Zone 3 has the lowest wages,

and Zone 1 has the highest wages.

Zone 1 may includes metro areas,

zone 2 may include small towns and cities,

zone 3 includes rural areas,

where the cost of living may be less.

Similarly, for all the schedules,

the minimum wages are prescribed,

according to skilled, unskilled and semi-skilled.

When you see here above,

it is a mixture of Basic plus Special allowance.

Here, the basic is also mentioned Rs 7900.

and the special allowance of Rs 3024.

In many states, overall wages are written,

but in Maharashtra, basic and special allowance are mentioned.

This is at the discretion of the State Government.

Let's move towards Central Government.

These are the Central Sphere wages from 1/4/2018 to 30/9/2018.

These gets revised for 6 months.

There are zones here. like A, B, C.

A zone is the highest and C zone has the lowest wages.

There are 5 categories -

unskilled, semi-skilled, skilled, highly-skilled, clerical.

And there are schedules on the left-hand side.

Based on the schedule, you can find your minimum wages.

Now, overall, you have understood,

it is easy to find out the minimum wages,

if you know 3 things,

your zone, your skill level and your state.
