federal government contracting has

significantly increased over the years

large and small businesses alike are

actively seeking new opportunities to

increase revenues the US government is
[22]
by far the largest customer of
[25]
commercial services and products
[26]
although a very lucrative venture there
[29]
are complex regulations and laws that
[31]
contractors must face in the current
[34]
administration there is a mandate for
[36]
more scrutiny on federal contracts and
[38]
performance this puts current
[41]
contractors in sensitive situations here
[44]
with us today is Theodore Watson

a lot of us hear the term government
[59]
contracts often we think about companies
[61]
like Halliburton or Boeing what's the
[65]
difference between a large company like
[66]
that and a small business owner that's
[68]
looking to secure a contract how does a
[70]
small business owner best position
[72]
themselves to get that work well I think
[75]
the first approach needs to be Congress
[78]
gets a lot of their taxes the
[80]
significant portion of their taxes
[82]
revenues from small businesses because
[85]
of that it's incumbent upon the
[87]
government to create opportunities for
[90]
businesses small to secure more
[94]
contracts each industry is designated
[101]
with a North American industry
[103]
classification code and in layman's
[106]
terms that is if its construction it
[109]
will be a 236 next codes that identify
[111]
what that company does along with that
[114]
is a certain limitation on annual
[117]
revenues for construction again you're
[119]
probably looking about 30 3.5 million if
[121]
you're making less than that you're
[123]
considered a small business by
[125]
regulation mm-hmm the other point I
[128]
would add is when you look at government
[129]
contracts about 15 20 years ago when I
[132]
was in the blue suit
[133]
government contracting was very
[135]
difficult and a lot of the commercial
[138]
sectors turned away from doing business
[140]
with the government they termed it to
[143]
red tape well Congress seeing that
[146]
wanted to change the rules to encourage
[149]
those businesses to come back to the
[151]
government to do work so what they've
[153]
done now is created what they call
[154]
performance-based contracts in a
[156]
nutshell the government gives the end
[159]
result that they want the contractor
[161]
comes in and tells the government how
[163]
they're going to do it so that's
[164]
something out there that viewers need to
[166]
understand that the rules are changing
[169]
to make it a lot easier for businesses
[171]
to do to come and do with the federal
[173]
government so this does your law firm
[175]

proposals or do you just deal with

disputes or good question again with the

economy we're trying to create a

business model to adapt to the economy

and more specifically to the needs of

contractors so what we've done is in

addition to dealing with the legal

disputes I always say federal
[200]
procurement is a process it begins part
[202]
a with the companies who are now turned
[205]
into government contracts we're trying
[207]
to market themselves all the way to
[210]
contract closeout so to answer your
[212]
question more directly we try to build
[214]
relationships upfront with the issues
[218]
that customers are looking to get help
[220]
with hence the proposal writing the
[223]
market it and then once they acquire the
[226]
contracts then we go down the pike and
[228]
we deal with the compliance issues
[232]
sometimes it may be a big protest that
[234]
we may have to file so in comparison to
[237]
the other traditional law firms what
[240]
we're trying to do is adjust to the
[241]
economy and focus on what the clients
[243]
are really facing increase their bottom
[245]
line so it's a through z process and so
[249]
having been in the military yourself and
[251]
having been a small business owner
[252]
yourself acquiring government contracts
[254]
I suppose you won't admit it but you
[256]
probably do have some pretty significant
[258]
insight into that process and how it
[261]
works I mean is that really play to your
[263]
firm's advantage and
[264]
being able to help process these things
[266]
perfect question I think for any client
[268]
whether it's a contractor or anybody
[271]
when they come to firms like mine they
[274]
want to understand first that you
[276]
understand what their concerns and
[278]
problems are so answer your question I
[280]
think a good position to be in is to be
[284]
able to have understood to be able to
[286]
understand the other side I've been
[287]
there on the other side dealing with the
[289]
small business programs and so forth so
[292]
that when clients come to me it's not
[295]
just for legal dispute I know how the
[297]
process works so I'm in a better
[300]
position to align them with how to
[303]
restructure how to refocus how to
[305]
develop internal controls so that they
[308]
can be in compliance so an actual fact
[310]
they're talking to somebody has been on
[312]
the other side okay is there anything
[314]
important that you'd like to add that
[316]
you think we have not covered this
[318]
afternoon I think you touched on it
[320]
earlier in this economy I think a lot of
[323]
the contractors out there need to
[325]
seriously look at what's working for
[327]
them and what's not from my perspective
[330]
I'm seeing a big struggle in the
[333]
proposal writing aspect because
[336]
obviously that's how they secure
[337]
government contracts there's obviously
[340]
different ways of getting government
[342]
contracts there's certain small business
[344]
programs such as da days and hub zones
[346]
etc these are congressional programs and
[349]
out there but I really think that they
[351]
need to focus on a restructuring what
[355]
they have done in the past to adjust the
[358]
way the economy is going now and more
[360]
importantly how the agency's change in
[363]
the old habits and selecting bids for
[366]
award once they adjust and do that what
[369]
we're doing is offering training and the
[373]
various aspects for 2012 for example we
[376]
have a lot of bid protests classes and
[379]
how to prevent them proposal right in
[381]
classes to really get into the meat and
[383]
potatoes about what really works instead
[386]
of just a general overview of proposal
[388]
writer that's kind of what you see out
[390]
there and do you provide free
[392]
consultations actually we do yes and
[395]
obviously I think that
[397]
to the benefit of the client they the
[400]
relationships that we form the client
[402]
has to see a as we talked about earlier
[405]
do we understand what their problem is
[407]
and I think it's fair to a potential
[410]
client to at least be able to not be
[412]
charged for that time to be able to see
[415]
if there's a relationship so yes we do
[416]
