talk about how to apply for long term
[10]
disability or short term disability
[12]
benefits with Lincoln although as I said
[15]
that I'm thinking I commonly see mostly
[17]
long term disability claims with Lincoln
[19]
however we know that Lincoln Financial
[22]
took over Liberty Mutual and we know
[24]
that Liberty also soul
[26]
sold a lot of short term disability
[27]
policy so high likelihood that that
[30]
Lincoln is handling a bunch of short
[32]
term disability as well as long term but
[34]
in this video I want to talk about the
[36]
important things that people need to
[37]
look out for and that they should know
[39]
when applying for these benefits now
[41]
obviously we helped hundreds of people
[44]
apply for benefits with Lincoln and
[47]
Liberty as well and we've and we've done
[50]
that in the past more available to help
[51]
but we're gonna give a road map as to
[52]
what to do because it can be done on
[54]
your own but I want people to be aware
[56]
of the pitfalls because of the fact that
[58]
I want you to get right into is what are
[60]
the implications if you make one mistake
[62]
that results in a denial one of the
[65]
hardest things you know in a lincoln
[67]
product or Foe is an old Liberty they're
[68]
calling it Lincoln they're they're
[70]
slightly different in there and the way
[71]
that they're gonna go about handling
[73]
certain aspects of your claim but the
[75]
big thing on a denial especially if this
[77]
is a true Lincoln policy is they have to
[80]
mandatory levels of appeal so what that
[83]
means ultimately is if you don't get
[84]
your application right the first time
[86]
and you have to go through two appeals
[88]
with them they will have up to six
[90]
months on those Appeals alone to conduct
[92]
a review so not getting it right with
[94]
Lincoln on the first go can mean you
[96]
could be out without benefits for an
[99]
extremely extended period of time and
[101]
just getting awarded short term if you
[103]
do doesn't necessarily mean the long
[106]
term will get awarded so then you're
[107]
you're you know could be well past the
[109]
time long terms pain you got to make
[111]
that application so with with Lincoln
[114]
more so than a lot of the other
[115]
companies you really want to make sure
[116]
you get it right just from that timing
[119]
standpoint and and remember that six
[121]
months that you're talking about is
[123]
after the elimination period and the
[125]
elimination period is how long you have
[126]
to wait before you're even eligible for
[128]
benefits which is usually 90 or 180 days
[131]
so if they deny you
[133]
you have a six-month elimination period
[135]
and it's gonna take six months to go
[137]
through two Appeals you could be waiting
[139]
a full year before you get benefits and
[141]
there's unlikely even more likely mana
[144]
and and that's if you win your appeal so
[146]
it could be a long run so you want to do
[148]
it right so first step in doing this
[151]
thing in my opinion is you got to
[153]
understand the policy language and
[155]
specifically the definition of
[156]
disability and why is that the first
[159]
step in the process of applying for long
[161]
term disability the first step the
[163]
reason being is is that you need to know
[165]
is your policy covering you from the
[166]
inability to do your own job or they
[168]
inability to do any occupation more
[170]
often than not it's going to cover you
[172]
for at least the first twenty four
[173]
months if you're unable to do the duties
[175]
of your own occupation with the caveat
[178]
that all the Lincoln policies will have
[180]
language that says your regular
[181]
occupation is not how it's done for your
[183]
employer or at the location that you
[186]
work at it's how it's done in a global
[187]
sense in the national economy so you
[190]
want to understand how they're gonna
[192]
look at you when it comes to disability
[193]
and then the parameters of what your
[196]
occupation is gonna mean and honestly I
[198]
see this more and more with applications
[200]
and it should be common sense or you
[202]
would think it is make sure you're going
[204]
to a doctor because a lot of conditions
[206]
that people go out on work for they may
[208]
need to go see a specialist
[210]
and sometimes it can take a while to get
[212]
in this you see this especially with
[213]
mental health claims where people aren't
[215]
actively getting treatment but they're
[216]
having issues and they try to make an
[218]
appointment with a doctor and by the
[220]
time they're able to get in with that
[221]
doctor they may have already filed so
[223]
Lincoln's looking at it well we have no
[225]
medical evidence so first and foremost I
[228]
think it's really important that the
[229]
medical is already established before
[232]
you really consider going out on
[234]
disability okay yeah I was gonna segue
[236]
into when do you think is the best time
[239]
to file for a claim and I want to give
[241]
the caveat to people that are watching
[243]
this video that we often consult with
[245]
clients while they're still working
[246]
because unless you get hit by a bus or
[249]
have a cat you know or have a very
[252]
serious medical diagnosis of something
[253]
that you didn't know about yeah then
[256]
then the likely it is you've been
[258]
working with pain or discomfort through
[260]
your job and that's how 95 percent of
[262]
these claims are you didn't just wake up
[264]
me like I can't work at all and if it
[266]
does happen then that
[267]
happen but let's go with the majority of
[269]
the claims so with that being the case
[271]
we've consulted you beforehand and said
[273]
here's what needs to happen now if
[275]
you're the type of person that wakes up
[276]
and says I can't do this anymore and
[279]
you've been suffering for six months and
[281]
you have no medical treatment and then
[282]
you call us up and say yeah I stopped
[284]
working the other day I'm done working
[287]
and I haven't been to a doctor yet but I
[290]
know I've got really bad back problems
[292]
and this and that what's the problem
[293]
with that for that person the problem is
[295]
gonna be is there's no medical
[297]
information contemporaneous when they
[299]
stopped working to support that they
[301]
couldn't work because Lincoln is not
[302]
going to take your word for it they're
[304]
gonna see what the medicals say so the
[307]
treatment aspect is so important and
[310]
then even if you are treating and you
[311]
know like you were saying you've been
[312]
working with this issue for for months
[314]
and months and months the argument back
[316]
from Lincoln's can be what changed you
[318]
know if you could do it before why can't
[320]
you do it hit you both ways mhm and and
[322]
and someone's watching us and hearing
[324]
what we said well okay I'm thinking of
[326]
filing I don't have maybe I haven't go
[329]
to the doctor but how much is enough
[330]
medical support how do you know well
[333]
that's that's a really fine line that's
[334]
that's a very good question I mean is
[336]
one appointment gonna do it I mean I
[339]
guess it depends on the on the medical
[341]
condition but we'll talk in the idea of
[343]
you know like a back pain problem issue
[345]
like that something isn't a catastrophic
[347]
diagnosis there that is a really good
[350]
question and also you also want to build
[352]
enough rapport with your doctor that
[353]
your doctor is gonna be willing to fill
[355]
out forms on your behalf is gonna be
[357]
willing to speak to you know doctors
[359]
from Lincoln to support you so there
[361]
does need to be a relationship
[363]
established with the doctor and then you
[365]
know what that doctor is gonna be
[367]
willing to say and what the doctor puts
[368]
in the record so it's really hard to say
[370]
how much is enough my experience is that
[374]
the vast majority of the people that
[376]
contact us don't want to stop working it
[379]
doesn't make sense that you want to stop
[381]
working because you're not replacing
[382]
your income if it was dollar for dollar
[384]
then everyone would have an incentive
[386]
but disability rarely covers what you
[389]
were making the most it pays is up to
[390]
two thirds of what you were earning so
[392]
you're already at a loss you know by
[395]
getting on disability but the other
[397]
thing I find is that people work through
[399]
their ailments and then like you just
[401]
said the insurance company punishes you
[403]
for that because you say oh I you looks
[405]
like you did it for six months or a year
[406]
or you say your complaints go back a
[409]
year and a half ago when you saw a
[411]
doctor once and you haven't been back
[412]
and then you end up going the doctor you
[415]
know a year and a half later and then
[417]
they say but you didn't really have any
[418]
treatment so how bad could it have been
[419]
so these are scenarios that you and I
[422]
are just bringing up but that's where we
[424]
coach the client to go through to
[427]
document because we always say the case
[429]
is only as good as it looks on paper and
[433]
what that means is that when when the
[435]
carrier in this case Lincoln Financial
[437]
gets to claim they're gonna look at it
[439]
and say they're gonna send the file out
[441]
to their nurse or their in-house doctor
[443]
and they're gonna get a medical review
[444]
back they're not gonna talk to you
[445]
likely they're not going to visit with
[447]
the with the claimant at all and they're
[449]
gonna base their review based on what
[450]
they see in that file so when people
[452]
call me I always say I need to make you
[454]
look messed up on paper now that may
[457]
sound offensive to you or may sound rude
[459]
but the truth is that if you don't look
[461]
messed up on paper then the likely it is
[463]
your claim is not going to get approved
[465]
so moving forward when we help the claim
[467]
and apply how do we work with their
[469]
doctor to get the records to the point
[471]
where it needs to be so that they have
[473]
appropriate medical support you know the
[475]
big thing is going to be the
[476]
documentation specific to your condition
[478]
you know if there are certain tests that
[480]
can be done to verify you know going
[483]
along with an idea of pain conditions so
[485]
you got radiating pain down into the leg
[487]
do you have MRIs do you have EMG nerve
[489]
conduction sighs do you have objective
[491]
evidence the doctor can rely on to
[493]
support restrictions and limitations are
[495]
going to apply then it's also very
[497]
important that the doctor is viewing it
[499]
and understanding that for purposes of
[501]
the disability this isn't about your
[502]
ability to activities of daily living
[504]
it's it's specifically to be in a
[505]
workplace work with reasonable
[507]
continuity and things like that
[509]
something I always touch upon with
[511]
clients too in an application process
[512]
because doctors like you said
[513]
understandably don't like dealing with
[515]
insurance companies you know the you're
[518]
more than likely almost probably 99% of
[520]
all the Lincoln policies with a few
[522]
exceptions are going to be governed by
[524]
the federal law orissa
[525]
and under that you know your doctor
[527]
would never be deposed by a lawyer will
[529]
never testify in court so a lot of
[532]
doctors are worried that they make
[533]
wrapped up in a long legal battle so
[535]
it's also educating the doctors as to
[537]
the fact that the only thing if it ever
[539]
ends up in court that will be considered
[541]
by a federal judges what that doctor put
[544]
in records or what they wrote in
[545]
statements so it's helping the doctor
[547]
understand the purpose of what's what's
[550]
what's happening in and making sure the
[552]
complaints are being documented you know
[554]
say you know patient has been saying for
[555]
several months having issues at work
[557]
I've recommended reduction and work
[559]
maybe taking time off and that's where
[561]
it comes in when you said with you know
[562]
coaching a client into setting up for
[565]
the disability because a lot of people
[566]
also concerned you know my work is
[569]
struggling I may not have been to the
[571]
doctor as much as I should
[572]
I'm afraid my employer may terminate me
[575]
before I can even file a claim so there
[577]
are so many moving parts that it can
[579]
just be really good to get the peace of
[581]
mind to have it set up in a way to make
[583]
it presentable because you're right
[585]
these people don't they don't want to
[586]
stop working it's it's no financial
[588]
incentive to of them so and we could go
[591]
on you know we've just scratched the
[592]
surface but the point is medical support
[594]
is essential and how you work it and
[596]
work and then we're gonna look at it
[598]
from a perspective of not just one
[599]
doctor but as many doctors as we
[601]
possibly can get to support the claim
[604]
and then you know the claimants also
[605]
people don't like to complain but you
[607]
need to go in and complain to the doctor
[609]
because if it's not in your records it
[610]
doesn't exist so that you know the the
[613]
other very important step I would say
[615]
step two is then you finally get to this
[617]
point where you get these claim
[618]
documents and you get you get these
[620]
forms and these forms are very generic
[622]
when I say they're generic why is that I
[625]
think it's a problem and and how do you
[627]
prepare your application so you can get
[629]
away from the generic nature of the
[631]
lincoln financial claim forms well the
[633]
problem with those claim forms is
[635]
realistically even though they will mess
[637]
up also potentially provide claim forms
[640]
related to mental health conditions so
[642]
it's more specific to that but any
[644]
physical medical condition it's the same
[646]
form they're talking about you could be
[648]
suffering from migraines they want to
[649]
know how much you can lift how much you
[651]
can sit things that aren't necessarily
[653]
being impacted by the conditions so with
[656]
these claim form some people feel that's
[658]
important to squeeze it all in the
[660]
little lines but we do addendums we do
[662]
attachments to be able to elaborate and
[666]
explain
[666]
more but also not explain too much you
[670]
know because remember they're gonna rely
[671]
on all this stuff so it's providing the
[672]
information in a in a concise way that's
[676]
encompassing what's really going on so
[679]
you know addendums to the policies I
[682]
mean I'm sorry to the application
[683]
documents are very important okay and
[685]
one of the most important addendums that
[687]
we always do that goes in line with
[690]
understanding the definition of
[691]
disability which we started this video
[692]
out talking about is how the claimant
[695]
describes their occupational duties why
[697]
is that so important well because every
[701]
insurance company Lincoln is no
[703]
different is going to try to strip it
[704]
down to the physical components of the
[706]
job for instance we're lawyers
[708]
Department of Labor says we have
[710]
sedentary jobs
[711]
Lincoln would pay lip service to some of
[713]
the duties we have to do in a generic
[715]
sense but they're always going to go
[717]
back with you know sedentary and we
[718]
think you have the physical ability to
[720]
do sedentary work so you want to hit
[722]
very early on the dialogue of what those
[724]
actual occupational duties are because
[726]
if all of us just had to sit for a while
[728]
lift up to ten pounds to do our jobs
[730]
work would be really easy so it's really
[733]
focusing the dialogue and if you have a
[735]
generic description from your employer
[737]
they may even classify your job
[739]
incorrectly under the national economy
[741]
standards so it's really important to
[743]
have that and documented in the file
[745]
just also in the event is extra you know
[748]
security in the event they do deny the
[750]
claim that's deeply embedded in the file
[752]
from the get-go and it could be
[754]
something a judge would take into
[755]
consideration later on all right and the
[757]
other thing we'll do is you can think
[758]
about getting things like support
[759]
letters from your employer your boss
[762]
your supervisor your co-workers family
[764]
members and there's a strategic manner
[766]
in which those should be drafted as well
[769]
because the kareoke says like you said
[771]
before well what was going on beforehand
[773]
we can't tell from the medical records
[775]
but it's helpful to have a peer review
[777]
from those people I just mentioned to
[779]
say yeah so-and-so was suffering so a
[782]
difficulty with this because then they
[783]
pull those employee reviews and
[785]
employers often tend to write positive
[788]
employee reviews that don't necessarily
[789]
represent the weaknesses of the person
[793]
may have and then they'll say well all
[794]
of your employee reviews were consistent
[796]
so there's so many different I mean like
[798]
we're just throwing out scenarios
[800]
there's hundreds of different angles to
[801]
look at of all the scenarios that we've
[803]
seen of how Lincoln financials gonna
[805]
look at this claim that a person can
[807]
make a mistake well I think it's almost
[809]
in a way like you're you're basically in
[811]
summary is they're not looking for ways
[814]
to approve your claim they're looking
[815]
for ways to deny your claim right and
[817]
and then in terms of putting it all
[819]
together at the end of the day you take
[822]
all this information and how do you how
[825]
important is it to determine the date of
[827]
disability extremely important you want
[831]
to make sure that it's coinciding with
[833]
times and dates of treatment
[835]
some people like we said they file for
[837]
disability then they go see the doctor
[838]
right so having you know a setup to the
[841]
story of where the problems are in lying
[843]
in it you know how do you approach the
[845]
employer with it
[846]
you know often with some of my clients
[848]
will say well listen you're having
[850]
issues and if you're concerned about
[851]
your your job being on the line if you
[854]
have vacation time or sick time put it
[856]
in you know you they don't need to know
[858]
why you're going out but if that first
[859]
day you miss you can use that as a dated
[861]
disability so strategically planning it
[864]
in a way to not only protect you with
[867]
your employer to make sure that they
[869]
don't fire you and then you're without
[870]
not without coverage but also just
[872]
setting it up so there's a clear line as
[874]
to why this is happening now because
[877]
most people don't think to to do these
[880]
things they think I'm gonna work and you
[881]
know I can't do it anymore my insurance
[883]
company's gonna do the right thing by me
[885]
okay so I want to talk about like 20
[888]
other issues that deal with the why
[890]
because it's the foundation of
[892]
everything that goes on and then we can
[894]
make it so good in the beginning and
[896]
eliminate all the problems from when the
[898]
other people call us when they've been
[899]
denied we can't recreate time but we can
[901]
make we can create the record we can
[904]
write the script per se and really
[906]
present you in the light most favorable
[907]
to support your claims so easy process
[911]
to work with us especially at this stage

the the easiest thing to do is give us a
[915]
call or fill out our free consultation

form we're gonna ask you to provide us

with a copy of your disability insurance

policy from Lincoln Financial we're

because of the fact that once you get

guarantee this isn't like you gotta

prove just like you applied for a pay

your premium know you got approved and

they're gonna evaluate it month after
[968]
month after month and we stick with you

throughout that process cuz we want you

to continue to get paid for as long as
[973]
you think you need this policy so we we
