Tax season is upon us, there are聽 a lot of tax breaks out there,聽聽
[15]
and there are some for 2021 that are聽 different than there will be for 2022.聽
[19]
Please join me as I sit down with Tom Breedlove,聽 the senior director of business development聽聽
[24]
for nanny payroll company Homepay. And聽 trust me, you don't want to miss this,聽聽
[28]
even I learned about several tax聽 breaks that I didn't know about before.

Laura: Hi everyone, I'm here聽 today with Tom Breedlove,聽聽
[35]
the senior director of business聽 development for Homepay. Thank you聽聽

so much for joining us today Tom. Tom: thanks for having me, Laura.
[42]
Laura: So today I have a few questions about nanny聽 taxes, and how to handle them for the current year聽聽
[48]
that we're right now we're dealing with 2021,聽 but then also to ask about any changes for 2022.聽聽
[55]
So, thank you again for joining us to聽 kind of walk us through all of this.

Tom: Sure!

Laura: So, let's start with clients who are聽 working right now on their 2021 tax returns,聽聽
[66]
what are the 2021 tax returns that these families聽 should know about as they pertain to child care?
[72]
Tom: A lot of people have heard of the child tax聽 credit, but there's also a thing called the child聽聽
[78]
care tax credit which is聽 really important to families,聽聽
[84]
and the way that that works is that that tax break聽 allows families to itemize this last tax year 21,聽聽
[91]
up to $8000 per child with a cap of $16 000 per聽 family. So, if you have more than two kids you聽聽
[100]
have to stop at $16 000, but what that allows聽 you to do then is take any dependent care,聽聽
[106]
it could be a daycare center, it could be fees聽 paid to your firm to find a nanny, it could be聽聽
[114]
wages paid to the nanny taxes paid behalf of聽 those wages for the nanny, even day camps count,聽聽
[122]
and families can then itemize up to $16000, and聽 then take a credit of up to 50% on those dollars,聽聽
[130]
and that 50% is actually can fluctuate聽 a little depending on how much聽聽
[136]
your adjusted gross income is. But, for a lot of families,聽聽
[139]
it will be 50% or close to that. So, you can see that family could come you know聽聽
[145]
could make as much as $8000 in tax savings just聽 by taking advantage of of these child care tax聽聽
[152]
credit, and these raised expense limits. So, if聽 you're getting annoyed really close to tax time.聽
[159]
But, if you have an accountant, we can actually聽 prepare or work with your accountant to get a聽聽
[164]
schedule H prepared to get wages paid in from聽 last year, all documented properly so that the聽聽
[171]
accountant can then follow the family's tax聽 returns. It may be that we're at a point now聽聽
[177]
where we want to try to get an extension, but聽 that's very common so that your accountant can聽聽
[182]
file an extension we can get the scheduled age聽 and the other documents prepared, and then when聽聽
[188]
your accountant files it you'll be able to take聽 advantage of all those tax savings and maybe get聽聽
[192]
up to $8000 back if you have two or more kids. So,聽 it's a good year for the child care tax credit.

Laura: Wonderful! So, I think I learned聽 a couple things here. I learned that by聽聽
[202]
sending my child to a summer camp which is聽 just a day camp that covers the working hours聽聽
[208]
that is actually something that can聽 be a tax credit those expenses. So,聽聽
[212]
that's interesting, I don't think聽 I ever actually knew that before.
[215]
And then the other thing is that, if I'm a family聽 who has been just paying my nanny in cash maybe聽聽
[220]
under the table, it's not too late for this year聽 to kind of retroactively bring everything up to聽聽
[226]
speed legally with regards to taxes, and then also聽 to be able to take advantage of those tax breaks.
[232]
Tom: That's exactly right!
[234]
Laura: That's fantastic!
[235]
Tom: Yeah, and those camps that you聽 brought up, they can be any kind of camp.
[243]
Laura: It's not the only聽 night camps though, right!
[245]
Tom: Overnight camps are excluded,聽 premises it has to be so that the聽聽
[250]
parents can work. But, any kind of day camp聽 during the summer would fall into that character.
[256]
Laura: Okay, wonderful, that's great聽 news! And then for a family paying a nanny聽聽
[261]
in the 2022 tax year, how do the tax breaks聽 work for 2022, and are there any changes?
[267]
Tom: Yeah that's a great question, and honestly聽 we're in kind of in a fuzzy area right now,聽聽
[273]
because the build back better act which聽 is currently kind of stalled in congress,聽聽
[278]
would actually change the amounts that families聽 could save for 2022, and it's in the proposal聽聽
[288]
may go to that amount, if it doesn't I聽 think it was $4000 is what's being proposed,聽聽
[293]
$4000 per child. So, it could go to that level.
[296]
The worst-case scenario is it will revert back聽 to the level it used to be before 2021 which聽聽
[302]
is $3000 per child, and a cap of $6000,聽 and then families can itemize, or use the聽聽
[309]
tax credit percentage against those expenses. So, what we're finding & what I would probably聽聽
[316]
tell your families is this year the probably the聽 most lucrative tax break will be an FSA, Dependent聽聽
[324]
Care FSA If their employer offers it. And, a聽 lot of companies offer Independent Care FSA.聽聽
[330]
They usually have what's called an open聽 enrollment in the fall in anticipation of 2022,聽聽
[336]
they probably did it that last October, but what聽 a lot of people don't realize is that there are a聽聽
[341]
lot of opportunities to get in mid-year because聽 there are what they call life-changing events,聽聽
[347]
and if you have any kind of life-changing event聽 which is switching a job, you might switch your聽聽
[351]
job you might switch care providers, or from a聽 daycare center to a nanny, for instance, that's聽聽
[358]
considered a life-changing event. If you had a聽 baby course that would be a life-changing event.
[363]
So, there are a number of things that each聽 HR Department has the ability to use as聽聽
[370]
an opportunity to enroll mid-year. So, you usually have a 30-day window聽聽
[375]
around those events, so I would encourage聽 your families that if they just had a baby聽聽
[380]
if they just switched jobs at any of those聽 life-changing events, or even if they're just聽聽
[384]
not sure, go ahead and talk to your聽 hr department. See if you can get in聽聽
[388]
mid-year because they do have like I said聽 a number of loopholes to enroll mid-year.
[393]
But then, you'll be able to set aside up to $5000聽聽
[398]
per family, per year, and then you as a聽 taxpayer wouldn't have any taxes on that $5000.聽聽
[406]
So, your families wouldn't have any income聽 taxes, any social security, any medicare,聽聽
[412]
all those taxes that typically get taken out,聽 for that $5000 they wouldn't have any taken out.聽
[417]
So, it typically saves families close聽 to a couple thousand dollars a year, and聽聽
[422]
this year unless the buildback better act passes聽 and actually gets increased a little bit, I'm聽聽
[428]
thinking that the FSA will probably be the best聽 bet for most families if they can enroll with you.
[433]
Laura: Right, okay that makes sense. My key聽 takeaway from that is, to be in touch and be聽聽
[439]
good friends with your HR Department. You can聽 reach out to them, and they can kind of walk聽聽
[444]
you through anything that should be on your聽 radar, based on what's happening in your life.
[449]
Tom: That's exactly right. And, if you you聽 know if your families have any questions about聽聽
[453]
any of this on their personal situation, or聽 if they want to understand more about what聽聽
[461]
if I become an employer, and I put my nanny on聽 the books, what are the cost, I know there are聽聽
[465]
some taxes, what is all that going to cost me. We have a team dedicated to helping families聽聽

tax breaks will be as an employer, and often times聽 the tax breaks will offset a large percentage聽聽

of the taxes. So, if families don't have to聽 come out of pocket too much to pay legally.

Laura: That's a really great point because that is聽 a concern about when families are considering any聽聽
[493]
care budgeting, and how much those nanny taxes are聽 going to cost, and I do have some budgeting tools聽聽
[499]
also I offer families, but it's important to know聽 that if you do things legally, those tax breaks聽聽
[504]
are there for a reason they do offset those聽 nanny taxes, which are concerned for so many.
[508]
Tom: They do, and back to the 21 tax year. I think聽聽
[512]
this year more than ever families many families聽 will come out ahead because of that $8000 that聽聽
[518]
I mentioned earlier that a lot of families will聽 get from this year is actually probably far exceed聽聽
[525]
by 4, 5, 6 thousand dollars probably聽 what the employer taxes would be.聽
[530]
So, you know you could really聽 gain some net positive cash there.
[536]
Laura: And nobody will ever be聽 sad about that, that's for sure.
[540]
Tom: That's right!
[540]
Laura: Okay! And, does everybody聽 qualify for these tax breaks?
[543]
Tom: Yeah that's a great question. The way the laws is structured聽聽
[548]
the dependent who is receiving care has to be聽 under the age of 13, or if they're over the age聽聽
[554]
of 13, they could still qualify but they have聽 to be mentally or physically unable to care for聽聽
[559]
themselves. So, there are some exceptions. But,聽 usually under 13 and then the other restriction聽聽
[565]
is that families both spouses have to work, or聽 be full-time students. So, as long as they're聽聽
[572]
the goal is to allow them to either be able to聽 participate in the economy, or be going to school,聽聽
[579]
and that's why the care is needed, and so both聽 spouses need to show that they're working or going聽聽
[585]
to school. But as long as those two things聽 are met, there are no income restrictions,聽聽
[591]
no matter how much a family makes, they can聽 still take advantage of these tax breaks.
[595]
Laura: And then if people have questions about聽 how this works, can they reach out directly聽聽

for themselves. A lot of folks do decide to pay聽 legally, and if they do decide to pay legally,聽聽

we can certainly explain what we do to make that聽 super easy for families because we have a service聽聽

that takes care of everything so they don't have聽 to spend their weekends trying to do tax stuff.

Laura: And having done taxes both ways before聽 handing off to a payroll company versus doing聽聽
[657]
payroll for our nanny ourselves, I can personally聽 attest to the fact that it is so much nicer to be聽聽
[662]
able to handoff. When I say so much nicer to聽 hand off I mean my husband because I wasn't聽聽
[666]
the one who handled that. I know he appreciates聽 the extra time, but yeah it's just it's really聽聽
[672]
nice to know that you guys, this is what you聽 do all day long, you can really go into this聽聽
[677]
and be able to trust that things are going to聽 be done correctly, you know people are going聽聽
[681]
to get paid on time, that sort of thing. So, I always encourage families just do聽聽
[685]
one less thing, and just hand聽 off the payroll, it's so nice.

One last question actually, it just made me聽 think about who can call and ask for help!聽聽
[693]
Can nannies call and ask you for help too if聽 they have questions about taxes or legal pay?
[697]
Tom: Yeah we get quite a few nannies聽 who do call and have a few questions,聽聽
[702]
and it's usually around like the w-4 when聽 you're trying to pick withholding how much taxes聽聽
[709]
should I withhold, and how many allowances should聽 I choose, and that kind of thing. But, we also聽聽
[714]
get a lot of questions about you know social聽 security, and how the earnings credits work, and聽聽
[720]
medicare, and disability, and聽 unemployment, and obtaining loan聽聽
[724]
things like the child tax credit for nannies,聽 because a lot of them have children and聽聽
[730]
they're able to then take advantage of that. So, there's a number of tax-related things,聽聽
[735]
work agreements, paid time off, paid sick聽 leave, those kinds of things a lot of times聽聽
[739]
nannies have questions about that, just like聽 families do, so we're here for them as well.
