while driving under the influence聽聽

this case was one of major controversy聽
as it demonstrated the reality of being聽聽

able to use one's wealth as a get out of jail聽
free card however now it was given a formal name聽聽

affluenza and many couldn't believe that this聽
defense was used to justify such a horrific crime

ethan couch was born on april 11 1997 to parents聽
fred couch and tanya couch fred was the president聽聽

and owner of clay burns sheet metal a large-scale聽
metal roofing company with over 40 employees聽聽

while tanya did some work as a vocational nurse聽
as well as odd jobs from fred's company as a child聽聽
[49]
eden was described as a cute little聽
kid who seemed happy to be in school聽聽

he was a great student and was聽
never mean to his fellow classmates聽聽

his childhood however was a dysfunctional聽
one due to fred and tanya's parenting styles聽聽

fred according to a psychologist had been聽
angry since his childhood he was arrogant聽聽

and prideful and flaunted his wealth around聽
with little regard for potential consequences聽聽

although tanya is described as kind she frequently聽
enabled ethan according to one of ethan's teachers聽聽

tanya's biggest problem was that she loved him聽
so much she couldn't tell him no both parents聽聽

especially his mother toted ethan as a golden boy聽

reason she and fred were getting divorced聽聽

was due to verbal and physical abuse fred would聽

described ethan as polite and patient he had an聽

from school 50 days in kindergarten and 40 days聽聽

the dysfunctional world in which ethan and his聽聽

parents lived in fred and tonya who had remarried聽
had moved to a new house while ethan was still聽聽

parking lot of a dollar general at 1 am inside the聽
truck the officer also found a 14 year old girl聽聽

who was undressed as well as bottles of alcohol聽
ethan was clearly intoxicated when asked what he聽聽

doing given his age his mother tanya was called to聽聽

the scene after she arrived ethan explained to his聽
mom that he had only drank one beer tanya's only聽聽

concern however was hiding the incident from her聽
husband although ethan had broken a number of laws聽聽

he was only issued two tickets one for minor in聽
consumption and the other for minor in possession聽聽

there took shots with ethan they ate dinner聽聽

and then left to pick up a few people and聽
stopped by a store to get more alcohol聽聽

driving his dad to f350 the group went to a nearby聽
walmart and picked up three cases of beer given聽聽

had gotten so drunk with ethan the weekend prior聽聽

and needed a break realized midway through聽
the party that her period had started聽聽

she was in desperate need of tampons聽
and couldn't find any in the house聽聽

she called two cab companies neither of which聽
picked up after expressing her dilemma to ethan聽聽

he volunteered to drive her to a gas station less聽
than a mile away from the house he took another聽聽

shot before leaving and because he had just聽
met some of the people at the party of that day聽聽

he didn't want to leave them in the house聽
alone so he told everyone to come with him聽聽

as ethan and his friends were piling into the car聽
another group of people were on their way to being聽聽

brought together in order to help someone having聽
car troubles the boyle's family was enjoying聽聽

dinner at home and had just sat down to watch the聽
movie together shelby their 21 year old daughter聽聽

was home from nursing school and spending聽
the evening with her parents eric and holly聽聽

down the street evan jennings was celebrating his聽
high school graduation with family and friends聽聽

when the party was winding down evan's father聽
youth pastor brian jennings loaded his truck up聽聽

with tables and chairs that he'd borrowed from the聽
church for the party brian along with his godson聽聽

help 24 year old brianna mitchell whose mercury聽
mountaineer spun out while driving home from work聽聽

crashing in front of the boyle's home eric holly聽
and shelby heard the accident outside their home聽聽

and went outside to assist brianna used聽
shelby's cell phones to call her mom for help聽聽

and shelby and holly waited with her in front聽
of her vehicle eric meanwhile picked up the聽聽

family's mailbox that had been knocked over by聽
the mountaineer and carried it up to the garage

brian jennings was also driving down the road聽
where the group had gathered he wanted to help he聽聽

pulled over and told the two boys riding with him聽

as pastor jennings holly shelby and brianna聽
were waiting on the side of the road聽聽

ethan pulled his dad's f350 out of his聽
driveway almost instantly after starting聽聽

the car ethan was driving recklessly he gunned聽
the engine drove on the wrong side of the road聽聽

and was speeding at 70 miles per hour his聽
friend star testified that she yelled at him聽聽

that he needed to get over ethan's driving set聽
off a horrific chain reaction of cars colliding聽聽

when he swerved back over ethan went off road聽
hitting briana's mountaineer along with the four聽聽

people standing in front of the car ethan's truck聽
then hit jennings vehicle knocking across the road聽聽

into oncoming traffic the truck then flipped over聽
and struck a tree the scene was absolute chaos

eric boyles who was still in the garage reported聽
that he heard an explosion so loud that it shook聽聽

his house walking back outside he was horrified聽
by what he saw there were car parts and bodies聽聽

and debris everywhere it reminded him more of聽
a plane crash than a car accident by the time聽聽

eric found both holly and shelby they were dead聽
brianna talking on the phone with her mom was聽聽

also killed on impact as for pastor jennings his聽
best friend who had just left the graduation party聽聽

drove past a wreck he could see chairs聽
laying in the road and knew that it was brian聽聽

he jumped out of his car and found his friend聽
lying in a ditch brian's wife also drove past聽聽

the scene and saw her husband as he was receiving聽
cpr she knew that whatever happened wasn't good

the teens riding with ethan all survived the聽
accident one passenger sergio molina suffered聽聽

a severe brain injury he's completely paralyzed聽
being unable to move or speak and can only聽聽

communicate with his family through blinking ethan聽
on the other hand walked away from the accident聽聽

bloody but in one piece the bystanders who聽
found him reported that when he came to he聽聽

said hey man i'm ethan i can get you out of all聽
of this he clearly didn't know what happened聽聽

he also refused medical attention claiming that he聽
couldn't afford an ambulance three hours following聽聽

the incident ethan had a blood alcohol level of聽
.24 that's three times the legal limit in texas

ethan was charged with four counts of intoxication聽
manslaughter and two counts of intoxication聽聽

assault he pled guilty and in december 2013聽
his sentence hearing began the psychologist聽聽

the defense brought on to analyze ethan spent聽
over 50 hours with him he concluded that ethan聽聽
[820]
was suffering from affluenza given his wealthy聽
upbringing and the lack of consequences from his聽聽
[826]
actions the psychologist recommended that ethan聽
be separated from his parents and that their poor聽聽
[831]
parenting was a major cause of the accident the聽
affluenza defense albeit flimsy was successful聽聽
[838]
and the judge sent even to only 10 years probation聽
as well as to spend time in a rehab facility
[846]
in 2015 two years after his sentencing ethan聽
violated the terms of his probation he had missed聽聽
[852]
a check-in with his probation officer and had been聽
seen playing beer pong at a party with friends聽聽
[858]
a warrant was issued for his arrest in another聽
attempt to evade the law ethan and his mother聽聽
[864]
tanya fled to mexico they were caught two聽
weeks later and returned to texas for trial聽聽

ethan finally received some jail聽
time for the probation violation聽聽
[874]
he was sentenced to 180 days for each of the聽
four people who died as a result of the accident聽聽

he was released from prison in april 2018聽
and will be eligible for parole in 2024

mitchell brian jennings and holly and shelby聽聽

boyles have all settled their civil suits聽
against the couch family and their family聽聽

settled a suit on his behalf this case was聽聽

divided on the fairness of ethan's punishment聽聽

parents had been unable to afford the聽聽

defense attorneys that he had would he have聽
gotten a tap on the wrist for a crime that聽聽
