let's talk about charge offs and how聽 to get those removed from your credit聽聽
[14]
hi folks welcome back to my channel it's me聽 jazzy mac and i appreciate all of you that聽聽
[19]
have liked and subscribed to my channel i love it聽 when you guys comment because it really does help聽聽
[25]
the channel to grow and it helps the algorithm to聽 pick up this channel and show it to more people聽聽
[30]
so thank you so much for all of your support聽 now today we're going to talk about charge offs聽聽
[37]
as you guys know i have a video that talks about聽 collections and how to get those collections聽聽
[43]
removed and of course i've always got supplemental聽 materials available for you guys i have templates聽聽
[50]
down below for anybody that just kind of聽 wants that extra guidance in how to write聽聽
[56]
those letters that help you to get items removed聽 from your credit so that's going to be in the聽聽
[61]
description box but let's talk about charge offs聽 now there seems to be a bunch of confusion about聽聽
[68]
what charge offs are so generally a charge off is聽 going to usually be a credit card account that um聽聽
[78]
you missed payments on the account got closed聽 and the creditor which would be you know amex聽聽
[86]
it'd be mastercard whoever you had the credit card聽 with that creditor decided that they're not going聽聽
[92]
to get their money from you so they've written聽 it off they've written it off as just a loss聽聽
[97]
so now it's a charge off and that's pretty much聽 that's the only difference between a charge off聽聽
[103]
in a collection the charge off it's been written聽 off like kind of like from a texas point of view聽聽
[109]
or from a business point of view but a collection聽 is something that has been turned over to a聽聽
[114]
collection agency in hopes that the money is going聽 to be recovered so with a charge off it definitely聽聽
[122]
holds the same amount of weight as a collection it聽 it is just as derogatory and um it is it has that聽聽
[132]
negative impact on it um and it's the same you聽 know sort of thing that you want to get removed as聽聽
[140]
soon as possible so if you have a charge off you聽 can definitely think of it as a collection that聽聽
[146]
has been written off by the company does that mean聽 that you don't technically still owe the money聽聽
[152]
your state laws are going to vary on that and how聽 that's treated but in general for a charge off聽聽
[158]
to be removed you either would have to wait the聽 seven years for it to be removed from the first聽聽
[164]
day of delinquency or you can take the quicker聽 route which is my route the dispute method with聽聽
[169]
my templates or you can just watch my other videos聽 on collections and how to get a collection removed聽聽
[176]
but i want to just walk you through the process so聽 if you see a charge off on your credit what you're聽聽
[183]
pretty much going to do is simply look at um first聽 look at the date that it was first reported now聽聽
[190]
obviously if it's been longer than seven years you聽 need to get it deleted and that's that's simple聽聽
[197]
um and we already know that but if it hasn't聽 been more than seven years you can definitely聽聽
[202]
chart you can definitely challenge it and ask for聽 full validation of that account and the person聽聽
[209]
that you would want to get the full validation聽 from is going to be the credit bureaus now just to聽聽
[215]
recap the credit bureaus do not share information聽 so if you have a charge off that is being reported聽聽
[223]
on three different credit reports then you have to聽 send three different letters to the credit bureaus聽聽
[231]
so i want to make sure that we're clear聽 on that if it's a charge off you're not聽聽
[235]
writing a letter to the creditors that is not how聽 it works because they no longer have the account聽聽
[241]
they have sent it over to someone else and聽 so you want to make sure that the person that聽聽
[247]
you dispute with is a person that works at the聽 credit reporting agencies which is going to be聽聽
[252]
experian equifax and transunion so in your letter聽 you're going to write the account information聽聽
[260]
which is going to be the account uh name in聽 addition to the date that it was first reported聽聽
[268]
you can also include the amount and you're聽 going to simply write in your letter that聽聽
[274]
you want to get full validation of this聽 account including the originally signed聽聽
[282]
contracts with your signature and you want to聽 specify that um and you want to also tell them聽聽
[289]
that if they cannot verify the account that聽 they must remove the account according to聽聽
[296]
the fcra laws so we've talked about fcra laws聽 we've talked about the fdcpa laws we've talked聽聽
[303]
about uh what to do if those laws are violated so聽 i want to make sure that you always include a line聽聽
[312]
in your letters about the fcra laws when you're聽 disputing with the credit bureaus um because it's聽聽
[318]
just reminding them that you know you're right聽 right so once you get that information in your聽聽
[324]
letter um the next thing you want to do when聽 you're mailing those letters please don't use like聽聽
[330]
the mail that you know that costs like 50 cents聽 that's going to get lost in the mail and then it's聽聽
[336]
going to be a wasted trip to the post office what聽 you want to do is make sure that you are using聽聽
[343]
signature delivery confirmation yeah it might cost聽 an extra 10 bucks or so but ten bucks is nothing聽聽
[353]
compared to getting something the cost of聽 getting something removed from your credit聽聽
[358]
or the cost of not removing it ten dollars is so聽 worth it so you never want to just send a letter聽聽
[365]
without having that delivery signature聽 confirmation on it because it's going to聽聽
[370]
also be proof that you started a dispute聽 so whenever you send off that information聽聽
[378]
once they receive it at the credit bureaus they聽 will send you a little card or a little slip in聽聽
[385]
the mail you'll get that back in the mail that聽 shows who signed for it so you always want to聽聽
[390]
make a copy of that just in case um they don't聽 you know correctly you know investigate it or聽聽
[397]
do a proper dispute or if it's beyond that 30-day聽 window that they have to investigate it or dispute聽聽
[404]
it you want to have that as evidence in case you聽 need to send a follow-up letter or if you need to聽聽
[412]
file a complaint with the cfpb and so i have a聽 credit roadmap that kind of guides you through聽聽
[419]
what to do if an item comes back verified um and聽 how important it is to carefully utilize the cfpb聽聽
[429]
as we know the cfpb stands for the聽 consumer finance protection bureau聽聽
[433]
and they are like your big brother they are a聽 consumer protection agency that um regularly聽聽
[441]
monitors and investigates not only the credit聽 reporting bureaus but also the collection agencies聽聽
[448]
and other financial institutions anybody that聽 deals with money um they are kind of like the聽聽
[454]
overseer that makes sure that consumers are not聽 being taken advantage of so that's why it's so聽聽
[460]
important to to know what the cfpb is and聽 to know um how to file a complaint and um聽聽
[469]
what i like what i did in my credit templates um聽 in the package is not only did i put the templates聽聽
[476]
in there but i created pretty much a road map聽 for where to start because you're going to get聽聽
[482]
there aren't going to be many different responses聽 that you'll get from the credit bureaus after the聽聽
[488]
investigation is complete you're either going聽 to get a letter that says it's been verified聽聽
[492]
you get a letter that requests additional聽 information or requests you to uh like verify聽聽
[498]
your identity or you're going to get um there's聽 a verification letter saying that it's verified聽聽
[505]
there's the id letter or there's the letter聽 that says it's been deleted so it's going to聽聽
[509]
be one of three options but based on the feedback聽 that they give you i did map out what you can do聽聽
[515]
and how you can respond and how you can use the聽 cfpb as your point of escalation because sometimes聽聽
[523]
credit bureaus are stubborn and they don't聽 actually do what they're supposed to do to verify聽聽
[529]
an account so that's why we have to escalate聽 that to the cfpb and we have to you know we have聽聽
[538]
to be assertive in our consumer rights so just聽 remember that if you're going to have a charge off聽聽
[544]
um and you're going to challenge it that you聽 need to challenge it with the bureaus if that聽聽
[549]
does not work after multiple attempts and they're聽 not properly investigating it and that's when you聽聽
[556]
want to escalate it to the cfpb so i hope that聽 makes sense um anything that you don't understand聽聽
[564]
about that process let me know in the comments聽 below i'm always happy to answer any questions聽聽
[568]
that you guys have um and until then happy聽 credit building see you in the next video bye
