[11]
I'm Marc Whitehead, a board certified disability聽 attorney and author of the disability help books,聽聽

[29]
everyone with depression qualifies for disability聽 benefits. Yet, severe depression can significantly聽聽
[35]
interfere with the person's daily activities聽 and the ability to work. In fact, depression is聽聽
[40]
among the leading causes of disability worldwide.聽 Disability claims based on depression or bipolar聽聽
[45]
disorder are routinely challenged by insurance聽 companies, the Social Security Administration,聽聽
[50]
and the Department of Veterans Affairs. If聽 this has been your experience it may be time聽聽
[56]
to seek legal help in order to prove you're聽 indeed disabled. Depression is not a sign of聽聽
[61]
personal weakness, it's a real mental illness with聽 real causes The cause may be due to chemistry,聽聽
[68]
biology, or life experiences, disorders of the聽 brain caused by chemical imbalance, genetics,聽聽
[73]
or emotional or physical trauma, it can also聽 be caused by hormone imbalance. Depression聽聽
[79]
can also coexist with a serious or painful聽 medical condition or as a reaction to the聽聽
[83]
condition. In fact, depression is one of the聽 most common secondary conditions associated聽聽
[88]
with severe injury or illness. There are聽 different forms of depressive disorders,聽聽
[93]
including; major depression, die semuc disorder,聽 minor depression, and bipolar disorder. The聽聽
[100]
symptoms of depression and severity of these聽 symptoms will also vary among individuals.聽聽
[104]
Depression is an illness that affects the whole聽 person, leading to feelings of hopelessness聽聽
[109]
and despair. People who suffer from depression聽 have trouble concentrating, sleeping or eating,聽聽
[114]
and have lost interest in taking care of their聽 daily activities. They may exhibit avoidance of聽聽
[120]
people, profound grief, and a lack of energy.聽 Depression carries a high risk of suicide.
[130]
To win Social Security disability for depression聽 you need to prove one thing, that your depression聽聽
[135]
is severe enough to stop you from working. To聽 determine a person's eligibility for benefits, the聽聽
[141]
Social Security Administration adheres to their聽 listing of impairments. The listing for depression聽聽
[146]
disability is found under mental disorders listing聽 12 .04, affective disorders. If your condition is聽聽
[152]
severe enough to satisfy these requirements聽 you'll be considered disabled by the Social聽聽
[156]
Security Administration. The SSA will need medical聽 evidence to support your exact limitations. This聽聽
[163]
means that they'll want to see medical records and聽 psychiatric records from doctors, psychiatrists聽聽
[168]
or psychologists, mental health clinics and聽 other facilities where you receive treatment.聽
[173]
Depressive disorders are often endured by veterans聽 who've lived through the emotional stress of war,聽聽
[181]
indeed following: the death or injury of聽 comrades, living through unbearable conditions,聽聽
[186]
are struggling with their own physical injuries聽 and disorders. Veterans disability benefits are聽聽
[191]
based on the establishment of a service-connected聽 impairment. A disability rating is assigned聽聽
[196]
based on the severity of the impairment or聽 combination of impairments. To arrive at聽聽
[201]
a rating the VA relies on the VA scheduled for聽 rating disabilities. Depression is listed under聽聽
[207]
mental disorders and further identified as a mood聽 disorder. VA disability payments are then awarded聽聽
[214]
based on this assessment combined with a veteran's聽 ability to work and earn a living. Depressive聽聽
[219]
disorders may begin because of experiences聽 or injuries the veteran had while in service.聽聽
[223]
Traumatic brain injury is frequently responsible聽 for the onset of depression. Depressive illness聽聽
[229]
may be closely related to other service-connected聽 disorders, such as post-traumatic stress disorder.
[236]
You may also be able to claim disability benefits聽 on your long term disability insurance policy for聽聽
[243]
your oppression. Whether you have long term聽 disability insurance privately or through聽聽
[247]
your employer it's the insurance carrier who聽 will process your claim. It's become routine聽聽
[253]
practice for many insurance companies to聽 deny legitimate claims for depression,聽聽
[257]
or to devalue these claims. Insurance claims聽 for depression disability present their own聽聽
[262]
unique set of challenges. One such talents聽 from insurers regarding depression disorders聽聽
[267]
is that the condition is not severe enough to聽 qualify for disability. Symptoms of depression聽聽
[272]
are emotional and abstract and sometimes with聽 highs and lows and difficult to measure. This聽聽
[278]
opens the door for insurers to claim that you聽 do not meet their definition of disability. You聽聽
[282]
may also suffer from depression as you endure聽 another serious illness or painful condition.聽聽
[288]
Most insurance companies have a clause that聽 lists mental disorders as mental nervous聽聽
[293]
conditions for which the benefit pay period is聽 limited to only two years. In their attempt to聽聽
[299]
reduce payment terms your insurer may try to聽 award benefits only for depression under the聽聽
[303]
mental nervous condition clause with no separate聽 recognition of the physical disability. For more聽聽
