issue that's been

flown a bit under the radar according to
[23]
data obtained by searchlight new mexico
[26]
the state mistakenly paid out 106
[28]
million dollars in pandemic unemployment
[31]
aid or pua as it's known and now it's
[34]
demanding that money back from the
[36]
citizens who unknowingly received it now
[38]
is that fair and how could such a major
[41]
error happen let me throw that first
[43]
dude dee dee feldman senator feldman how
[45]
could it happen and why are we asking
[46]
for money back here
[48]
you know it it's it's uh
[50]
it's obvious that the department of
[52]
workforce solutions has been overwhelmed
[55]
uh by uh claims during the
[59]
pandemic and also
[61]
new funds coming to the state through
[64]
the various federal
[66]
through the cares act for example
[68]
and other and other funds uh but they're
[71]
really
[73]
this seems quite incompetent uh in my
[76]
view and really a terrible injustice
[80]
uh that they are now asking people to
[82]
pay back
[83]
uh money that was sent to them by
[86]
their own error
[88]
i mean it is the department of workforce
[90]
solution that calculates how much people
[93]
are due
[94]
in unemployment uh individuals don't
[98]
calculate that themselves
[100]
and figure out whether they're being
[102]
overpaid or underpaid and then to be
[106]
suddenly
[108]
suddenly

faced with a 13 000
[112]
bill i mean it is
[114]
an outrage uh for the uh department of
[118]
workforce solutions i think
[120]
and uh people i think are justifiably uh
[124]
uh mad about been having this money that
[128]
they supposedly owe
[130]
deducted from future checks
[133]
that they are due
[134]
um

so uh you know it's just another one of
[138]
those things that's going to make people
[140]
hate government even though
[142]
uh they're they're
[144]
they're the recipient of funds from the
[146]
government they they are
[148]
now going to be left with a very sour
[150]
taste in their mouths

you know this i'm not news to you but

you know department of workforce

solutions their own numbers show 17

136 people that's nearly 20 percent
[164]
of pua payment recipients have filed
[167]
waivers
[168]
asking to be excused from paying back
[170]
the money
[171]
over 17 000 people
[174]
so let me just say when i first read
[177]
this searchlight piece
[178]
just blew my mind and i will say this
[180]
about that particular piece of reporting
[182]
the original number for overpayment was
[185]
somewhere close to 240 million not the
[188]
106 that they just recently corrected it
[190]
too so even then it seemed really
[192]
extreme and now even with 106 million
[194]
it's just it's a crazy number but you're
[197]
right um you know we're talking about
[199]
real people here we're talking about um
[201]
real people with families and this is
[203]
going to affect them greatly um
[205]
uh the last report i read said something
[207]
like 14 000 people are still waiting for
[210]
waivers to be exempted from repaying
[212]
this and it's just dragging on it's just
[215]
dragging on
[216]
that's wild hey merit the same issue as
[218]
you know is playing out in arizona
[219]
michigan new jersey connecticut lots of
[221]
other states
[222]
should you know should some of the flame
[224]
blame fall in the federal government for
[226]
failing to be specific enough with the
[227]
criteria for pua money
[230]
well
[231]
absolutely and i i think the
[234]
the root cause of this
[235]
there is just so much money out there
[238]
yeah it's a ridiculous amount of money
[241]
out there that went to states flooding
[243]
aid started with the last administration
[245]
continued with this administration new
[247]
mexico was actually one of the slowest
[249]
states we couldn't even figure out how
[251]
to spend all this money right
[253]
that should tell you something the
[254]
situation is almost ludicrous we're
[257]
printing money
[259]
um or just manufacturing it
[261]
electronically i guess uh you could
[263]
almost say um so the notion of going
[266]
down to the lowest level the households
[269]
where it matters where this is keeping
[270]
people um out of poverty and feeding
[272]
their family to claw back from them when
[275]
we're a state who couldn't even figure
[277]
out who was going to spend the money
[279]
whether it's going to be the governor or
[280]
the legislature and that whole fight and
[283]
paying lawyers to work that out in front
[285]
of the supreme court to clap back from
[288]
the individual household to me um that's
[290]
just it's just me right just me no i
[293]
don't think i don't think it's just you
[295]
senator interesting rhode island as you
[296]
probably know is waving all over
[299]
payments
[300]
saying the money is quote long gone
[302]
you know in our state right now more
[304]
than two thousand waiver requests have
[306]
been denied
[308]
i just i don't where are we headed on
[310]
this how did that happen right how did
[312]
that happen well you know i think that
[314]
clearly uh new mexico ought to just give
[317]
a blanket waiver
[319]
uh as a result of these overpayments
[321]
particularly since we are if not the
[325]
poorest state or the uh the lowest
[328]
income state at least in the top three
[331]
of the lowest income states and yes
[333]
there is a lot of money but yes there's
[335]
a lot of unemployment and there's a lot
[338]
of need in new mexico as well
[341]
so all the more reason for
[344]
the department of workforce solutions to
[347]
um
[348]
to
[350]
enact a blanket waiver and then enact
[353]
for the public an accounting of where
[356]
this money
[357]
uh went to
[358]
um and what they're doing with it
[361]
merit i just i
[363]
oh i'm so frustrated with this topic
[365]
because why aren't we as dede says we
[367]
are flush right now
[370]
who are these people inside workforce
[372]
solutions turning down these
[374]
waiver requests that's what i want to
[376]
know right off the top what is the
[378]
criteria how do they decide who gets one
[381]
who decides who doesn't get one we don't
[383]
know any of that at this point right
[386]
that's true there's very little
[387]
transparency on this and then my
[389]
question is what is the state going to
[390]
do with the money
[392]
again we have not been able to figure
[393]
out how to spend the
[395]
uh deluge of federal funds we've gotten
[398]
what are we actually what
[400]
substantive purpose are we going to put
[402]
this these funds to right um
[405]
again i i think a blanket waiver the
[407]
funds are gone
[410]
um and we saw this um in congress with a
[413]
paycheck protect protection program you
[416]
know two serial box tops and a and um uh
[420]
an application put out in crayon and
[422]
your paycheck protection program waiver
[424]
got approved i think new mexico could
[426]
easily do that here
[428]
i i gotta say you know in a poor state
[430]
where money is just a very tricky thing
[432]
if workforce solutions want to take it
[434]
to its natural extent
[436]
and start issuing warrants and bringing
[438]
people to court to get this money back i
[440]
say good luck to them
[441]
you know this this ought to be a very
[443]
interesting deal go ahead senator look
[445]
at a thought there but they don't have
[446]
to they don't have to do that all they
[448]
do is deduct it from their from future
[450]
unemployment checks
[452]
so they still have the upper hand and uh
[455]
they don't have to take affirmative
[457]
action all they have to do is just
[459]
withhold the money now the department of
[462]
workforce solutions i think bears some
[464]
checking um they are they have an acting
[468]
secretary and have had an acting
[470]
secretary since their previous secretary
[473]
bill mccandly left the left the state
[476]
not just left the job but left the state
[479]
very prematurely so um
[482]
i think i think this bears some some
[484]
invent further investigation and i
[487]
really applaud searchlight new mexico
