insurance for the driver who hit you is

going to pay for your medical bills as

you get your medical treatment it
[58]
doesn't work that way in most states
[61]
again most states your medical bills
[64]
will not be paid by the insurance
[65]
company until your case is resolved

whether by verdict or through settlement
[70]
now again this doesn't apply in all
[72]
states specifically it doesn't apply to
[75]
states that follow no-fault laws I put a

states that do follow no-fault laws and

in those states your medical bills

generally speaking are going to be paid
[87]
regardless of fault but no-fault states
[90]
aside after an accident there's really
[94]
no point in telling the emergency room
[96]
or your doctor or your chiropractor to
[99]
build the insurance for the guy who hit
[101]
you the only thing that's gonna happen
[103]
in that case is that your medical bills
[105]
are just gonna sit there and ultimately
[108]
they're going to go to collections which
[110]
theoretically could affect your credit
[112]
it's really unfair isn't it I mean you
[114]
were involved in an accident that was
[116]
not your fault yet you're still the one
[119]
who is responsible for making sure that
[121]
your medical bills get paid so here are
[124]
a few of the different ways that you can
[125]
make sure your medical bills get paid
[127]
first I already mentioned there's no
[130]
fault insurance several states follow
[132]
no-fault
[133]
pterence laws and the reason being is
[136]
that it makes sure that your bills get
[137]
paid after an accident regardless of
[139]
who's at fault so there is some benefit
[142]
to no-fault laws there are some
[144]
detractions as well but we're not going
[145]
to get into those in this video the
[147]
second way to pay your medical bills is
[150]
by using what's called med pay or
[152]
medical payments coverage it's just a
[155]
small part of your auto insurance policy
[158]
in some states it might be called PIP
[160]
coverage or personal injury protection
[162]
the way it works is that prior to
[165]
getting in an accident you will have
[167]
contracted with your insurance company
[168]
to provide you twenty five hundred
[170]
dollars or five thousand or even ten
[173]
thousand dollars in medical payments
[175]
coverage now the thing about it is I've
[177]
heard a lot of people on YouTube say
[180]
that med pay isn't worth it well if you
[183]
don't have health insurance it's worth
[184]
it because otherwise your medical bills
[186]
are not going to get paid also it's
[188]
great for paying for deductibles and
[191]
your co-pays in addition you can use
[194]
your med pay regardless of fault so if
[197]
you caused an accident
[198]
you can still use it and lastly the nice
[201]
thing about med pay is it's not 80/20
[204]
you don't have to pay a portion of your
[206]
medical bill your med pay will cover it
[208]
all the third way to pay your medical
[211]
bills is something that I always advise
[214]
my clients to do and that is to use your
[217]
health insurance sometimes medical
[220]
providers don't want to take your health
[221]
insurance after an accident why is that
[225]
because your health insurance provider
[227]
like Aetna or Cigna or Blue Cross Blue
[230]
Shield has a contract with the medical
[232]
provider so if you have a ten thousand
[235]
dollar medical bill it's likely that
[237]
Aetna has already negotiated they will
[239]
only pay three thousand dollars of that
[241]
bill now if instead
[244]
Edna comes after you for the bill they
[246]
will likely recover more that's why I
[249]
always recommend using your insurance
[251]
because it'll cost you a lot less in the
[253]
end a couple of significant points to
[256]
remember when using your health
[257]
insurance to pay your medical bills
[259]
after an auto accident
[260]
first your health insurance company is
[264]
probably going to want to be reimbursed
[265]
for the money they
[267]
to your medical providers on your behalf
[269]
second even if you use your health
[271]
insurance you're not totally off the
[273]
hook because you're still gonna have to
[275]
pay your co-pays or your coinsurance or
[279]
meet your deductible before your health
[281]
insurance kicks in and many of us these
[284]
days have large deductibles and as such
[286]
have to put out a lot of money before
[288]
our insurance will pay for our bills
[290]
another way to pay for your bills is by
[293]
using a lien Li en and by lien I mean
[298]
when you go to an emergency room for
[300]
example shortly after you receive your
[303]
treatment you'll receive a letter in the
[304]
mail saying that the hospital has filed
[306]
a lien with the county and a lien means
[309]
that they have a claim to your recovery
[312]
meaning that when you do settle your
[315]
case you are obligated by law to pay
[317]
your medical provider back now some
[320]
folks do it immediately like a hospital
[322]
other doctors oftentimes chiropractors
[325]
will enter into a lien agreement with
[327]
you meaning they will provide you the
[329]
medical service you need and in exchange
[332]
for your agreement to pay them they will
[334]
hold off collecting until you resolve
[336]
your case another option for paying your
[339]
bills is to pay an upfront to pay with
[341]
cash now obviously this isn't the most
[344]
frequently used option and most of us
[346]
can't afford to pay for our medical
[348]
bills much of which is very expensive
[350]
but it is an option the thing to
[353]
remember here is since you don't have a
[354]
contract with your medical provider
[355]
they're gonna charge you the full amount
[357]
of your medical bills so if you can try
[359]
to negotiate the amount of your medical
[361]
bills with your provider before your
[363]
treatment occurs and the last way to pay
[366]
for your medical bills is to use the
[368]
auto insurance but as I already told you
[371]
the defendants auto insurance company is
[373]
not going to pay for your medical bills
[375]
and your case is resolved and the same
[377]
thing goes for your uninsured motorist
[379]
or underinsured motorist coverage your
[382]
insurance company aside from med pay is
[385]
not going to pay for your medical bills
[386]
until the case resolves as well so it's
[389]
critical to stay on top of your medical
[391]
bills as you start to receive them if
[393]
you have an attorney get your attorney
[395]
involved to call these medical providers
[397]
to make sure they hold off billing and
[399]
don't send the bills to
[400]
collections one last point I want to
[403]
leave you with there's another
[405]
misperception that people have that when
[408]
you settle your case your settlement is
[411]
separate and different from your medical
[413]
bills that's not the case let me give an
[416]
example if you settle your case for
[419]
$10,000 let's say you had a back sprain
[421]
and that's what your case is worth if
[423]
you have three thousand dollars in
[425]
medical bills they're not sitting on top
[428]
of the ten thousand dollars the three
[430]
thousand dollars in medical bills is
[432]
included in the ten thousand dollar
[433]
settlement offer the insurance company
[435]
made to you in addition if you have an
[438]
attorney you have to pay your attorney
[440]
out of that ten thousand dollars as well
[442]
so that's something to keep in mind when
[444]
you're deciding on whether to accept an
[446]
insurance company's settlement offer or
[448]
not okay it's time for your take on the
