and if you've already made payments on

your medical collections i'm gonna tell

you a way that you might actually be

entitled to a refund for those payments

I have some pretty heavy stuff i'm going

to talk about as far as your medical
[62]
collections those icky icky collections
[65]
that seem to haunt all of us
[68]
i'm going to break it down into two
[70]
scenarios basically
[73]
um for if you have a medical collection
[76]
that you just got that's not on your
[78]
credit versus a medical collection that
[81]
is on your credit and we're going to
[82]
talk about the differences in how to
[84]
treat those collections and how to make
[86]
them go away so before we get into it
[89]
guys i want you to
[91]
basically do something for me so i can
[93]
gauge
[94]
what type of content i need to put out
[96]
as a follow-up to this go ahead and type

if you've actually paid off a collection

for medical debt so a number one if you

currently have medical collections a

number two if you've paid off a medical

collection within the last few years

because i'm telling you
[124]
the ones for those of you that have paid
[126]
off um a collection you might be
[130]
entitled to a refund that's why i'm
[132]
trying to get you guys to understand
[134]
like
[135]
this is serious business you don't have
[138]
to just buckle down and pay stuff
[140]
because sometimes they're not entitled
[142]
to that payment so let's hop right in
[145]
and let's talk about some things so
[147]
let's just get into the first scenario
[149]
where
[150]
um if you have a medical collection that
[153]
let's say you just got it in the mail
[155]
today
[156]
what you would need to do to handle that
[158]
um and to possibly make it go away so
[162]
let's say you got a procedure
[164]
and that procedure cost two thousand
[166]
dollars but you've received a collection
[169]
in the mail for that same medical
[171]
procedure that states that you owe
[174]
three thousand dollars and there is a
[176]
breakdown that shows that you owe two
[179]
thousand for the procedure you owe
[182]
500 for the collection fee and then
[185]
they're charging you 500 in interest
[187]
let's just assume that's how they came
[189]
to the 3 000 number do you pay it
[192]
absolutely not you know why because
[194]
jazzy mac told you not to
[197]
and because jazzy mac is going to tell
[198]
you what your consumer rights are as
[200]
well so let's look at your rights the
[203]
first thing that you want to do anytime
[205]
you get a medical collection um notice
[208]
in the mail whether you think it's right
[210]
or not you always want to ask for
[213]
validation when we ask for validation we
[216]
are challenging the collection agency
[219]
to provide proof that the account indeed
[223]
belongs to us number one and that those
[226]
charges that they're stating are ours
[228]
um we want them to be able to back up
[231]
what they're saying and to prove it and
[233]
not just say oh here's a balance but you
[235]
prove it by providing the original
[237]
contracts with our wet signature
[241]
that shows that we agree to those terms
[244]
and agreements so that's the first thing
[247]
you want to do now you don't necessarily
[249]
want to do this over the phone
[251]
um you know because it's you know it's
[255]
it's
[255]
not a paper trail and anytime that you
[258]
communicate with a collection agency you
[261]
always want to have a paper trail in
[263]
case you have to escalate it at a later
[266]
time and i'll tell i'll talk about who
[269]
you can escalate to
[271]
um in these situations so the first
[273]
thing you're going to do is create um
[275]
write out your validation letter
[278]
to
[279]
the collection agency asking for the
[281]
original contract but you're also going
[283]
to include the line for hipaa because
[287]
according to hipaa
[289]
your information cannot be shared um
[292]
with a third party without your prior
[295]
consent meaning that you would have had
[298]
to sign an agreement that says you give
[300]
authorization for the medical facility
[303]
to share that information with the third
[305]
party in this case being the collection
[307]
agency um and them reporting information
[311]
about you as far as sending you a notice
[314]
saying that you owe something that's
[316]
sharing your information so we're gonna
[319]
we want to challenge that because one
[320]
it's not legal for them to do that if
[322]
you didn't give prior consent and then
[324]
two
[325]
um it's also a way for you to just make
[329]
sure that you're keeping people honest
[331]
and you're not letting people take
[332]
advantage of you so if you ask for the
[335]
validation letter and they're not able
[338]
to provide you
[340]
with validation within 30 days then
[343]
legally they're not able to collect it
[346]
and they should either refer the account
[349]
back to the facility or they should
[351]
forgive the debt altogether if they have
[354]
indeed purchased that debt from the
[357]
facility so again if it's not valid
[360]
meaning they can't provide you the
[362]
original contracts um they cannot
[365]
continue to pursue that from you because
[367]
you number one don't have an agreement
[369]
with them um in addition where you trip
[372]
them up at is if they do provide a
[374]
contract to you and that contract does
[376]
not explicitly state that you give
[378]
authorization to a third party to access
[380]
your records that is a hipaa violation
[383]
when we talk about hipaa violations now
[385]
we're getting into
[386]
where they can be severely fined
[390]
by the cfpb which is the consumer
[392]
finance protection bureau in fact there
[395]
was just a case where um
[398]
there was a collection agency
[400]
that actually violated uh one of the
[403]
hipaa laws
[404]
and they were required to pay consumers
[407]
back and not only the money that the
[409]
consumer had spent paying off the debt
[411]
but they had to give them an extra
[413]
thousand dollars for damages and as a
[416]
violation fee and they also had to pay
[418]
250 000
[420]
i believe in restitution
[422]
so trust me
[424]
um you have rights and you need to
[427]
exercise those rights and so if um the
[430]
collection efforts were to continue
[434]
um after they have failed to provide
[436]
validation that's when you want to do
[438]
your cfpb complaint um and you want to
[441]
file that complaint against the
[442]
collection agency uh for illegally
[446]
pursuing a debt um and also for
[449]
violating your hipaa violating the hipaa
[451]
privacy laws and trust me the cfpb does
[454]
not take that type of stuff uh lightly
[456]
they take it very seriously so usually
[459]
that will result in if it's a hipaa
[462]
violation usually the debt will either
[464]
be forgiven or you'll be
[466]
not required to pay the debt um you know
[469]
there's going to be some sort of you
[470]
know outcome if if the hipaa
[474]
um was violated so that's if you don't
[478]
get validation and it you know
[481]
is a violation
[483]
however on the flip side
[485]
as far as medical debt being reported on
[488]
your credit
[489]
uh when it's past that initial 30-day
[491]
mark
[492]
when you first get it in the mail if
[494]
it's on your credit there's a couple of
[496]
different things you want to do
[498]
to again challenge it so as far as
[501]
asking for validation with
[504]
in this case if it's on your credit i
[507]
would personally
[508]
do the dispute process with the credit
[510]
bureau
[511]
and the first scenario we did with the
[513]
collection agency in this scenario we do
[515]
it with the credit bureau because
[516]
they're the ones that are listing it out
[519]
so you want to just write your dispute
[521]
letters ask for validation and also
[525]
mention hipaa and again i have the
[526]
templates below if you don't feel
[528]
comfortable just drafting a letter from
[530]
scratch i have templates below for how
[533]
you ask for medical
[535]
debt validation
[536]
and how you need to insert that hipaa
[539]
wording so that your case is treated in
[542]
a different way than how they would
[544]
treat general
[545]
disputes so i have that below but again
[548]
you want to make sure that in the case
[550]
of it being on your credit report you go
[552]
and dispute it directly with the three
[554]
bureaus if that's where they're
[556]
appearing um if you don't hear back in
[558]
30 days if they can't validate it in 30
[560]
days then by law they are supposed to
[564]
remove that account completely
[567]
from your credit uh report altogether
[570]
okay so if they do not do that and they
[573]
do not provide validation they don't
[574]
provide you the original contracts and
[577]
they can't you know um show you like a
[580]
signature where you've signed off
[581]
acknowledging the debt within a contract
[584]
then that's when we also again want to
[586]
escalate to big brother who's big
[588]
brother the cfpb the cfpb um is where
[592]
you'll file the complaint against the
[594]
credit bureau and against the collection
[596]
agency on the same complaint i also have
[599]
that mapped out in my credit roadmap
[602]
i've tried to make it super super easy
[604]
for you guys to follow these steps
[606]
because they really are simple steps to
[608]
get that debt like completely removed so
[612]
that's um
[614]
just pretty much you know the rundown
[617]
for if these debts can't be validated
[619]
now let's say
[620]
uh you have a collection that is
[622]
completely valid you've read through the
[624]
contract you've acknowledged that you
[626]
know you actually did give a third party
[630]
um access to your information you signed
[632]
off on it let's say the debt is
[634]
completely valid
[635]
well
[636]
what you can do is you can offer to do a
[639]
debt settlement now if it's on your
[641]
credit report we're not doing anything
[643]
um without a written notice saying that
[646]
they will delete it from your credit
[647]
after payment that's known as a pay for
[649]
delete um but if it is not on your
[651]
credit yet then you can negotiate for a
[654]
much lower amount and the thing is
[657]
they purchase these debts for pennies on
[659]
a dollar they can buy a thousand dollar
[661]
debt for literally a hundred dollars so
[664]
if you owe
[666]
a collection of a thousand dollars but
[667]
you just say hey i only have 200 that's
[670]
it
[671]
take it or leave it
[672]
they're normally going to take it
[674]
especially if you use the b word what is
[677]
the b word the b word is bankruptcy if
[681]
you ever
[682]
mention like hey i just want to i just
[685]
want to clear this debt up i want to
[686]
settle it for less i only have 200 if
[688]
you don't accept it then i'm just going
[690]
to add it to my bankruptcy pal and you
[692]
guys won't get anything i mean they're
[694]
going to say oh wait wait no
[697]
we'll take it or hey could you do 40
[699]
instead or can you do 50 of the debt to
[703]
market as resolved and for us to take it
[705]
off your credit or stop pursuing you
[707]
whatever the case may be so you want to
[710]
exercise using the b word um if that
[713]
situation
[714]
applies to you um some of you may have
[716]
different strategies or tactics that you
[719]
may use um but for me it was using the b
[722]
word um because at one point i did
[724]
consider bankruptcy until i found out
[726]
that you know
[728]
student loans wouldn't go away with
[730]
bankruptcy um that was before i paid off
[732]
my student loans that was years ago but
[734]
the b word use it use it to your
[736]
advantage especially if you're going
[738]
through a financial hardship i'm not
[739]
telling you to file for bankruptcy but
[741]
i'm telling you to use it strategically
[744]
as a way to convince them to settle your
[747]
debt
[749]
and as i mentioned
[750]
if you've already paid some medical
[752]
collections
[754]
there may possibly be
[756]
a refund in your future
[759]
depending on who you paid
[762]
and i'll explain that so
[765]
that same i'm just going to look at my
[767]
notes here
[769]
that same story that i was telling you
[771]
about when cfpb took action against that
[774]
medical debt collector and um charged
[776]
him with that 500 000
[778]
penalty for violating hipaa laws so
[781]
basically when you get
[784]
any type of collection letter in the
[786]
mail
[787]
five days prior to you getting that
[788]
letter in the mail you're supposed to
[790]
have gotten a phone call
[792]
um just you know a verbal phone call
[794]
saying hey it's abc collection company
[797]
we're calling to collect a debt and
[799]
here's your debt amount
[801]
so after you get that call they're
[803]
supposed to send you a written notice
[805]
um of the debt
[807]
what happens many times is people go and
[811]
pull up their credit report and they
[812]
look and see that they've got a medical
[814]
collection on there and they never even
[816]
got anything in the mail no one ever
[818]
called them no one ever gave them the
[820]
opportunity to rectify it
[823]
it just popped up on their credit report
[826]
that is a direct violation of the
[828]
consumer finance protection bureau's
[831]
guidelines around a medical debt
[833]
collection you have to give the consumer
[836]
um a fair amount of time to rectify that
[839]
debt and to resolve it
[841]
but many companies are very cutthroat
[844]
they won't give you that opportunity to
[846]
resolve it and they'll immediately
[848]
report it to your credit
[850]
because now they just they're using that
[852]
as a scare tactic to get you to just pay
[854]
them
[855]
and you know again that is against the
[857]
law so if you are one of those people
[858]
that that's happened to you file your
[860]
complaint with the cfpb and depending on
[863]
the company that you're filing it
[864]
against you may be entitled to getting
[866]
not only a refund back for the medical
[869]
collection amount that you paid
[871]
and having it removed from your credit
[874]
but you also might be entitled to
[876]
getting um up to a thousand dollars in
[879]
damages and no that doesn't even require
[882]
you to go to court many times those are
[885]
things that are settled outside of court
[888]
and those are things that have already
[891]
amounts that have already been allocated
[893]
for consumers so you want to
[897]
make sure that you read up on that i'll
[898]
actually put that article i think i'll
[901]
um put it in the description box for you

guys to read because it's a very very
[907]
interesting piece
[908]
of knowledge to have as far as like i
[911]
never knew that you could get refunds
[913]
for medical collection debt until a few
[915]
years ago
[916]
when i disputed some things um and you
[919]
know
[920]
you can either dispute it you know
[922]
through the method i've discussed or
[925]
sometimes you can even dispute it
[926]
through the bank
[928]
um if you can prove that the cfpb has
[930]
stated that they illegally collected
[932]
those funds from you you can absolutely
[934]
dispute that with the bank and get your
[936]
money back as long as it's not passed
[938]
you know the bank's dispute uh window
[942]
so
[943]
again you know challenge every single
[946]
medical collection that you get it is
[948]
your consumer right
[951]
do not pay something blindly even if you
[954]
think you owe it challenge it because
[956]
chances are they tacked on some fees
[959]
that you didn't even pay attention to
[961]
and that's how they get rich so um
[964]
in the course of doing that never just
[966]
admit to owing a debt always say hey i
[969]
don't know if i owe that and what you
[971]
know you want to
[972]
like play dumb because if you admit to
[975]
owing it or if you acknowledge um the
[978]
debt then that resets the clock for the
[980]
statute of limitations for how long they
[982]
can collect or pursue the debt from you
[986]
so i hope all of that makes sense um you

i i just i hate that
[992]
this country is just just built on greed
[995]
from these corporations that take
[996]
advantage of consumers and so that's why
[999]
i try to put this information out there
