now let's talk about how to prepare

yourself financially

for a divorce if you are getting ready

to go through a divorce it's different
[63]
to prepare financially if you are the
[66]
what we
[66]
call the money spouse or the non-money
[70]
spouse the money spouse is usually the
[72]
one
[73]
who is making more money and very often
[76]
times the money spouse is the one who
[78]
has more control over the finances
[82]
sometimes it's not necessarily that way
[85]
sometimes you
[86]
see the person making the money and then
[88]
the other person who
[89]
hasn't been making as much is the one
[92]
who
[92]
has been paying the bills and in control
[95]
of the finances
[96]
but a lot of times what you see is you
[98]
see the money spouse
[100]
also usually has control over the actual
[104]
money
[104]
so if you are the non-money spouse or
[107]
the person who doesn't have control over
[109]
the finances it's really even more
[111]
important for
[111]
you to prepare yourself financially for
[115]
divorce
[116]
and if you are getting ready to divorce
[118]
a narcissist or anybody
[120]

if you are getting ready to divorce a

regardless of who you are whether you're

the money spouse or the non-money spouse

the very first thing you're going to
[143]
want to do is gather your financial
[146]
documents
[147]
so when you go to file for divorce and
[150]
once the divorce is filed regardless of
[152]
where you are
[154]
you will have to disclose information
[157]
about your finances
[158]
so generally that means a couple of
[162]
years of tax returns
[163]
several months of bank statements credit
[165]
card statements
[166]
you know savings accounts and checking
[169]
accounts for both personal
[170]
and business it also means credit card
[173]
statements for both personal and
[175]
business
[176]
and it usually um means any kind of
[179]
prenuptial agreements
[180]
deeds for real estate um
[184]
retirement account statements pay stubs
[189]
the way that you've been paid you know
[191]
whether it's uh
[192]
maybe it's a 1099 or maybe it's a
[195]
w-2 or maybe it's a k-1 but
[198]
you will need to be able to have access
[201]
to all of that information
[203]
or actually copies of all of that
[205]
information
[206]
your lawyer will need that and you know
[208]
for how long will you need it for
[210]
i mean at least several months worth of
[213]
financial
[215]
statements for banks and credit cards
[218]
probably at least a couple of years of
[221]
income
[221]
information for um your
[225]
tax returns and then at least a couple
[228]
of months of statements for
[230]
current pay pay stubs things of that
[233]
nature
[234]
so that's number one is gathering your
[236]
financial information
[238]
sometimes if you're the non-money spouse
[240]
it can be kind of hard to get
[242]
access to that don't beat yourself up
[244]
over it if you can't get access to it
[247]
then it will have to be disclosed anyway
[251]
once the case gets started but it's a
[253]
little bit easier for your lawyer
[255]
if you've already got that information
[258]
because
[259]
now that avoids having to send out
[261]
requests to produce
[263]
and then if the other person doesn't
[266]
produce the documents
[267]
then your lawyer now has to file some
[269]
kind of motion to compel
[271]
the information to be um disclosed to
[275]
you
[275]
so i would just say the more you can get
[279]
your hands on the better it is
[281]
i actually had a client one time who
[284]
would just
[284]
get little bits and pieces and and you
[286]
know she would just drop it off at my
[288]
office and
[289]
she did that for like two years before
[291]
we actually even started the divorce but
[294]
um that's what she did and so gathering
[296]
your financial information is going to
[298]
be really really important
[300]
number two is going to be understanding
[303]
your lifestyle and tracking your
[305]
expenses
[306]
so if there's going to be any kind of a
[308]
claim
[309]
with regard to alimony or support
[313]
or maybe even child support or something
[315]
like that lifestyle
[317]
and and monthly expenses may
[320]
end up being an issue so it's really
[323]
good if you have a really good
[324]
understanding of how much you've been
[326]
spending monthly
[327]
on anything you know including
[331]
mortgage taxes insurance electricity
[335]
utilities cell phones but also
[338]
dining out insurances pet expenses
[342]
grooming gifts for people any kind of
[345]
children's expenses
[346]
tuition lunches
[350]
anything that you're spending for the
[351]
children extracurricular activities
[354]
things like that so
[356]
make sure you have a really good
[357]
understanding if you can
[359]
of what the lifestyle has been because
[362]
that will also help you as well
[365]
sometimes people need to hire forensic
[367]
accountants for lifestyle analysis
[369]
and if you've already done the work it
[372]
will save you
[373]
lots and lots of money number three
[377]
is having access to cash because
[380]
especially if you are the non-moneyed
[382]
spouse
[383]
yes your lawyer can potentially file
[386]
something for you to get
[388]
some sort of support for you
[391]
on a temporary basis and going forward
[394]
and yes maybe
[395]
your spouse will continue to deposit
[397]
their paycheck into the joint account or
[400]
let you have access to credit cards and
[402]
things like that but they may not
[404]
they may cut off your access to that and
[406]
yes your lawyer can file something that
[409]
orders the court that where the judge
[412]
will order the
[412]
narcissist or whoever the other person
[414]
is to
[416]
continue to pay for those things for you
[418]
and can you continue to give you
[420]
access to those things but in the
[422]
meantime
[423]
while they've cut you off your lawyer
[425]
has to
[426]
file the motion get the hearing time
[429]
get in front of the judge get the judge
[431]
to give a ruling
[432]
and all that time you're trying to live
[435]
and how
[436]
are you going to so if you can
[439]
ideally it would be better if you have
[441]
at least a few months worth
[443]
of cash that you have access to that you
[446]
have sole control over
[448]
and also enough to hire a lawyer
[452]
if possible if you don't have a way to
[455]
save it up for yourself
[456]
maybe you can call upon family members
[459]
or friends to
[460]
get a loan for you so that until your
[464]
lawyer can go and get that money back
[466]
from the spouse
[469]
from a court hearing that you uh take it
[472]
out in loans and
[473]
obviously there's no guarantee that you
[475]
can get it back but that is something
[477]
that you will want to talk
[478]
to your attorney about but in the
[480]
meantime if you can get access to having
[483]
enough cash to
[485]
let you know get you going for a few
[487]
months and also
[489]
hire an attorney that would be the ideal
[491]
situation
[492]
the last thing is just prepare yourself
[495]
and your documents
[496]
and making sure that your trust account
[498]
i mean any trust documents or wills or
[501]
anything like that
[502]
state what you want them to say because
[505]
once you get
[506]
going with the divorce you may or may
[508]
not be allowed to change beneficiaries
[510]
or
[511]
change what is in your
[514]
trust documents or your wills or things
[517]
like that or beneficiaries on iras
[519]
because sometimes depending on the
[522]
jurisdiction that you're in
[523]
there may be a standing order issued
[526]
that it gets issued it's an
[528]
order of the court that gets issued as
[530]
soon as the divorce is filed
[533]
which precludes people from making big
[535]
changes
[536]
so you know it will preclude you from
[539]
also putting the house on the market or
[541]
doing anything like that
[542]
unless you agree to
[545]
putting it on the market or making these
[547]
big changes
[548]
so um if there are changes that you want
[552]
to make you should probably talk to your
[553]
lawyer but those are the kinds of things
[555]
that you're going to want to do
[557]
prior to the divorce being filed
[561]
so if you are getting ready to divorce a
[564]
narcissist and you're getting ready
[565]
or anybody and you're getting ready to
[568]
negotiate with that person you should
[570]
