and we're going to talk to you today

about a more in-depth topic in regards
[30]
to
[30]
auto accident litigation
[32]
and something that we're unfortunately
[34]
seeing a lot more of here at the beach
[36]
with everyone
[37]
uh with everything reopening everybody
[39]
getting back on the road and getting
[41]
into the bars and the restaurants here
[42]
at the beach and now that the tourist
[44]
season is kind of slowing down
[47]
hopefully these kind of cases slow down
[49]
as well but we want to educate you on
[50]
the front end on what to look out for
[53]
so the topic today is dram shops okay
[56]
and that that's kind of that's a lawsuit
[58]
that will be brought in conjunction or
[60]
maybe stand alone when you are hit by
[63]
someone who was driving while they were
[65]
impaired and obviously they were over
[67]
served at a restaurant or bar or any
[70]
kind of establishment that serves
[71]
alcohol
[73]
so i kind of defined it if y'all want to
[76]
add add to that you can but
[78]
the law just changed in south carolina a
[80]
couple years ago and unfortunately we
[82]
had cases that we had early on in our
[85]
practice what what happened amy
[88]
before the law changed before
[90]
the law changed and this is what like
[92]
broke our hearts because these cases are
[94]
always really catastrophic injuries is
[96]
that out people who are serving alcohol
[98]
were not required to carry insurance
[100]
so you could serve any amount of alcohol
[102]
somebody could come to your
[103]
establishment a half a gallon of liquor
[105]
and they could go and kill somebody
[107]
and then bring their liability right and
[110]
or
[110]
reliability but no no requirement for
[113]
insurance and so
[114]
we've had it happen way too many times
[116]
and it broke our heart because either
[118]
they're catastrophic catastrophic
[119]
injuries paralysis i mean you name it um
[122]
or death and there's nothing there's no
[125]
way to recover for that family and it
[128]
just it breaks your heart but a couple
[129]
years ago they enacted a law where you
[132]
have to carry a minimum of a million
[133]
dollar policy so that's great so right
[135]
everybody in south carolina if they're
[137]
an establishment serving alcohol they
[139]
have to carry a million dollar liability
[141]
alcohol policy which that that is great
[143]
and our senator luke rankin was behind
[145]
that and so it's kudos to him yeah
[149]
that's so important because normally the
[151]
drunk driver who hits our clients will
[153]
have state minimum you know liability
[155]
insurance
[156]
on their auto policy and so that's
[159]
twenty five thousand dollars um fifty
[161]
thousand if you're lucky you can get the
[163]
property damage um but
[166]
where it really comes in is when the
[167]
bars over serve these drunk drivers that
[169]
adds extra value there's more insurance
[171]
money that you normally wouldn't have
[173]
for these catastrophic injuries
[175]
we've talked about our investigation
[177]
team
[179]
in several of these episodes
[181]
and in no other case is it more
[184]
important than in these dram shop cases
[187]
absolutely
[188]
and
[189]
we of course
[191]
our investigator is a retired detective
[193]
when we get a case like this we call him
[195]
and he is on it immediately and he'll
[198]
drop anything he's doing and he knows
[199]
that when justin amy sarah call he's
[202]
gonna stop what he's doing he's gonna go
[203]
get to the bottom of this and start
[205]
investigating this for us and the reason
[207]
why is you gotta figure out these
[209]
witnesses
[210]
you've got to figure out these
[211]
bartenders and receipts receipts but the
[215]
bartenders down here it's a very
[216]
transient community down here in myrtle
[218]
beach so
[219]
there's people who can be bartending one
[221]
week and they're
[222]
you know waiting tables at some other
[223]
bar the next week and we've got to chase
[225]
these people they're constantly moving
[227]
and these witnesses are very very
[229]
important if the defense is going to
[230]
fight us on this and say oh no he didn't
[232]
drink that last drink here or he wasn't
[234]
over served here because that's always
[236]
their defense their defense says hey we
[237]
can give somebody a couple beers but
[240]
were they properly trained was the guy
[242]
already drinking and that's what you
[244]
said receipts who said receipts
[246]
so you see yeah so you can see somebody
[247]
took three shots or drink six beers i
[249]
mean that's that's ridiculous that's not
[250]
believable that they weren't over served
[253]
especially in a short amount of time but
[254]
also the investigation is so important
[256]
for videos because you'll have other
[258]
businesses
[259]
catch the accident or the person leaving
[261]
a bar on video or the bar's own
[263]
surveillance video but oftentimes those
[265]
videos will overwrite themselves
[266]
sometimes within 24 hours
[269]
sometimes within a week and you can't
[271]
get that footage very long after the
[273]
accident so it's super important that
[275]
our investigator gets on it um we send
[277]
out our letters of preservation and we
[278]
make sure that all the video is going to
[280]
be there
[281]
when we needed to litigate the clean you
[283]
know we've also learned um it's also not
[285]
just about the receipts because a lot of
[287]
times the receipts lie to us because
[288]
somebody's buying shops for their
[290]
friends or whatever i mean we've had a
[292]
recent case where
[294]
the guy would pay for some of it but
[296]
also run a tab
[297]
um
[299]
on the house um on a separate book put
[302]
it on the books i mean so we're
[304]
constantly that's what our investigator
[305]
is figuring out he's watching he's going
[307]
in there before he even asks questions
[309]
and he's pretend you know nursing a
[310]
drink and watching everything that
[311]
happens for a couple nights just to see
[314]
are there you know is there anything out
[315]
of the ordinary um where are the
[317]
security cameras placed you know what
[319]
kind of receipt system are they doing
[321]
how are they ringing everything up these
[322]
are all things that go and go into play
[325]
and they're really really so important
[326]
in these cases and now the the law makes
[329]
servers and bartenders they have to pass
[332]
just the cursory
[334]
alcohol training bare minimum yeah
[336]
and then there's also standards that
[338]
restaurants need to have
[340]
to make sure that someone is not over
[343]
served there's got to be a policy in
[344]
place and so the problem that we see
[346]
with covid with a lockdown is you had
[348]
all this rush everybody would open back
[350]
up when myrtle beach was open back up
[352]

everybody came down here and what they
[354]
want to do they wanted to party right
[356]
right and then we had these struggling
[358]
restaurants and bars that needed income
[361]
and what are they doing they don't care
[362]
they're just getting they're they're
[364]
letting their standards and policies and
[365]
their training go to the win and they're
[366]
just serving to get the money as much as
[368]
they can and it's it's the restaurant's
[370]
fault they need the money but it's also
[372]
the bartender the server they want the
[373]
tips so they're not going to cut
[374]
somebody off right and but what's what's
[377]
the bad part is
[379]
you know average joe client he's driving
[381]
down the street he gets hit head on by a
[382]
drunk driver that's what we're talking
[384]
about you get hit by a drunk driver okay
[385]
which is ridiculous
[387]
um
[389]
other entities we've seen so we talked
[391]
about bars restaurants can just be a bar
[394]
it can be a restaurant but um anybody
[397]
with an alcohol license yeah anybody has
[399]
to have this insurance policy now and so
[402]
anywhere that's serving alcohol you know
[404]
one of the things um
[405]
we were i mean i think we're all kind of
[407]
in tune to the murdoch cases happening
[409]
down in hampton county and uh we were
[411]
learning about the mallory beach case
[412]
which is a young woman who got killed in
[414]
a boating accident because uh the driver
[416]
was allegedly overserved and you know
[420]
when we're listening to that podcast and
[421]
we're learning about it um we learned
[423]
that you know he had bought alcohol with
[425]
a fake id at uh at a um gas station and
[428]
they've gone through the door
[430]
on video and so you know in my head the
[431]
lawyer in us the dram shop attorney in
[434]
us we're going okay we're just counting
[436]
the ball there's the policy and then you
[438]
know then we hear that he's drinking at
[439]
a bar um getting shots there's a policy
[442]
he's at a home and was there you know
[444]
possibly served underage uh by an adult
[447]
we're thinking homeowners personal
[448]
liability you know these are the things
[450]
that the average attorney is not
[452]
thinking of um that we think we think
[455]
about on a continuous basis yeah so you
[457]
and you would in a situation like that
[459]
you do a proper investigation and you
[461]
can hit every policy down the chain and
[463]
we're serving preservation letters on
[465]
every one of those entities we're you
[467]
know investigating every one of those
[469]
entities we're trying to get security
[470]
cameras from every um
[473]
every angle
[474]
along the way
[475]
because a lot of times you have people
[477]
drinking at multiple bars as well
[480]
over drinking at multiple bars right
[482]
correct and you can get every one of
[484]
them now let's say they say well
[486]
he might have drank drunk at our bar
[488]
maybe let's say it's bar number one
[489]
right and book bar and bar number three
[492]
agrees hey he was over served bar number
[493]
two says yeah he was over bar number one
[495]
says no he wasn't over served
[498]
so what happens then sir what what do we
[500]
need to do at that point in time or what
[501]
would we do if we had that case um we
[503]
would litigate it and fight it um
[506]
interview all the witnesses and it's
[508]
really gonna determine
[510]
how much alcohol
[512]
the defendant had at each bar and so
[514]
sometimes we'll even have to hire an
[515]
expert
[516]
to determine you know this was his blood
[518]
alcohol level at the time of the
[519]
accident this is his heightened weight
[522]
or hers and how much she drank at the
[523]
first bar and second bar and sort of
[525]
make a timeline to show that this person
[528]
was over served at the first bar should
[530]
have never even had a drink at the
[531]
second bar or the third bar um to get to
[534]
all those policies and get our client
[536]
compensated and the majority of the time
[537]
these people when these accidents happen
[539]
they're charged with a bui or a dui and
[542]
so we've got um
[544]
the medical records that say what the
[545]
alcohol level is or the court records or
[547]
the police records that show what that
[549]
alcohol level is and so we can reverse
[551]
engineer once we know that last number
[553]
we can go through and and figure out
[555]
what that alcohol level was and that's
[557]
what those experts and toxicologists are
[559]
able to tell us it's also that's
[560]
something great that and sets us apart
[562]
the lovely law firm you're able to
[564]
leverage your contacts with law
[565]
enforcement and the solicitor's office
[567]
who are prosecuting those felony duis
[569]
who are prosecuting the buis the duis
[572]
and we let them know hey we represent
[573]
the victim and so we work with the
[575]
victim who's also going to be the
[576]
plaintiff in the dram shop case but we
[578]
also work with the victims advocates
[579]
office who's wanted to make sure that
[581]
this person can can be made whole if
[583]
possible
[584]
now and then of course we have to go
[585]
looking because they're going to do
[586]
their own investigation they're doing a
[587]
criminal investigation okay we're doing
[590]
a plaintiff's investigation that will go
[593]
alongside and of course as we get more
[594]
information it leads us down certain
[596]
rabbit holes and we find out some
[598]
information that the police department
[599]
or the solicitor's office doesn't know
[601]
and we share that information back and
[602]
forth you know this witness said this
[605]
you really should go talk to him and
[606]
that police officer investigators out
[608]
talking to those witnesses and it really
[609]
makes all the difference and you know
[612]
we have a really wonderful relationship
[614]
with all the police departments here in
[615]
our area and our solicitor's office um
[618]
they really trust us
[620]
and um and we really trust them they and
[622]
we just have this great relationship to
[624]
where we can help each other along the
[626]
way because in these kind of cases
[628]
there's no way to put our clients back
[629]
whole again there's just not you know a
[632]
lot of times we're looking at people who
[633]
are paraplegics or you know broken
[636]
spines uh
[639]
stoma bags on the you know the outside
[640]
of their bodies for the rest of their
[642]
life permanently disabled people
[644]
horrific injuries and there's not a
[647]
number that will ever make them hold
[648]
there's not a number of years you know
[651]
the athlete driver can do in prison that
[652]
will ever make them okay again and so a
[655]
lot of times this is our only way
[658]
to even attempt to try to get them there
[660]
or to give them some kind of peace or
[663]
you know help them with their daily
[665]
lives because everything changed in an
[667]
instant yeah and the criminal
[670]
defendant can be punished you know in
[671]
the criminal system but as far as these
[673]
bars over serving people and sort of
[676]
enabling these drivers to get drunk and
[680]
almost kill someone or kill someone um
[682]
the bars don't go to jail and so the
[684]
only way to hold them accountable is to
[685]
hold them accountable civilly i think
[687]
the solicitor's office knows that and so
[689]
we kind of work together to make sure
[690]
there's accountability on all ends yeah
[692]
we can't throw a a bar in jail you know
[694]
we can't throw a business in jail but
[696]
the one thing we can do to hold them
[697]
accountable is to sue them and try to
[699]
prevent it from happening right and
[701]
that's it makes everybody think twice
[703]
after that yeah the next person they
[705]
serve they're not going to give them
[706]
that for the four shots or whatever that
[708]
is and go back to those policies and
[710]
procedures that they should have been
[711]
following all along
[713]
the one thing i would add uh ladies is
[716]
uh
[717]
and i've preached this i preach this to
[719]
everybody but it's even especially here
[721]
while we've been talking about hey this
[723]
is a good thing there's a million dollar
[724]
policy there's going to be an order
[726]
of uh
[728]
recovery
[729]
first we're going to go after the at
[730]
fault driver okay
[732]
sarah you touched on this that might be
[734]
a minimum policy 25.50 so the only way
[737]
that you can adequately protect yourself
[739]
is to raise
[741]
your under insured motorist coverage
[745]
you have to get as much as you can
[746]
possibly afford and that's coverage that
[748]
steps in if there's not enough insurance
[751]
on the front end
[752]
again you're never going to be made
[753]
whole but if you get
[755]
the at fault policy you have adequate
[758]
underinsured motorist coverage policy we
[760]
get that policy for you then we go after
[762]
this you have a chance
[765]
you know we tell everybody all the time
[766]
whether you're on a motorcycle in a car
[769]
an rv whatever that looks like for you
[771]
raise your you i am to as much as you
[775]
can afford and i've been hearing this a
[776]
lot recently that i have full coverage
[779]
so even if you think you have full
[780]
coverage uh make sure you look at that
[782]
policy because full coverage means that
[784]
your property damage is going to get
[785]
fixed whether you cause the accident or
[787]
someone else does and that's protecting
[790]
the bank who you make your payments to
[791]
that's not protecting you so under
[793]
insured motorist coverage is the only
[795]
insurance that you can really buy to
[797]
protect yourself
[799]
in case something bad happens and that's
[801]
it's worth every penny it's not that
[802]
much extra on your policy either and we
[804]
tell people all the time when we meet
[806]
people out or we do you know rallies or
[808]
community service projects or whatever
[811]
call us we'll look at your insurance
[812]
send us your deck page and we'll tell
[814]
you for free um exactly you know where
[817]
you're lacking and what you need to up
[819]
um and almost 100 of the time 99.9
[823]
percent of the time i'd say justin are
[824]
probably and syria are probably the only
[826]
exception to this rule because we know
[827]
it or attorneys that do this kind of
[829]
work because we have crazy high uims on
[832]
our own cars we have a million dollar
[834]
policy that will cover us if something
[836]
happens
[837]
that you need to up your uim and um so
[839]
if they have no insurance or they don't
[841]
have enough to cover you you need of
[843]
those to as much as you can afford and a
[845]
lot of times the the difference in uh
[848]
what you're paying and that little bit
[849]
of extra insurance is negligible it's
[851]
ten twenty dollars
[853]
um you know a quarter or a whole period
[856]
yeah so definitely call us we we'd be
[858]
happy to do that for you especially if
[860]
you think you have full coverage um let
[862]
me look at it and let me know that
[863]
you're covering yourself percent of the
[865]
time when people say they have full
[866]
coverage they don't really have full
[867]
coverage they're not protected and that
[869]
that's a rude awakening when we have
[871]
that conversation with a client and they
[873]
say hey i got full coverage i got full
[874]
coverage no you got nothing breaks are
[876]
hard especially when they have these
[877]
catastrophic injuries
[879]
you know or any really anything over 25
[881]
50 000 injuries i mean you go to the
[883]
hospital as a trauma you know a level
[885]
one trauma that's your hospital bill in
[888]
one shot in a two-day period
[891]
i think that's a good place to end it
[893]
if you don't want to do it for yourself
[895]
do it for your family do it for your
[896]
wife do it for your kids because that's
[898]
who's going to be left holding the bag
[899]
if you're hit by one of these jackasses
[901]
driving drunk i mean let's just put it
