um joshua relates to all of our tenants

the good ones

and the bad ones today we got a story

about a bad one that we're dealing with

and it's okay
[15]
just not all tenants are perfect there
[16]
are bad tenants out there and the
[18]
question is what do you do when you've
[19]
got a bad tenant so
[21]
here's what we've got we've got a tenant
[23]
that just moved in recently making a
[24]
bunch of noise in the building
[26]
she's in there doing her laundry at two
[28]
o'clock in the morning the laundry room
[29]
when there's clear posted notice not to
[31]
do that
[32]
um she's you know active typically from
[35]
midnight
[35]
to four in the morning having you know
[38]
arguments with her boyfriend and
[40]
she's also smoking in the building as
[42]
clear no smoking policy in the property
[44]
um and the boyfriend that i just
[46]
referred to is not on the lease and he
[47]
lives there with her and so there's a
[49]
clear clause in our lease that says
[50]
unauthorized occupants are not allowed
[52]
in the property um
[54]
did i miss anything that she's doing in
[56]
there yeah pets she's got a pet
[58]
got a little kitty cat that's okay we
[60]
love pets too but we charge pet fees for
[62]
pets pets pay rent at the
[63]
in our property so um and she said you
[66]
know the typical thing we've had from
[67]
every tenant that has a pet that's not
[69]
supposed to
[70]
give us the same line you know that

every tenant said what did she say she
[74]
says i'm cassitting so

you're watching it for a friend okay
[76]
yeah everybody's oh i'm watching

watching this dog from my friend on a
[79]
on a tuesday you know not over the
[81]
weekend or anything like that i just
[82]
happen to have this dog
[84]
and all this dog food and all these you
[86]
know pet toys and stuff like that so no

not my dog you know but i just happen to
[90]
be a cat and she's cat sitting
[91]
okay so uh so what do we do and when
[95]
what enables us to get her out quickly
[98]
because of
[98]
clauses we have in our ways tell us what
[100]
we're what we're correct so

we're about to hand over a i'm gonna
[104]
cover her name here

we're about to protect the innocent here

right right we're gonna never

pretty much hand over a notice to vacate

and this allows us to
[114]
pretty much uh get to 10 out there uh by
[116]
a certain date but
[118]
most landlords you have to just be
[119]
mindful of how you structure
[121]
your lease because depending on how you
[123]
structure your lease
[124]
will determine whether you're allowed to
[125]
do this some landlords can't do this
[128]
they have to do a notice to cease
[130]
before they can even get this far in the
[132]
process but our lease allows us to do
[134]
this so

um i don't want to get more into that

but uh
[138]
sure yeah so you want to go so pretty

much uh
[141]
you know with this tenant particularly
[144]
uh as he said
[145]
she uh has an unauthorized tenant excuse
[148]
me a guest
[149]
and that by itself allows us to actually
[152]
guess
[153]
he's been in there for uh yeah
[156]
unauthorized occupants is anyone listed
[158]
in the lease that has lived in the lease
[160]
property for more than 10 days in a row
[162]
so we're not sticklers they can have
[164]
their friends stay over for the weekend
[166]
have a little sleepover party but
[167]
they can't have somebody with them for
[169]
10 days or more because that becomes
[170]
another occupant
[171]
becomes more usage on the building and
[173]
and we don't know who they are
[175]
how they're going to handle our space so
[176]
that becomes something that you know is
[178]
a violation of the lease
[179]
so joshua wrote up this letter this
[181]
notice of ak
[183]
and he's cited all the different places
[184]
that she's breaking her lease
[186]
and what we're doing is um what we're uh
[189]
we're going to her and saying um we're
[192]
requesting that you leave and vacate
[193]
this property we're giving her a few
[195]
days to vacate and we'll give her
[196]
her rent money back and her security
[198]
deposit back so
[199]
not getting an attorney involved we're
[201]
just giving a notice to vacate and
[202]
saying you need to leave and here's what
[204]
we'll do for you
[205]
if she does if she decides not to do
[207]
that she's still breaking her lease
[208]
contract
[209]
and we can then file eviction if she
[211]
doesn't move out by that date and in
[213]
about 30 days or so we'll have her out
[215]
um it is very easy to get a tenant out
[218]
that has not paid their rent
[219]
it's much harder to get a tenant out for
[221]
doing things that are violations of the
[222]
lease contract so make sure your lease
[224]
is
[224]
really really robust and it has all
[226]
kinds of clauses in there on things that
[227]
the tenants shouldn't be doing and what
[229]
you're going to do if they don't do it
[230]
