Okay? So this story is tremendous. I love聽 it because when the clients came to us, um,聽聽
[53]
they were very nervous. It's a husband. It was it's a husband and wife team. And the聽聽
[58]
husband was very adamant about the fact that the聽 government will not take away his wife from him,聽聽
[64]
whatever he needed to do to ensure that she was聽 secure here in the U S with him, he was going to聽聽
[70]
make it happen. And so he played a very big role聽 in the success story that I'm about to share with聽聽
[76]
you. I'm going to pull up the presentation. And聽 so guys, this is a spousal adjustment of status聽聽
[83]
case and [inaudible] waiver case. And the reason聽 it that, that we needed to prepare the waiver聽聽
[91]
is because of the criminal record that the wife聽 has. Now, what happened here? What's the story?聽聽
[100]
Well, they first went to a big firm. Okay. They聽 first consulted with a big firm, uh, but it聽聽
[107]
didn't feel right to them. And so the hue, the U S聽 citizens, husband had been watching me on YouTube聽聽
[114]
and he felt like let's go to make bean let's. I think McBean is the one to work with on this.聽聽
[121]
So they came to us and had a consultation at聽 the end of January, 2020. And if you guys recall聽聽
[128]
in January of 2020, what was the biggest聽 thing that was happening around that time聽聽
[134]
public charge, right? And we wanted to hurry up聽 and prepare the case in light of the public charge聽聽
[143]
deadline, because we didn't want our clients to聽 have to go through that horrible filing process聽聽
[149]
under public charge. We ended up filing their聽 case in February of 2020 to avoid that deadline.聽聽
[156]
Now, the client was arrested and she was聽 charged with possession of marijuana, one gram聽聽
[163]
in her country. And this is in the Caribbean and聽 her criminal case dragged up for a while. It did聽聽
[170]
drag out for a while in the Caribbean, but she聽 ultimately pled guilty and she paid a fine. 聽
[177]
Now we, When we, when she came to us,聽聽
[181]
um, we didn't have enough time to get all of her聽 records from the government to see what is it that聽聽
[190]
she put on? What did she put on her visa聽 application before coming to the us?聽聽
[195]
Did she disclose to the government that she聽 was arrested and she has this crime on her聽聽
[201]
record? Or did she withhold that information?聽 We didn't have the time in the beginning of聽聽
[208]
February to get her foyer records from the聽 department of state in time for us to file her聽聽
[215]
case before public charge hit. So we went ahead,聽 file the case. And then we ultimately got her聽聽
[221]
records back from the government in July of 2020.聽 And sure enough, her [inaudible] visa application聽聽
[229]
showed that she did misrepresent, um,聽 on her application. She misrepresented聽聽
[234]
with respect to her arrest history. Now聽 the [inaudible] waiver that we prepared,聽聽
[241]
addressed two different types of issues. The first is the marijuana offense. And then聽聽
[248]
the second is the misrepresentation on her visa聽 application. Both issues needed to be accounted聽聽
[255]
for. And so the government has this rule that聽 says that, um, if you have a criminal, if you聽聽
[263]
are found to have certain criminal grounds of聽 inadmissibility, you're going to need a waiver.聽聽
[269]
And so controlled substances friends, as you may聽 know, um, is very difficult under, is treated聽聽
[277]
very harshly under immigration laws, but there聽 is one waiver that is allowed for a controlled聽聽
[284]
substance violation. And it says this a controlled聽 substance violation, um, uh, of the laws and聽聽
[292]
regulations of any country or us state related to聽 a single offense of simple possession of 30 grams聽聽
[300]
or less of marijuana is waivable. Okay. So it聽 has to be that single offense of say a simple聽聽
[307]
possession of 30 grams or less of marijuana. So we knew that the waiver is available to聽聽
[314]
our client and we prepare it accordingly. Now,聽 what was our approach to the [inaudible] waiver?聽聽
[321]
The approach really focused on drilling down on聽 the extreme hardship that the U S citizen husband聽聽
[328]
would face. If his wife, uh, was removed or had聽 to go back to their country in the Caribbean.聽聽
[334]
And he had to go with her, we had to really聽 look at what those hardships are to our,聽聽
[340]
to him or potential hardships would be for him.聽 And the husband also had a very compelling story,聽聽
[347]
friends. I very, very compelling story of things聽 he experienced over the course of his life. And we聽聽
[353]
pulled together those experiences and told that聽 story. And then also for this particular family,聽聽
[360]
things did change during COVID, um, the income聽 level change, some medical issues, cropped up,聽聽
[367]
things did change. And so we had an opportunity聽 to talk about those changes as well, and how going聽聽
[373]
back to the Caribbean was just Completely, completely 聽
[377]
Out of the picture for this family. And we also聽 prepared a very lengthy and thorough declaration聽聽
[385]
of hardship to the U S citizen husband. But what, uh, let, well, I 聽
[391]
Was gonna actually jump past this slide, but聽 let me cover one other thing here on this slide聽聽
[396]
that the client was interviewed on August 19th,聽 2021. And then the following day, we received聽聽
[403]
an email that her case had been approved.聽 Now what ultimately led to this approval?聽聽
[410]
Well, firstly, friends, the clients were extremely聽 prepared for the interview. We did meet with them聽聽
[416]
and we re prep them really well for the interview聽 so that the wife would be very prepared on how to聽聽
[423]
make her argument about what happened with this聽 offense. Um, and to, to just be transparent聽聽
[430]
and present her case to the immigration聽 officer who was interviewing her. And then聽聽
[435]
we also attended this interview telephonically,聽 like what we do for most of our clients who聽聽
[441]
want us to be there at the interview with聽 them. And I must say that the officer聽聽
[446]
that we got that day, he was very fair. He was extremely reasonable and fair to our聽聽
[451]
clients and guys that does make a difference.聽 And so if you're out there and you have a very聽聽
[456]
similar case where you have a criminal issue聽 on your record and you need a waiver and it may聽聽
[463]
not necessarily be a criminal issue, it could be聽 fraud. It could be misrepresentation. It could be聽聽
[467]

issue waived, or, um, approved through this聽 [inaudible] waiver process, contact us, we聽聽

will tell you that we will let you know. Now the聽 [inaudible] waiver do, does require a qualifying聽聽
[595]
relative friends. It requires that you have either聽 a us citizen or a green card holder, parent,聽聽
[603]
or spouse who will suffer extreme hardship. If聽 you're separated and you have to go back to your聽聽
[610]
country and they have to go with you, right? So聽 it, this doesn't apply to everyone. You must have聽聽
[616]
this qualifying relative very important that you聽 understand this detail about the I 6 0 1 waiver聽聽
[623]
