everyone it might be a good time to get

a refresher on michigan's dram shop law

if you're wondering what is the dram

shop law what is that concept well to

clue us in what is this concept behind

the dram shop law
[31]
so that's an old term an old legal term
[33]
dram shop law we don't actually use that
[35]
as the official legal term anymore
[37]
because we have a state statute that
[39]
governs governs what we call retail
[41]
licensees and retail licensees are those
[43]
entities that are licensed by the state
[46]
specifically the michigan liquor control
[48]
commission to sell alcohol
[51]
the concept of a dram shop law which is
[53]
still a term very much used casually is
[56]
the
[56]
idea that a retail licensee an entity
[60]
that sells or furnishes alcohol can in
[63]
certain circumstances be liable
[66]
if there is an injury or death resulting
[69]
from the selling or the furnishing of
[72]
alcohol
[73]
through that establishment that's the
[74]
basic concept of what we call a dram
[76]
shop law
[78]
and when it comes to that is is it
[80]
different for folks who legally can
[82]
purchase alcohol versus those underaged
[85]
if they are involved in this
[87]
it is and it's a really important
[89]
distinction so the distinctions here
[91]
we're talking about when one of these
[93]
retail licensees can be liable for those
[96]
who are underage it is a hard and fast
[99]
no tolerance rule meaning there is no
[101]
permitted selling or furnishing of
[104]
alcohol to someone who's under the age
[105]
of 21. and so if a licensee if a bar
[110]
furnishes alcohol sells alcohol to
[111]
someone under 21
[113]
then the bar can be liable doesn't
[115]
matter the level of the intoxication of
[117]
the underage person so that's those are
[120]
our underage folks
[122]
for people who are of age 21 or older
[125]
the standard is what we call visible
[127]
intoxication
[129]
meaning that if the retail licensee
[131]
sells or furnishes alcohol to someone
[133]
who is a visibly intoxicated person
[136]
then that scenario is where the bar can
[140]
be liable if there is later
[142]
injury or death that results from that
[145]
visibly intoxicated person consuming the
[147]
alcohol so those are our two general
[149]
standards of liability for the various
[151]
classes of people that could be involved
[153]
here
[155]
with so many people tipping a few back
[157]
this week it is typically a big bar week
[159]
during thanksgiving holiday break
[161]
what about bar owners i'm sure they're a
[163]
little nervous are there any unique
[165]
rules or maybe some defenses that they
[167]
have to protect themselves
[169]
there are there's actually quite a few
[171]
so
[172]
again this concept applies if a third
[175]
party you know somebody who wasn't the
[177]
one drinking is injured or killed as a
[179]
result of the consumption of alcohol so
[181]
the first rule to remember is that is
[183]
that that person has to prove that it
[186]
was that consumption of alcohol that
[188]
what is what we call a proximate cause
[191]
or simply put played a role
[193]
in the injury or death so that's one
[195]
rule that everyone has to be
[197]
mindful of there are other rules
[199]
specific to those victims those
[201]
third-party victims the first is what we
[204]
call a statutory notice period so if one
[207]
of those victims retains a lawyer to
[210]
help them then the lawyer has to make
[212]
sure that they notify the bar within 120
[215]
days of being retained by the victim and
[218]
if they don't then the victim cannot
[220]
pursue a claim
[222]
after that the victim and their lawyer
[223]
has to make sure that they file a
[225]
lawsuit no later than two years from the
[227]
date of the injury or death again those
[229]
are rules that apply to to everyone on
[232]
on the bar side of things there are
[234]
specific defenses a one of them a good
[237]
example is the law provides a defense to
[239]
bars if the the visibly if the underage
[243]
uh consumer of alcohol had a fake id so
[246]
that provides the the bar
[249]
one defense
[250]
another defense is that the visibly
[252]
intoxicated person
[254]
cannot be the one pursuing the claim
[257]
against the bar it has to be this idea
[259]
of a third party
[261]
and then
[262]
the other thing to
[264]
this is a technical point but if a
[266]
lawyer is representing a victim
[269]
the lawyer if they're going to pursue a
[271]
claim a legal action against the bar
[274]
they have to include
[276]
the intoxicated person as a defendant as
[278]
well we call this name and retain you
[281]
have to name
[283]
the intoxicated person and keep them as
[285]
part of the lawsuit and that's also
[288]
because bars have a right for what's
[290]
called indemnification meaning they can
[292]
seek reimbursement from the intoxicated
[295]
person if the bar is held liable so
[298]
there's kind of a lot to unpack there i
[300]
think the takeaway there is that yes
[302]
there are very specific rules that apply
[306]
to these unique set of of cases that are
[309]
they are personal injury or wrongful
[311]
death cases but they're subject to a
[312]
whole different set of their own rules
[315]
obviously this is something that we hope
[317]
never happens to anyone but the stats do
[319]
show that
[321]
there are more traffic accidents and
[323]
injuries through drunk driving this time
[326]
of year especially around this holiday
[328]
if someone
[329]
is involved in that heaven forbid where
[331]
can they get more information where can
[332]
they get the details they need to
[334]
protect themselves
[336]
well i would recommend that that happens
[337]
that people do seek the advice of legal
[340]
counsel
[341]
for some of the reasons i mentioned but
[343]
also because these cases can be very
[344]
fact intensive and there's important
[346]
evidence that has to be ascertained
[348]
oftentimes very early on to determine
[351]
where did the intoxicated person consume
[353]
their alcohol was it at one place was it
[356]
multiple places
[357]
over what period of time and the
[359]
evidence that to prove that various
[362]
chain of events is something that needs
[363]
to be gathered and collected soon and
[365]
then because of these unique rules it's
[368]
not something that i think people want
[369]
to navigate on their own without some
[371]
