right now here's the question that I'm

this is not a question that I could just

answer in one video this is going to be

a series okay a series on case

processing times because I get asked so

very frequently either on YouTube
[69]
through your comments or Facebook or

from folks call in my office folks

wonder 1 tend to know how long will
[77]
their green card petition process take
[80]
and so I'm gonna break it down for you
[82]
in this video let's talk only about a US
[85]
citizen petitioner okay so as you know
[89]
you smart immigration people a US
[91]
citizen can petition for his or her
[94]
spouse parent child of any age and
[97]
marital status and also sibling brother
[101]
and sister let's take a look
[103]
specifically at a US citizen who
[106]
petitions for either the parent the
[110]
child who's under the age of 21 and
[112]
unmarried or the spouse so those people
[116]
are considered the immediate relatives
[118]
of a US citizen so what is the process
[120]
in time as you guys know immediate
[122]
relatives are they they basically have
[125]
the highest priority right to our
[128]
government as far as the green card
[130]
process goes there at the very
[132]
top of the list so their wait time for
[135]
approval is not typically as long as
[138]
those who go through our family based
[140]
system here's what we're looking at now
[143]
first of all you need to know that case
[145]
process and times have slowed down
[148]
because lots of petitions and
[152]
applications have been filled coming in
[154]
right from people who are very scared
[157]
and worried about their immigration
[158]
status and so they've been there are
[161]
more violence
[162]
so processing times have slowed down a
[165]
bit but the point is that if a US
[168]
citizen is petitioning for an immediate
[172]
relative we've got to first look at
[174]
where that petition will be processed at
[178]
for example if you're here on the East
[181]
Coast I'm in New York right the
[183]
petitions the i-130 petition would go up
[186]
to the vermont processing center and so
[189]
vermont processing center is now
[193]
reporting on uscis.gov x' website that
[196]
they're processing time for the i-130
[198]
petition for u.s. citizens sponsoring an
[201]
immediate relative that process and time
[203]
is five to seven months and so they are
[206]
as of the filming of this video they are
[209]
up to petitions that were received as of
[213]
February 21st 2018 so that's not really
[216]
a very long wait time right but the time
[219]
does get a bit longer if those
[221]
individuals are going through the
[223]
adjustment of status process and in one
[226]
step process to a green card those
[229]
people obviously face a somewhat of a
[232]
longer wait time right I'm not talking
[235]
about the processing of adjustment of
[237]
status in this video I'm only talking
[240]
about the i-130 family petition and
[243]
USCIS is reporting that it will only
[246]
take five to seven months of processing
[249]
time at the Vermont Center now let's
[251]
look at the other centers around the
[252]
country Texas for example Texas it takes
[255]
about six point five to eight months for
[258]
that petition to be approved they are
[260]
now up to January 20th 2018
[264]
Potomac for those who are in the virgin
[266]
area those petitions take a bit longer
[268]
9.5 months to 12 months nebraska seven
[273]
months to nine point five months so
[275]
that's the note this is the normal
[278]
processing time case processing time now
[282]
if you find that your i-130 petition has
[285]
been pending longer than those
[287]
processing times that are being reported
[289]
by the government you can actually
[292]
submit a request to the government and
[294]
let them know that your petition has
[298]
been pending outside of the normal
[300]
processing time and therefore they need
[302]
to look into it and give you an
[304]
explanation as to why it's taken so long
[307]
and also give you an opportunity to cure
[310]
the problem if there's additional
[312]
evidence that you'll need to submit I
[314]
