would try this out for the latest video. Today I'm going to talk to you about what聽聽

can go wrong if you don't pay your nanny legally. So, if you're going to bring in some household聽聽
[23]
help, you definitely need to think about a聽 plan and how you're going to pay your nanny.

There are two ways to pay your nanny. You can聽 pay legally Above The Table or you can pay聽聽
[33]
Under The Table, which is kind of more casual聽 pay how you would pay maybe the neighborhood聽聽
[38]
who comes over to break your lawn for example. If you're going to bring any sort of household聽聽
[43]
help in, such as a Nanny and that care is going to聽 happen on an ongoing basis and you are directing聽聽
[49]
how that care happens, the individual cannot聽 be paid as a 1099 independent contractor.

They have to be paid as a W2 employee. That means that they must be paid time聽聽
[61]
and a half for any hours worked over 40 in聽 a week and you must as a household employer,聽聽
[68]
pay for social security, medicare,聽 and workers compensation insurance.

So, how do you know when you聽 need to start paying these taxes?

For 2021 the IRS has set the threshold for when聽 you need to start paying those taxes at $2,300.

So, you can pay your care provider up to聽 twenty-three hundred dollars each year聽聽
[89]
before you're responsible for paying those taxes.

They do change that amount every year so聽 every year you do wanna check and see how that聽聽
[97]
threshold has changed, if it has gone up which it聽 typically does or it has gone down for no reason.

The term payment Under The Table is a very聽 common topic but it's important to note that聽聽
[107]
it's also synonymous with tax evasion, if you聽 are going over that $2,300 per year threshold.聽聽

And tax evasion of course, as we all know has some really聽聽
[116]
serious consequences for both聽 the employer and the employee.

It's estimated based on some recent studies聽 that only about 250000 households in the us聽聽
[126]
is reporting household wages, and according聽 to The IRS, schedule h filings have actually聽聽
[132]
declined even though the bureau of labor聽 standards is reporting that home care聽聽
[137]
and home aid workers are actually increasing. So,聽 those kinds of workers are getting more popular.聽

A recent survey of domestic employees聽 was done that showed that fewer than 9%聽聽
[147]
of them actually worked for聽 employers who paid social security.聽聽
[152]
It's also estimated that 75% to 95%聽 of people who employ domestic workers,聽聽
[158]
such as nannies don't pay payroll taxes. So, they're paying under the table,聽聽
[163]
opening themselves up to a lot of聽 liability if they ever get caught.

So, paying under the table.

Well, there is definitely a cost-saving,聽 you know if you're not paying the payroll聽聽
[175]
taxes which end up being about聽 10% of the nanny's gross pay.聽

It actually has some more聽 downsides than upsides to it.聽

So, I'm going to talk about聽 a few of those right now.

For the employee not being paid legally聽 means they won't have access to worker's聽聽
[190]
compensation insurance, they won't聽 have access to any disability benefits聽聽
[195]
and they won't have unemployment聽 insurance, medicare, or social security.

These benefits are really聽 important later on in life.聽

So, that means that could impact their future,聽 that could impact their retirement, it also can聽聽
[208]
impact financial stability for their families. For example, if the worker is injured on the job,聽聽
[215]
they could potentially be missing out on benefits聽 that not only would offer protection for them but聽聽
[220]
also potentially for their children or their聽 spouses. Another thing that the worker is聽聽
[225]
going to miss out on is that they're going to lack聽 access to certain loans and rental opportunities.

If they don't officially have those pay stubs that聽 one would get from being paid over the table or聽聽
[239]
being paid legally, they're not going to have that聽 employment history that they may need to provide聽聽
[243]
proof of if they're going to go try and rent an聽 apartment or if they're going to go buy a car聽聽

or if they're going to get some other type of聽 loan or maybe even go to buy to the first house.

So, that's something really important to consider.

It's important to know that even though聽 the employer is responsible for some of聽聽
[262]
these taxes of course, that there are聽 some tax benefits available at tax time.

So, for example, the child independent聽 care tax credit is available,聽聽
[273]
also it's possible that some employers聽 might be able to get benefits such as聽聽
[278]
a flexible spending account through聽 their own employer, through their work.

So it's important you know check-in with聽 your own HR, you might be able to access聽聽

some of those pre-tax dollars and set聽 some aside for child care expenses.聽

So, you may wonder how in the world聽 would I get caught paying my nanny聽聽
[297]
or household employee under the table if聽 I'm good with it and they're good with it!聽
[301]
Because of course, if I'm paying my nanny聽 in cash they're gonna be making more money聽聽
[306]
off the top right? So, they're happy, I'm happy,聽 I'm saving money so win-win right? Not so fast!

There are a few things you should think聽 more into before you make this choice.聽

So, if you don't file your share聽 of social security medicare聽聽
[322]
and unemployment taxes but the employee files聽 their income taxes, that can flag the IRS.聽
[329]
If you let your nanny go, they聽 can file for unemployment.聽
[332]
In doing so, they're required to give聽 a list of all their former employers,聽聽
[336]
the unemployment office can investigate聽 and the nanny won't get any benefits.聽聽

And, here's an example of a situation that聽 I just heard personally from a family,聽聽
[347]
where their nanny was at work and they got injured聽 on the job, the nanny went to the ER but because聽聽
[352]
the nanny wasn't being paid legally by the family,聽 they didn't have access to workers' comp insurance.聽
[357]
And unfortunately, this leaves both the nanny and聽 the family in a really tough spot, because the聽聽
[362]
nanny doesn't have any access to benefits through聽 worker's compensation or labor in industries聽聽
[367]
and it could potentially open up the聽 family to some legal liability there.

Because now we're going to聽 finish up with what can happen聽聽

if the nanny or the family聽 gets caught not paying taxes!

So first off, I do want to put聽 out this little disclaimer that聽聽

So first off, if you're a nanny you definitely聽 would be responsible for any back taxes and聽聽
[391]
probably some penalties and fines. So, what are some of the consequences聽聽
[396]
for the household employer the聽 family of not paying legally?

You could be responsible, you could hold聽 all of the liability for both your own聽聽
[405]
portion as well as the employee's聽 portion of paying the back taxes.聽
[409]
You could be hit with penalties and聽 fines for not paying those back taxes聽聽
[413]
and you could be responsible for聽 interest charges that go along with that.聽
[417]
You could also be hit with criminal charges聽 which may include jail time for tax evasion,聽聽
[422]
and if you hold any professional licensures may聽 be a physician or a dentist you could lose those.

It's important to know that there's no聽 statute of limitations on tax evasion.聽

So, 20 years after you employ a nanny you could聽 still have the IRS come knocking on your door聽聽
[438]
to collect those back taxes and I don't know what聽 interest would be on 20-year-old nanny back taxes.

But, I'm assuming it would be a really large聽 number. So, as you can see the pros of paying聽聽
[448]
your nanny legally far outweigh the cons,聽 nobody wants to land in jail over nanny pay.

It's quick and easy to set up via a聽 payroll company or with a little bit聽聽

of late work if you have the time to聽 invest in doing the payroll yourself.
