CMP and NTSO Complaints.
[51]
I'm Rosemarie Purcell with

[54]
and Enforcement.
[55]
This webinar is the
fourth in a series of five
[58]
webinars to assist
retailers, who have
[61]
received a Complaint for a
CMP, also referred to as a
[65]
Civil Money Penalty, or an
NTSO, also referred to as
[69]
a No-Tobacco- Sale Order.
[71]
Throughout this webinar,
we will focus on the
[75]
Settlement Process
for CMPs and NTSOs.
[78]
The FDA has created five
separate webinars in this
[81]
series.
[82]
The other webinars are:
Part 1: Introduction to
[86]
CMP and NTSO Complaints,
[89]
Part 2: How to Pay a CMP
[91]
using the Online Payment
Portal; Part 3: How to
[95]
File an Answer and the
Consequences for Not
[98]
Filing an Answer; and Part
5: The Hearing Process,
[103]
including what happens
before the hearing is
[105]
conducted, during the
hearing, and after the
[107]
hearing.
[109]
All five webinars are
available on the FDA
[112]

[119]
bar on the main FDA
homepage, and follow the
[122]
FDA Tobacco Compliance
Webinars link in search
[125]
results.
[127]
Webinars are
organized by year.
[129]
You can watch all five
webinars in succession or
[132]
you can skip ahead to a
webinar or topic of your
[135]
choice.
[136]
During this webinar, we
will focus on how you can
[140]
settle your CMP or NTSO
case with the FDA's Center
[144]
for Tobacco Products.
[146]
Specifically, we will
discuss - What is
[150]
Settlement?
[151]
- What is a
Settlement Conference?
[153]
- What will be discussed
during the Settlement
[155]
Conference?
[156]
- And, what is the
Settlement Agreement?
[159]
So, what is Settlement?
[161]
A settlement conference is
simply a meeting between
[163]
you and the FDA's Center
for Tobacco Products to
[167]
discuss your case.
[169]
Settlement discussions are
an efficient method for
[172]
resolving your case
without proceeding to a
[174]
hearing.
[176]
You can resolve your
CMP or NTSO case through
[179]
settlement, where you and
FDA's Center for Tobacco
[183]
Products agree to a
reduced penalty amount or
[186]
NTSO period.
[188]
Settlement can occur at
any time after you have
[191]
received your Complaint,
and before a final
[194]
decision has been
reached in your case.
[197]
If settlement cannot be
reached, your case will
[200]
proceed through the
hearing process.
[202]
We will discuss the
hearing process in detail
[204]
in the fifth webinar.
[207]
A settlement conference
takes place by telephone
[209]
only.
[210]
Settlement conferences
are not held in person.
[213]
To settle your case, you
must contact FDA's Center
[217]
for Tobacco Products and
arrange for a settlement
[219]
conference.
[222]
The purpose of a
settlement conference is
[224]
for both sides to discuss
the appropriateness of the
[227]
penalty sought.
[228]
These settlement
conferences are typically
[231]
informal.
[232]
If you are represented by
an attorney, FDA's Center
[235]
for Tobacco Products
will communicate with you
[237]
through your attorney,
so your attorney should
[240]
attend the settlement
conference.
[243]
To request a settlement
conference, you can
[245]
contact FDA's Center for
Tobacco Products by phone
[249]
or email.
[250]
The contact information
is listed on the slide.
[254]
Contact information and
additional details on how
[256]
to resolve your case
outside of a hearing by
[259]
scheduling a settlement
conference are outlined in
[263]
the cover letter that
accompanies the Complaint
[266]
sent to you by the
FDA's Center for Tobacco
[268]
Products.
[270]
When you contact the
FDA's Center for Tobacco
[273]
Products, please provide
your name, your contact
[277]
information, and the
FDA docket number.
[280]
The FDA docket number
can be found on the cover
[284]
letter that accompanies
your Complaint.
[287]
Once you provide FDA's
Center for Tobacco
[290]
Products with your contact
information and FDA docket
[293]
number, we will contact
you to set up a mutually
[296]
agreeable date and time
to discuss your case.
[301]
Who participates in the
settlement conference?
[304]
- You, the retailer; -
Your attorney, if you have
[308]
one; - FDA's Center
for Tobacco Products
[312]
representatives.
[314]
Now let's turn our
attention to what is
[316]
discussed during the
settlement conference.
[319]
During the settlement
conference, you should be
[322]
prepared to discuss
any specific facts or
[325]
circumstances that you
feel should reduce your
[328]
CMP amount or NTSO period.
[331]
These are called
mitigating factors.
[334]
The following are some
examples of information or
[337]
facts that might be
considered during
[339]
settlement discussions.
[341]
These factors are also
the same factors that the
[344]
Administrative Law Judge,
or ALJ, would be required
[348]
to consider at
the hearing.
[351]
The ability to
pay the penalty.
[353]
This may include, but
is not limited to,
[356]
information related
to income, assets, and
[360]
information about revenue
from tobacco sales.
[364]
The effect the proposed
penalty has on the retail
[366]
establishment's ability to
continue to do business.
[371]
The history of prior
violations at the
[373]
establishment.
[376]
The degree of culpability.
[377]
As the owner of the retail
establishment, you are
[380]
responsible for the
actions of your employees.
[385]
Any fine or penalty you
already have paid to your
[388]
State for the
same violation.
[391]
Any other unique
circumstances that you
[394]
believe should lower the
penalty amount or NTSO
[397]
duration.
[399]
We encourage you to inform
FDA's Center for Tobacco
[402]
Products of these
facts during settlement
[405]
conferences, as they may
help FDA's Center for
[408]
Tobacco Products in
determining an appropriate
[411]
settlement for the case.
[413]
Additionally, if you have
taken steps to prevent
[416]
future sales of tobacco
products to minors, it is
[419]
very important that you
inform FDA's Center for
[422]
Tobacco Products
of such actions.
[426]
We will now look at some
examples of mitigating
[429]
factors that have helped
to reduce penalties sought
[432]
during settlement
conferences.
[435]
- Establishing
disciplinary sanctions for
[438]
employees who sell tobacco
products to minors or
[441]
violate other
tobacco regulations.
[444]
- Additional employee
training regarding sale of
[447]
tobacco products,
including preventing sales
[449]
to minors.
[451]
- Requiring employees
to verify age by way of
[454]
photographic
identification using an
[456]
electronic
scanning device.
[459]
- Or, enrollment in
voluntary compliance check
[462]
programs, also known as
secret shopper programs.
[466]
This list of examples
is not exhaustive.
[469]
You may have implemented
other policies or changes
[472]
that help prevent sales
of tobacco products to
[475]
minors.
[476]
If that is the case, you
should inform FDA's Center
[479]
for Tobacco Products
of those measures.
[483]
FDA's Center for Tobacco
Products may request
[486]
documents to support any
facts or circumstances
[489]
that help reduce a
penalty during settlement
[491]
discussions.
[493]
Examples of such documents
include: - Financial
[497]
documents related to
tobacco sales and revenue,
[500]
showing how much of your
total revenue is made up
[504]
of tobacco sales.
[506]
- Documents related to
financial hardship that
[508]
you may be having.
[510]
- Documentation of any
actions you have taken to
[513]
ensure compliance after
receiving a Warning
[516]
Letter, CMP, or
NTSO in the past.
[520]
This list of examples
is not exhaustive.
[523]
FDA's Center for Tobacco
Products may request, and
[526]
you may propose, other
documents or evidence that
[529]
could help in
settlement discussions.
[532]
Now let's discuss what
happens if you and the
[534]
FDA's Center for Tobacco
Products agree to settle
[538]
your case.
[539]
The next few slides will
discuss the settlement
[541]
agreement separately for
CMPs and NTSOs, because
[545]
the process is slightly
different for each.
[548]
Let's start with CMPs.
[551]
If you reach a settlement
with FDA's Center for
[553]
Tobacco Products for a
CMP Complaint, you will
[557]
receive a letter
summarizing the settlement
[559]
discussions.
[560]
Your letter will include:
- the agreed upon reduced
[564]
penalty amount, - the date
that the payment is due,
[568]
- and detailed
instructions on how to
[570]
acknowledge the violations
in the CMP Complaint and
[574]
pay the agreed
upon amount.
[576]
Remember, all CMPs should
be paid through the online
[579]
payment portal unless
alternate arrangements
[582]
were made during the
settlement conference.
[585]
For more detailed
instructions on using the
[588]
online payment portal,
please watch our second
[591]
webinar in this series:
How to Pay a CMP Using the
[595]
Online Portal.
[598]
Once you acknowledge
the violations and FDA
[601]
receives payment, we
will notify the ALJ by
[604]
submitting a document
called the "Notice of
[607]
Settlement
Agreement," or NSA.
[609]
The NSA will state that
your case was resolved
[613]
through the settlement
agreement, you have made
[615]
sufficient payment, you
acknowledged that the
[618]
violations outlined in the
CMP Complaint occurred,
[622]
and requests that the
ALJ close the case.
[626]
The FDA's Center for
Tobacco Products will send
[629]
you a paper copy of the
NSA when it is filed with
[632]
the Departmental
Appeals Board, or DAB.
[634]
Now let's discuss the
Settlement Agreement for
[638]
an NTSO complaint.
[641]
If you reach an agreement
with the FDA's Center for
[644]
Tobacco Products for an
NTSO Complaint, FDA's
[648]
Center for Tobacco
Products will send you the
[650]
Settlement Agreement for
signature The Settlement
[653]
Agreement will require
acknowledgment of the
[656]
violations alleged in
the Complaint, and will
[659]
contain all the
agreed-upon terms of
[661]
settlement, including the
agreed-upon NTSO duration
[666]
and the start and end
dates for the NTSO.
[669]
The Settlement Agreement
will also specify a
[672]
penalty for failing to
meet the terms of the
[674]
agreement.
[675]
The Settlement Agreement
must be signed by the
[677]
retailer and returned to
FDA's Center for Tobacco
[680]
Products by the
requested due date.
[684]
Failure to do so may
void the agreement.
[687]
Once FDA's Center for
Tobacco Products receives
[690]
the signed Settlement
Agreement from you, the
[693]
FDA assigned attorney will
then sign the Settlement
[696]
Agreement.
[698]
This signed Settlement
Agreement with both
[700]
signatures notifies the
court that you and the
[703]
FDA's Center for Tobacco
Products have reached a
[706]
settlement in your case.
[708]
FDA's Center for Tobacco
Products will file the
[711]
signed Settlement
Agreement with the DAB and
[714]
will mail you a copy of
the Settlement Agreement
[716]
filed with DAB.
[717]
As previously discussed in
this webinar, settlement
[720]
can occur at any time
after you have received a
[724]
Complaint, and before a
final decision has been
[728]
reached for your case.
[730]
However, the settlement
process is separate from
[733]
the hearing process.
[734]
Your participation in the
settlement process does
[737]
not delay any deadlines
set by the ALJ.
[740]
You must meet all of the
ALJ-set deadlines and
[745]
requirements associated
with your case until the
[748]
Notice of Settlement
Agreement is filed and the
[751]
ALJ officially
closes your case.
[755]
This includes the
requirement that you
[757]
submit an Answer within 30
days after receiving the
[760]
Complaint.
[762]
Please view the third
webinar in our series: How
[765]
to File an Answer and
Consequences for Not
[766]
Filing an Answer, during
which we discuss the
[768]
process for
submitting an Answer.
[775]
If an Answer is filed
by the deadline, but no
[777]
settlement is reached, the
case will proceed through
[780]
the hearing process.
[783]
Please view our fifth
and last webinar in this
[785]
series, The Hearing
Process, for more
[787]
information.
[789]
This concludes our
discussion on Settling a
[792]
CMP or NTSO.
[794]
To summarize the material
that we have covered in
[797]
this webinar: - We have
discussed what settlement
[800]
is, and when it can occur.
[802]
- We have explained what
the Settlement Conference
[805]
is, and how to
request one.
[807]
- We discussed mitigating
factors that could help
[810]
reduce your penalty.
[811]
And we have described
the Notice of Settlement
[814]
Agreement, when the Notice
is sent to you, and what
[817]
the Notice contains.
[819]
Please remember the Notice
of Settlement Agreement
[821]
starts the process of
closing your case, and
[824]
that process differs
slightly depending on
[827]
whether you received a
CMP or a NTSO Complaint.
[832]

[834]
Conference process for CMP
or a NTSO Complaint, we
