will be liable for fees however if the

adjoining owner is asking the building

owner to carry out works over and above

the initial intention for example change

of materials or asking for a party rule

planned they would then become liable

for the fees

involved with those works

if the adjoining owner then instructs

their party rule for matters outside of

the scope of party rule works they will

be liable for the fees involved with

those works as they are not covered

if the adjoining owner decides to refer

matters to the third surveyor and the

third surveyor finds favour with the

building owner the fed surveyor will

apportion part of their fees as

reasonable to the adjoining owner

will also need to consider any

also be liable for something called

enclosure costs

enclosure costs arise when a building

owner uses or encloses upon a wall that

was previously built by the adjoining

this cost is in the form of a payment

from the building owner directly to the

adjoining owner

the reasoning behind this is that the

wall was previously constructed and paid

for by the adjoining owner

if you do wish to make use of of this

wall you will need to pay 50 percent of

the build cost of the wall at current

this ensures that the building owner is

construction even though the wall was

although this may seem unfair in our

eyes it should be considered a cost

saving rather than an additional cost
