'The Five' react to trial of Kyle Rittenhouse closing arguments - YouTube
Channel: unknown
[0]
where you've been watching the murder
[1]
trial of Kyle Rittenhouse this is
[3]
closing arguments day it has taken all
[6]
day they're obviously being very
[8]
detail-oriented the jury is listening to
[10]
all of this and is expected to get the
[12]
case tonight
[14]
um we're gonna we're in a 10-minute
[15]
break in the trial so we'll take it
[17]
around the table here Katie pelvis has
[18]
guitar love Jesse Waters and Greg
[20]
Gutfeld are all here for the five he
[23]
said not to talk about the case
[25]
what would you rather talk about I don't
[28]
know I mean I don't want to you know I
[29]
hate to get in trouble yes I don't want
[30]
to get in trouble I don't want to do
[31]
anything that would be wrong
[33]
um Jesse uh get your opening argument
[36]
your opening statement I love that you
[39]
can see in this country the wheels of
[40]
Justice turn like this there's not other
[42]
countries that you can just watch a live
[44]
trial see all the evidence see the
[45]
testimony in the video there's really no
[48]
reason if this looks like it's going the
[49]
way it's going for anybody to be violent
[52]
if you've watched this case closely Kyle
[54]
was there trying to help the community
[56]
the people that were shot were there to
[58]
harm the community Kyle did not have a
[61]
criminal history of these people did
[62]
have a criminal history Kyle gave up his
[65]
body armor the defense Council made a
[67]
great Point why would you give up your
[69]
body armor if you were some sort of
[70]
active shooter looking for trouble and
[73]
they searched Kyle's phone I didn't even
[75]
realize that they searched and seized
[77]
his phone he didn't have anything in
[78]
there about militias white supremacy the
[81]
phone was clean but the one guy's phone
[84]
they had a subpoena for they didn't
[85]
search the one guy changed his case
[88]
about three times and is a stone cold
[90]
liar the antifa medic this guy Rosenbaum
[93]
the committed pedophile who was Chase
[95]
him using the n-word at a BLM rally do
[99]
you really think he was with that crowd
[100]
if he's using the n-word at a BLM rally
[102]
he's chasing him down he's physically
[104]
grabbing the weapon and then again
[107]
assaulted with a skateboard kicked in
[110]
the head punched and then he's got a
[112]
loaded Glock aimed at him this whole
[114]
time Kyle's on the ground so the case is
[117]
cut and dry and the prosecution knows
[120]
they indicted too early they know they
[121]
overcharged so what do they do they lie
[123]
they get up on clothes today and they
[126]
say yeah uh he shot Rosenbaum in the
[129]
back no he didn't they had expert
[131]
Witnesses testify didn't shoot him in
[132]
the back and then remember he got caught
[135]
coaching that one witness to lie and
[136]
says you don't have the right to
[138]
self-defense if you're the one that
[139]
brings the weapon straight up not true
[141]
and then he says he's an active shooter
[143]
and you're watching video that is clear
[145]
as day this guy had ample opportunity to
[148]
cap anybody and Katie and I were in the
[151]
break talking about he had 30 rounds
[154]
the Democrats won't you what do they
[156]
want 10 tops if he had had less than 30
[159]
he might not have survived that night so
[162]
it's a political case the guy says out
[165]
there defense counsel he wants to nail
[167]
Kyle's hide to the wall because he needs
[170]
a scapegoat for the violence in Kenosha
[173]
think about it
[174]
the whole city burned down and the guy
[176]
that went in to protect the city from
[178]
burning he's now supposed to rot in jail
[180]
for the rest of his life it's
[182]
Preposterous if you don't if you don't
[184]
like the system leave all right the
[187]
judge appointed by a Democrat appointed
[189]
by a Democrat and then ran for
[191]
reelection the people put him there the
[193]
jury half of them were selected by the
[195]
prosecution you have a problem with that
[197]
go live somewhere else okay this is a
[200]
great system of government we have it is
[202]
extremely transparent we expect Justice
[205]
he was allowed to have that AR-15 as a
[208]
17 year old that night this is as clear
[211]
a cut a case of self-defense I have ever
[213]
seen and Katie you were in particular
[216]
knew a lot about the weapons charges
[218]
here
[219]
so the the question that we were
[221]
discussing uh during the trial is why
[223]
did the judge drop the the dangerous
[225]
weapons charge and the defense which has
[228]
been very good for Kyle uh read the law
[230]
and brought it to the judge and said
[232]
you're allowed to have a rifle so long
[233]
as it is not a short barrel rifle and
[236]
the rifle they are 15 that Kyle
[237]
Rittenhouse had that night was not a
[240]
short barreled rifle and therefore he
[242]
was legally allowed to possess that
[243]
weapon they throw out the dangerous
[244]
weapons charge and now the prosecution
[246]
has practically no nothing to go on at
[249]
this point I want to talk about
[251]
um you know how the the defense has gone
[254]
back to the evidence in this maybe we
[256]
can get to to the defense attorney which
[260]
number thought number two there's a call
[261]
for number two control room if you could
[263]
pull that one up and Tom um Thomas
[265]
Binger
[266]
um basically is the he's the prosecutor
[268]
and the defense is talking about him
[270]
lying here watch this
[272]
think back to back on November 2nd when
[277]
this case started
[278]
did you hear one word out of Mr binger's
[282]
mouth about provocation you didn't
[285]
because it was never said but when his
[288]
case explodes in his face now he comes
[292]
with provocation one he's lying
[296]
two he's misrepresenting or
[300]
he wasn't prepared when he started this
[302]
trial and his closing argument has been
[304]
a change to try and fit what has come
[307]
out Katie so the defense has been able
[310]
to go back to the evidence with the jury
[312]
to show them to let them see what
[315]
happened whereas the prosecution has
[317]
repeatedly changed their story based on
[319]
their own Witnesses blowing their their
[321]
case gauge growth scores for example
[323]
admitting that he was fired upon by Kyle
[326]
Rittenhouse after he pointed his Glock
[328]
19 in his face and so therefore proved
[331]
the self-defense case for the jury one
[334]
thing that's happening in Kenosha right
[336]
now there's been a lot of public opinion
[338]
about this Kyle was tried in the court
[340]
of public opinion there are National
[342]
Guard troops on guard to make sure that
[344]
the place isn't burned down again
[345]
watching all the footage and watching
[347]
the evidence from this trial brings up
[349]
last summer again and how this was
[350]
allowed in city after City
[353]
completely you know buildings burned to
[355]
the ground private business people were
[356]
killed as a result of this rioting and
[359]
it was excused over and over and over
[361]
again and tonight people are threatening
[363]
to Riot if Kyle is not convicted well
[365]
who are they defending in this case are
[367]
they defending uh Rosenbaum who's a
[370]
convicted sex offender child rapist are
[373]
they defending uh the uh Huber who was a
[376]
domestic abuser who was charged with
[378]
felony strangulation is that what we're
[380]
doing here because then it really points
[382]
out right versus wrong in this country
[384]
and are you on the side of Kyle
[386]
Rittenhouse who was there to clean up
[388]
graffiti and defend his his community or
[390]
you're going to defend the guys who
[392]
ended up you know attacking him this
[394]
band of criminals who attacked him in
[396]
the street
[397]
is that who you're going to defend and
[398]
burn the city down again for I mean
[400]
that's that's what this comes down to at
[402]
this point and the threats that are
[403]
being made there are 500 National Guard
[405]
troops that were ordered to the area in
[407]
anticipation of the verdict yeah I mean
[409]
you have the media saying we're bracing
[412]
for riots but they're pretending to be
[413]
ignorant of the role in setting this all
[416]
up and they're telegraphing it as always
[418]
that somehow it is acceptable to re to
[421]
Riot or wage some kind of violence in
[423]
the streets because there is no justice
[425]
and you have to take a time machine and
[428]
go back and remind people about Jacob
[430]
Blake right a knife-wielding brute who
[433]
attempted to kidnap an accent or kids
[436]
she called the police and the police
[437]
came and did their job they shot him
[439]
that was their job he had a knife yet
[441]
the media in collusion with the activist
[443]
class you know greenlit the violence
[445]
like you said in the riots and um that
[447]
later exposed this void where there was
[449]
no law enforcement when that happens you
[452]
end up with citizens in in the Second
[454]
Amendment coming together to fill that
[455]
vote void but it goes back to we've been
[458]
covering this stuff for like almost
[459]
seven to eight years there's a bigger
[462]
problem these are parts of the problem
[463]
the bigger problem is the the refusal to
[466]
look at the handful of deadly outcomes
[469]
between police and suspects as
[471]
individual cases right we can count them
[473]
it's really easy there's maybe 20 to 30
[476]
a year any journalist could spend an
[479]
hour a day and figure out how each one
[481]
is different if you actually looked at
[483]
these 25 or 30 cases more than half are
[486]
white if you did that you wouldn't be
[488]
able to have riots because you'd see
[490]
that each one is different for example
[492]
if you looked at Jacob Blake
[494]
individually you never would have had
[496]
these riots you would have seen he was a
[498]
knife-wielding feed but what you have
[501]
now and what we've we've Fallen prey to
[503]
is everything is grouped under one
[505]
heading all these cases fall under
[507]
systemic racism created by police
[509]
brutality in a system that doesn't allow
[511]
for justice for blacks creates this
[514]
whole this this Narrative of
[516]
hopelessness and rage there's no justice
[518]
no equality no opportunity and that
[520]
replaces achievement with angst and
[522]
which and what it really is is if you
[524]
just took the damn time and looked at
[526]
each case you would see that all of this
[530]
pain and suffering is unnecessary if you
[533]
could pull up call for number one for us
[535]
this is the prosecutor Binger on
[539]
self-defense we mentioned this briefly
[540]
but I think it's worth playing this
[541]
again listen to that they have to
[543]
convince you that Joseph Rosenbaum was
[546]
going to take that gun and use it on the
[548]
defendant because they know oh
[550]
you can't claim self-defense
[554]
against an unarmed man like this
[557]
you lose the right to self-defense when
[560]
you're the one who brought the gun when
[562]
you're the one creating the damn danger
[564]
when you're the one provoking other
[565]
people Jessica we haven't had your
[567]
thoughts yet but I thought you know that
[568]
was something that a lot of people are
[569]
like wait what how could that be yeah
[572]
blue check mark Twitter was even like I
[575]
mean I joked with them in the break like
[576]
even I know that's not right and I'm no
[579]
gun expert uh I think the prosecution
[582]
has not done a great job and putting
[584]
aside even inconsistencies in the story
[586]
as we've gone from November 2nd up until
[588]
today they're just been have a few
[591]
comments that have come out that have
[592]
raised eyebrows like do you know this
[594]
case well enough do you know the laws in
[596]
Wisconsin well enough because there's
[597]
obviously a very specific set of laws
[600]
especially governing self-defense and
[603]
guns that this prosecutor seems to not
[605]
be aware of and when the judge dropped
[609]
the gun charge earlier this morning I
[611]
was like okay this is done right because
[612]
everybody had kind of assumed this was
[614]
the only thing that he was possibly
[615]
going to be held on the possession of a
[617]
dangerous firearm and we were talking
[620]
also about whether we think there will
[622]
be these riots tonight and how hopeful
[624]
we were that it wouldn't or tomorrow
[626]
night whenever the verdict may come back
[627]
if it is that he's acquitted that maybe
[629]
we can move past this and to Greg's
[632]
point about people not knowing the
[634]
details of things where you go for your
[636]
Source material matters so much because
[639]
there are a lot of people it's not your
[642]
fault necessarily that you didn't know
[643]
that the two people who passed away in
[646]
this were not black it was not
[647]
advertised for a very long time that the
[650]
victims were white or I should say three
[652]
victims two dead one injured and to your
[655]
point about you know are you on the side
[657]
of a convicted pedophile
[660]
to me that doesn't matter I understand
[662]
in the grand scheme of things that is
[664]
someone who I don't want to know versus
[665]
I would like to know you and you know
[667]
continue to be friends those things
[669]
aren't comparable but it doesn't mean a
[671]
death sentence for someone because they
[673]
did something and I think we need to
[675]
move away from that because this idea of
[677]
vigilantism is so dangerous and is being
[679]
used in so many different ways you know
[682]
the justice system as Jesse said it
[684]
plays out and it does its job and
[686]
Rosenbaum had whatever is coming to him
[688]
he's been convicted of it already let
[690]
that happen but no one deserves to die
[692]
in that particular instance because of
[695]
something that happened before and I
[697]
just but it goes to his character and
[699]
the idea that he was more than willing
[701]
to be there he was rioting he attacked
[703]
Kyle Rittenhouse and said he was going
[705]
to kill him he had dangerous weapons
[706]
like chains previously in the night so
[708]
you know Character Matters and your your
[712]
history matters and we've tried this
[714]
case in the court of public opinion and
[716]
I think it's really important that
[718]
people understand who these people are
[719]
in terms of their care character
[720]
especially since people like the
[722]
president of the United States smeared
[724]
Kyle Rittenhouse as a white supremacist
[726]
who was just a vigilante in this
[728]
community when really he was there
[730]
trying to give medically a cleaning up
[732]
his community taking you know he was
[733]
asked to be there to protect people's
[736]
property and to protect people's lives
[738]
quite frankly and so if we're going to
[740]
try Kyle in the court of public opinion
[742]
I think it's more than fair to try the
[744]
people who attacked him violently in the
[747]
street and to talk about their criminal
[748]
records as well which includes raping
[751]
small children but you do obviously it's
[753]
terrible and I don't want to be the girl
[754]
that's just defending a pedophile on
[756]
National Television but you do no Jesse
[758]
but you do get into conversations then
[761]
with how many people came out talking
[762]
about George Floyd like what drugs he
[764]
was on how many priorities would you
[766]
have to talk about that if people hadn't
[767]
convicted Kyle Rittenhouse or even at
[769]
the beginning of this case if there had
[770]
been accurate and Folsom reporting about
[773]
Jacob Blake in the Press that's in the
[775]
first place I I I want to have you call
[777]
up number seven but before that Jesse
[779]
did you want to come comment on the
[780]
self-defense well it goes to if someone
[784]
is a suicidal bipolar Maniac off his
[788]
meds yelling the n-word and I'm gonna F
[791]
you up lunging at a weapon and chasing
[794]
this guy
[795]
that package has to be
[798]
demonstrated to the jury and it was
[802]
you would want your defense counsel to
[804]
make that exact argument so last week
[806]
when the trial was underway Kyle
[808]
Rittenhouse did break down on the stand
[809]
here is what the prosecutor said about
[812]
that this is as a jury is about to go to
[814]
deliberate one of the first things that
[816]
they saw was on that first day Kyle
[819]
Rittenhouse and his emotion this is how
[821]
the prosecutor described it
[823]
even on the witness stand when he
[825]
testified on Wednesday
[828]
he broke down crying about himself
[830]
not about anybody that he hurt that
[832]
night
[834]
No Remorse no concern for anyone else
[839]
I don't know what the jury's going to
[840]
decide Greg but I have to imagine that
[841]
like the prosecutor doesn't know that
[843]
yeah this guy is in way over his head he
[846]
he reminds me of me when I'm not
[849]
prepared for this show so it's like you
[851]
just say things and it's just like you
[854]
know if he you know what he's trying so
[857]
hard not to do his job it would have
[859]
just been easier if he tried to do his
[861]
job but everything that he's been doing
[863]
so far has been so Off the Mark it's
[865]
clear that he just like he's a terrible
[868]
student he's like somebody who slept in
[869]
missed his classes and just said maybe I
[871]
could Wing this because this is awesome
[873]
some people think he was actually
[874]
angling for a mistrial because of the
[877]
way he acted earlier last week and when
[880]
he hold it held the gun the AR yes I
[883]
mean obviously it's not loaded but I
[884]
mean after Alec Baldwin do you know for
[886]
sure so and he pointed it at the jury
[888]
and his finger was on the trigger like
[892]
on the trigger now the jury's already
[895]
probably getting death threats getting
[897]
photographs taken of them going into the
[900]
courtroom maybe somewhere else and you
[902]
think you want the prosecutor
[904]
pointing a weapon at you after the the
[907]
deadly accident at rust look at that
[910]
look at that right there he's pointing
[911]
that at the jury and this guy is the
[914]
state's lead prosecutor which is crazy
[916]
and then he puts out this video which
[919]
they worked days on to show that Kyle at
[922]
one point had raised his weapon
[924]
never raised his weapon he'd never
[927]
raised his weapon and they made this
[929]
huge showing of oh he raised his weapon
[931]
it just wasn't true yeah my favorite
[933]
part was when he today tried to compare
[935]
this to a bar fight and then he turns to
[937]
the jury and goes you've all probably
[939]
been in a bar fight before yeah let's
[941]
play that actually call for number three
[945]
let's assume for a minute yeah Joseph
[948]
Rosenbaum is chasing after the defendant
[951]
because he wants to do some physical
[953]
harm to him he's an unarmed man this is
[956]
a bar fight this is a fist fight this is
[958]
a fight that maybe many of you have been
[960]
involved in two people hand to hand were
[963]
throwing punches we're pushing we're
[965]
shoving or whatever
[967]
but what you don't do is you don't bring
[969]
a gun to a fist fight Katie
[973]
all right so uh the idea that he turned
[975]
to the jury and essentially said you're
[977]
just like the people that we're talking
[978]
about in this trial it's probably pretty
[980]
insulting to them the other thing is he
[982]
says he was an unarmed man well if we're
[985]
taking this case and looking at the
[986]
evidence according to FBI statistics
[988]
more people are killed each years with
[990]
hands with fists than people are killed
[992]
with error 15s this idea that you could
[995]
be an unarmed person and not be
[996]
dangerous and also if you have a
[998]
skateboard and you're threatened to hurt
[1000]
someone with it you can kill somebody
[1001]
with a skateboards this idea that
[1003]
someone was unarmed and therefore they
[1005]
weren't a threat was completely
[1006]
destroyed by all of the evidence that
[1008]
people saw throughout the trial you want
[1010]
to comment because you hadn't seen that
[1011]
they actually put up that photograph
[1013]
yeah I couldn't believe that was real it
[1015]
was just a Roadhouse I mean That's a
[1017]
classic maybe not the best prosecutor
[1019]
maybe one element initially he wanted to
[1021]
go with Dirty Dancing Yeah I mean adding
[1023]
movie clips can sometimes be helpful
[1024]
yeah
[1025]
[Laughter]
[1029]
um I also wanted to play if you would
[1030]
call for number five
[1032]
um because does the prosecutor have a
[1034]
point here watch
[1036]
the same set of rules apply to the
[1039]
defendant is everybody else
[1040]
there's no exception in the law for Kyle
[1042]
Rittenhouse
[1044]
there's no exception that says if anyone
[1046]
else has a gun you're a danger except
[1047]
for Kyle Rittenhouse
[1049]
there's no exception in the law that
[1050]
