i was an adjuster for 20 plus years the art of聽

claims handling process today we'll be talking聽聽

about why defense counsel and insurers will need聽
an expert witness for claims handling in today's聽聽
[33]
day and age everyone really wants to save money聽
and that means pinching pennies so to keep costs聽聽
[40]
down defense counsel and insurers want to save on聽
loss adjustment expenses (LAE) and they usually聽聽

don't want to retain a claims handling expert on聽
a bad faith claim the thought is that a adjuster聽聽

or the claims manager can serve as the good faith聽
claims handling witness and that's absolutely true聽聽

but the issue is that sometimes they are聽
too close to to the problem to see what聽聽

may come out and bite them you've probably聽
heard the phrase i didn't see the trees聽聽

because of the forest and that's what could happen聽
here the adjuster and the manager may be too close聽聽

to look at the file objectively and the defense聽
attorney while he's very skilled in insurance law聽聽

may not catch a clue that the plaintiff's claim聽
attorney or the plaintiff's claim handler expert聽聽

would catch for example i handled a case where the聽
claimant was an automobile case where the claimant聽聽

was med-flighted to the hospital and the聽
doctors and staff worked on the claimant for聽聽

quite a long time and there was one line one note聽
by the doctor about one or two o'clock the very聽聽

next morning that said that he called the chaplain聽
for the claimant and this indicates to me that聽聽

the claimant was very near death and that the聽
doctor did not believe that the claimant would聽聽

be making it to the morning and and so i pointed聽
that out to defense counsel and said hey you know聽聽

i know you don't think there was a lot of of pain聽
and suffering in this since the claim it came out聽聽

okay and in the very end the claim it did survive聽
but when everything is said and done i mean聽聽
[162]
there is some pain and suffering if the doctor聽
didn't even think the claimant was going to be聽聽
[166]
making it and so the defense counsel was聽
able to go back to her client the insurer聽聽

and say look guys we need to go ahead and聽
settle soon now and so i was able to actually聽聽
[179]
help save the insurer more LAE rather than having聽
them take it to court and possibly receiving a聽聽

plaintiff verdict and then an excess verdict on聽
top of that so this week we've discussed why you聽聽
[197]
need an expert for claims handling procedures and聽
standards insurers want to save on lae but this聽聽
[203]
might not necessarily be a good area to skimp聽
on of course every claim is different and every聽聽
[210]
insurer has different protocols for handling聽
losses however this being in the litigated聽聽

world that we're in see below for some legalese聽
very few claims go to jury trial and picking an聽聽

expert who's been deposed the most or who has gone聽
to trial the most may not be the correct expert聽聽

failing to have a second set of eyes on the claim聽
in order to save on expenses isn't always the best聽聽

way to resolve a loss as an expert witness聽
