What is a Marital Trust Agreement in Estate聽
Planning? So in this video you're going to learn:聽聽

What a Marital Trust Agreement is, the purpose it聽
serves and why someone would put a Marital Trust聽聽
[20]
in place. First quick intro of myself Bill O'Leary聽
here I'm an attorney here in Jacksonville Florida,聽聽

So what is a Marital Trust agreement? Well as is聽聽
[41]
obvious from the name it's a Trust that's put聽
together by folks who were married, that's why聽聽
[47]
it's called a Marital Trust and as you might聽
imagine it's very common for a married couple;聽聽
[53]
let's say to want everything to go to the聽
surviving spouse at the first spouse's death聽聽
[57]
fair enough so far so good and many couples聽
frankly are just fine with everything going聽聽
[63]
to the surviving spouse directly and outright聽
this is the easiest way to do it for sure.聽聽

This means though that the surviving spouse has聽
complete control over all of the assets he or聽聽
[75]
she can do anything that they want with the money.聽
Well this works just fine when the couple is, is聽聽
[82]
okay with the surviving spouse having unrestricted聽
access to the money after the first spouse dies聽聽
[88]
but what would happen to the money if the聽
surviving spouse is let's say not good with money,聽聽
[95]
what if they're not the most astute in financial聽
matters, what if giving everything out right to聽聽
[100]
the surviving spouse would run the risk that聽
everything would be spent in short order,聽聽
[106]
is there a way to prevent this from happening,聽
yes there is. Instead of giving everything to聽聽
[112]
the surviving spouse directly just as an outright聽
distribution, the married couple they can create聽聽
[118]
a set of think of them as guard rails to聽
protect the money you know think of it as聽聽
[124]
maybe creating a lock box for the surviving聽
spouse. The lock box would hold the money,聽聽
[130]
the money in the lock box would be there to take聽
care of the surviving spouse but the spouse would聽聽
[134]
not have unfettered access to the money. This lock聽
box it's called a Trust and it's given a special聽聽
[142]
name called a Marital Trust and Marital Trust is聽
an Irrevocable Trust that is designed to benefit聽聽
[149]
the surviving spouse by the way the surviving聽
spouse can be the trustee or you can make someone聽聽
[154]
else the trustee or maybe you make a combination聽
of both as co-trustees and then when the surviving聽聽
[161]
spouse dies, what is left in the Trust will聽
go to other beneficiaries usually children.聽聽

There are some other reasons for implementing a聽
Marital Trust besides simply where the surviving聽聽
[174]
spouse is not good with money. For example聽
a Marital Trust can be used to prevent undue聽聽
[179]
influence this usually is a concern let's say for聽
older couples where maybe the surviving spouse may聽聽
[185]
be in declining health and there's a concern they聽
may be susceptible to being taken advantage of.聽聽

Another situation where Marital Trust is often聽
used is in a second marriage situation where聽聽
[197]
let's say one or both spouses have children from聽
a prior marriage, imagine the first spouse to die聽聽
[204]
has children from a previous marriage聽
and he or she wants to make sure that聽聽
[207]
their kids get an inheritance at some point in the聽
future, say after the surviving spouse dies right聽聽
[214]
so giving everything out right to the surviving聽
spouse well that would run the risk that their聽聽
[221]
kids the first spouse to die their kids get cut聽
out because the surviving spouse ends up changing聽聽
[227]
the plan after the first death. Having a Marital聽
Trust on the other hand for the surviving spouse聽聽
[233]
ensures this can't happen. So a Marital Trust, yes聽
it will be there to benefit the surviving spouse聽聽
[240]
they won't be wanting for their needs be there for聽
their lifetime but what is left in the Trust will聽聽
[246]
go back to the children from the prior marriage聽
and a Marital Trust can also be used as part of聽聽
[251]
a Estate Tax Planning, let's say where the married聽
couple has a large enough Estate where they need聽聽
[259]
to minimize taxes so here Marital Trust is often聽
used with another type of Irrevocable Trust called聽聽
[265]
a Bypass Trust, this more complicated form of聽
Estate Planning is typically what we call an AB聽聽
