Channel: Fox News
[0]
well members of the migrant caravan are
[2]
not american they're not even in the
[3]
united states yet according to the left
[5]
that makes no difference to the left
[6]
there are two groups of people in the
[7]
world
[8]
current american citizens and american
[9]
citizens who simply haven't shown up yet
[12]
if you don't want them here immediately
[14]
then you are
[15]
a monster watch the president united
[18]
states has decided
[19]
that a couple thousand scared sick you
[21]
know people fleeing violence are a
[23]
bigger threat to the united states
[25]
than isis i spent two days with a
[27]
caravan and i didn't see criminals or
[29]
rapists or
[30]
terrorists donald trump feeds off of
[33]
this kind of ugliness
[34]
and cruelty and his supporters back him
[37]
on it because they didn't get the wall
[39]
but now they might be able to stop a an
[41]
imaginary caravan
[45]
people have gotten so much dumber in the
[46]
last two years it's unbelievable
[48]
and it shouldn't surprise us that in the
[50]
face of programming like that
[52]
a dozen honduran migrants have sued the
[54]
administration for supposedly
[56]
violating their constitutional rights
[57]
even though once again they have not yet
[59]
reached the border yet
[60]
and they are of course not american
[61]
citizens mike donovan is ceo of nexus
[63]
services which is financing that lawsuit
[65]
he joins us tonight mike thanks a lot
[66]
for coming on
[67]
and for example thanks for having me of
[69]
course a sincere question and i i really
[71]
am glad that you're here
[73]
because it's hard to see what the
[74]
standing is here these are people who
[76]
are not american citizens they're not on
[77]
american soil
[79]
and some of them have declared intent to
[81]
violate american law
[83]
how are their constitutional rights the
[85]
constitution of a country
[87]
they're not part of how are those rights
[88]
being violated exactly
[91]
well so of the of the name plaintiffs in
[94]
this lawsuit
[94]
each of them and each of the individuals
[97]
in the in the purported class
[98]
are individuals who want to seek asylum
[100]
and do so legally so i think that's an
[102]
important part
[103]
of this conversation but tucker it's
[105]
it's a good question
[106]
the asylum so we have an immigration law
[108]
it's a series of immigration laws and
[110]
one of those elements is asylum and and
[113]
those
[114]
laws uh are specific to the individuals
[117]
in this caravan who are coming to claim
[120]
asylum
[121]
that pro that in alone it may not be
[124]
enough but the
[125]
president of the united states has taken
[127]
to making this
[128]
caravan a symbol of an invasion of our
[132]
country
[133]
and he has taken a great deal of time to
[135]
defame the individuals who are
[137]
traveling fleeing bloodshed in their
[139]
home countries
[140]
trying to find a place where they can
[142]
live and and and
[143]
support their families okay i guess what
[146]
does that have to and i understand you
[147]
don't like that and you're on their side
[149]
you don't like trump
[150]
fine but what does that how does that
[152]
mean that they have a constitutional
[154]
right that is being violated what is
[155]
that right where in the constitution
[156]
does it reside
[157]
as just a normal american i'm confused
[159]
can you help me
[161]
yeah absolutely it's a right to due
[163]
process these individuals are coming to
[165]
the country
[166]
um they have in one way or another
[168]
stated their intent to come to the
[169]
country
[170]
and the chief executive of this country
[171]
has taken aim and attacked them so
[174]
what i'm saying is that their standing
[175]
is very simple they're asylum seekers
[178]
they want clarification i think that we
[180]
should respect these uh
[182]
migrants maybe we should wait
[185]
there's a legal question so i get it we
[187]
should respect them you you're on the
[188]
side of the migrants that's
[189]
that's that's your right i just want to
[192]
know
[192]
where my responsibility begins as as an
[196]
american citizen
[196]
you're saying they have a constitutional
[198]
right to due process but they're not
[200]
americans
[200]
and they're not on u.s soil they're
[202]
hundreds of miles from the united states
[204]
they're not here so in what sense are
[206]
they covered by our due process protect
[208]
like this is insane and you know what's
[209]
insane i just want you to admit that
[211]
it's
[211]
no it's no it's not insane tucker they
[214]
are
[214]
claiming rights under the asylum
[217]
provisions
[218]
of our statutes that affords them due
[220]
process rights under that law we have
[222]
due process under the law this is a law
[225]
that is specifically directed to them so
[227]
of course they have due process right
[228]
now
[229]
let me just correct you as a non-lawyer
[232]
they do not possess those rights if
[233]
they're in another
[234]
country and not u.s citizens so if they
[236]
possess those rights
[238]
then i don't know the entire country of
[240]
nigeria or any pick a country that's
[242]
poor the united states can say we want
[244]
to come there president says you can't
[245]
come
[246]
and all of a sudden 800 million people
[248]
sue you for violating their
[249]
constitutional rights in the country
[250]
they've never been to
[251]
without with all due respect tucker you
[253]
know that that's not exactly that's not
[255]
what we're talking about here we're
[256]
talking about individual
[257]
migrants who are coming together who are
[259]
on their way to the border to exercise
[261]
their rights under
[262]
u.s law nobody i'm process right now but
[264]
it's not it's not difficult
[266]
because it's a few it is what's the
[268]
principle in what sense is it different
[269]
what's the principle
[270]
if you're a foreigner residing in a
[272]
foreign country
[274]
okay well i don't know if they're in
[276]
routers the entire nation of
[277]
if the if the entire nation of nigeria
[279]
were in route to the united states
[281]
perhaps it would be apples to apples but
[283]
that's what you said it's not correct
[284]
these are
[285]
individuals coming to this country to
[287]
seek asylum okay
[289]
first of all you don't know that we
[290]
don't know what their intent is they're
[292]
sure
[293]
actually you don't they're hundreds of
[294]
miles away and asylum claims
[297]
have to be made on u.s soil either in an
[300]
embassy a consulate or at a border
[301]
okay that's the loss because someone who
[303]
purportedly defends the law you know
[305]
that i know
[306]
so you can't actually claim that you're
[309]
covered by the us constitution again if
[311]
you're not on u.s soil and you're not a
[312]
u.s citizen
[313]
because if you could unfortunately no
[317]
argument but tucker it's not an argument
[319]
the courts don't
[320]
the courts don't agree with you there's
[322]
a court case in the d.c
[323]
circuit that is in the matter of ari
[326]
r.l johnson where judge bosberg said
[330]
that the administration can't use
[332]
deterrence to curb asylum seekers who
[334]
are coming to this country
[335]
i'm afraid that this is an area of law
[337]
that's already been litigated
[339]
i'm not concerned but you're in you are
[342]
incorrect
[342]
you are no you're factually incorrect no
[344]
the united states the united states
[345]
supreme court has never said
[347]
that due process protection applies to
[350]
non-citizens on foreign soil that has
[352]
never happened
[354]
that the the district of columbia
[356]
federal courts have and that's where
[357]
this shows
[358]
so are you one day we'll get to the
[360]
supreme court i think this is important
[361]
but
[362]
here's what's important hold on here's
[364]
what's important is that the rest of us
[365]
know what the president is
[366]
and so is by this standard anyone in any
[369]
country who says he's on his way to the
[371]
united states and is walking in our
[373]
direction
[374]
can sue the united states for saying we
[376]
don't want you
[377]
you really want to set that president or
[378]
you
[381]
do i want to set the precedent tucker if
[383]
the president of the united states
[385]
engages in abusive violent rhetoric
[388]
toward a group of people
[398]
this president is behaving badly and you
[400]
know you don't like the president you
[401]
should condemn it too don't
[403]
it's not a matter now you're moralized
[405]
like every one of these people
[406]
i don't
[415]
do i think it's okay i want to talk
[416]
about adult things like what does the
[418]
constitution
[419]
guarantee foreigners is it okay that
[422]
he's mean
[423]
okay thank you
