hey everyone it's drew from champlain
[2]
valley law
[3]
in today's video we'll answer the
[5]
question
[6]
what are policy limits
[19]
any lawyer will tell you that in order
[22]
to have a successful personal injury
[24]
claim
[25]
you have to have three things number one
[28]
an at-fault driver or business number
[32]
two
[33]
damages in the form of measurable harms
[36]
and losses
[36]
suffered by the injured person and
[39]
finally number three
[41]
money to make up for those losses this
[44]
video
[44]
is about the last point money to make up
[47]
for the losses
[49]
you may be wondering how much money will
[52]
the at fault driver's insurance pay
[54]
to cover my injuries now this is a topic
[58]
that can get complicated quickly because
[60]
there are
[61]
lots of different kinds of insurance
[63]
that might come into play
[65]
but let's start with the basics when
[67]
somebody buys car insurance
[70]
it always comes with coverage for harm
[73]
done
[73]
because of negligence we call that
[76]
bodily injury
[77]
or liability coverage the policy limit
[81]
is the dollar amount that represents the
[84]
maximum amount of money
[86]
the insurance company will pay for harm
[88]
done
[89]
to the injured person by the at fault
[92]
driver
[93]
for example let's say you're injured in
[95]
a car crash
[97]
and the at fault driver's insurance has
[99]
a limit
[100]
of fifty thousand dollars well then
[103]
fifty thousand dollars
[105]
is going to be the most money the
[107]
insurance company will pay
[109]
for the harms and losses done to you
[111]
this is true
[113]
even if your medical care lost wages
[116]
and other harms and losses add up to
[118]
much more than the policy limit
[121]
and it's usually going to be true even
[123]
if a jury values your case
[125]
at more than the policy limit every
[128]
insurance policy
[130]
has a collection of coverages and each
[133]
one
[133]
will have its own limit so you're likely
[136]
to see more than one limit
[137]
in the same policy for example a common
[141]
auto insurance policy
[143]
might include coverages for liability or
[145]
bodily injury
[147]
collision coverage or medical payments
[149]
coverage
[151]
and each of these will have their own
[153]
separate limit
[154]
and while each of these is important our
[157]
focus is going to be
[159]
on the liability or bodily injury
[161]
coverage
[162]
because this is the money that pays you
[165]
for
[165]
all of the harms and losses that you've
[167]
suffered that includes lost wages
[170]
medical bills pain suffering and
[173]
all the other harms and losses that you
[176]
suffer as a result of a crash
[178]
every state has a minimum amount of
[181]
insurance coverage
[182]
that a driver must have but this is just
[185]
the starting point
[187]
anybody can purchase more coverage
[190]
it's not uncommon to see liability
[193]
limits
[194]
of a hundred thousand two hundred and
[196]
fifty
[197]
or even more in some cases in vermont
[200]
and new york
[201]
the minimum amount of liability coverage
[204]
is 25 000
[206]
per person with some important
[208]
exceptions we'll talk about in a second
[210]
here's where it gets a little tricky the
[213]
way the law
[214]
is actually written in new york and in
[216]
vermont
[217]
is that it requires 25 000 per person
[221]
and 50 000 per accident in coverage
[224]
and that's the minimum when lawyers or
[228]
insurance adjusters talk about this
[230]
we sometimes refer to it as a 2550
[233]
policy situation what this means
[237]
is that with the minimum coverage if
[239]
there are two people
[241]
injured by negligence in the same
[243]
collision
[244]
each of them can collect up to twenty
[247]
five thousand dollars
[248]
for a total of fifty thousand in the
[251]
same accident
[252]
now there are some policies that are
[255]
written as what we call
[256]
single limit policies meaning that
[259]
there's only one dollar amount
[261]
say 300 000 that's meant to cover
[264]
everybody injured due to negligence in
[267]
the same crash
[269]
with single limit coverage if there are
[271]
several people
[272]
who get hurt in the same crash they may
[275]
wind up fighting each other
[277]
for a slice of the same pie depending on
[280]
how bad their injuries are
[281]
in the case of a 2550 policy though
[285]
two people injured in the same crash
[287]
will never have to fight each other
[289]
because they each have their own
[290]
separate limit but a
[292]
third or fourth injured person from the
[295]
same crash
[296]
may wind up taking dollars from one of
[299]
the first two
[300]
and there's no priority it doesn't
[303]
matter who filed the claim first
[306]
which brings us to our final point what
[309]
do you do
[310]
if your injuries are so severe that
[312]
twenty five
[313]
fifty or even a hundred thousand dollars
[316]
isn't enough
[318]
to cover all of your losses in many
[320]
cases
[321]
the answer is that there's nothing you
[323]
can do about it
[325]
and that's the cold hard truth most
[327]
people
[328]
simply don't have the money or assets
[331]
to pay for the harm that they cause a
[334]
good lawyer
[335]
will spend time and energy tracking down
[338]
other at fault parties and tracing
[341]
insurance coverage that might apply
[344]
and you yourself may have underinsured
[347]
motorist coverage
[348]
that applies to this crash these are
[351]
topics
[352]
that are beyond the scope of today's
[354]
conversation
[355]
but we will talk about them separately
[357]
in an upcoming video
[360]
for now your takeaways from today's
[362]
video are these
[364]
number one in new york and in vermont
[368]
every driver must carry a minimum amount
[372]
of liability coverage that's 25 000 per
[375]
person
[376]
up to 50 000 per collision for harms
[380]
caused due to that driver's negligence
[384]
number two if there are more than two
[386]
people
[387]
injured in the same crash there's a good
[390]
chance
[390]
that some of those people may wind up
[392]
fighting each other
[394]
for the limited insurance dollars
[395]
available
[397]
and finally number three if the value of
[400]
your damages
[401]
exceeds the policy limit of the at fault
[404]
drivers insurance
[405]
you're going to have to look elsewhere
[407]
for money and you may not find it
[410]
that's it for today's video i hope you
