WOW! Poppy Sued For Copyright Infringement, Kevin Hart Extortion Revelation, AZ Teachers, and More - YouTube
Channel: Philip DeFranco
[0]
S'up, you beautiful bastards?
[1]
Hope you had a fantastic Friday.
[3]
Welcome back to the Philip DeFranco show!
[5]
If you are new here - on Fridays, we do things a little bit different.
[7]
On Friday, I try to include more viewer requested stories.
[10]
Also, include stories we wanted to include earlier this week but they had to be cut for time,
[14]
or we didn't have enough time to shoot because we wanted to be on time.
[17]
With that said, let's just jump into it!
[18]
And the first thing we're gonna talk about today was one of the most requested stories,
[22]
and that was to look into the Poppy lawsuit.
[24]
Poppy, real name: Moriah Pereira,
[26]
and her creative partner, Titanic Sinclair, are being sued by a woman
[29]
by the name of Brittany Sheets.
[30]
And to fully explained this story, you need to have some background.
[32]
We'll start with Mars Argo which was a music group that was active between 2009, and 2015.
[37]
It was made up of Brittany Sheets, who was the main face of Mars Argo,
[40]
and Corey Mixter AKA Titanic Sinclair.
[42]
And, in addition to making up this group together, they were reportedly dating from 2008 to January 2014.
[47]
They had a show called 'Computer Show', where they produced funky shorts.
[50]
The channel 'grocerybagdottv' had about 92 videos on it. Although, now, most of them are deleted.
[54]
And they apparently had an awful relationship, both when they were dating and afterwards.
[59]
In the lawsuit, she details a ton of examples where she says that he was abusive in the relationship, and then after.
[63]
Saying he broke into her apartment multiple times - doing things like
[66]
getting on her laptop; messing with her Facebook;
[68]
shattering wine glasses on the ground.
[70]
They reportedly break up in January of 2014
[72]
but at that time, Mars Argo had a cult following. It had decent success.
[75]
So, Sheets and Mixter decide they're going to have a working relationship.
[78]
But then, after another incident with Mixter,
[80]
Sheets decides to put the band on an indefinite hiatus.
[82]
Although, she would later release a single in 2015
[85]
- one that they worked on before they had the hiatus.
[87]
So, this is where Poppy comes in.
[88]
The lawsuit alleges that Mixter met Poppy in mid-2014
[90]
shortly after the breakup of Mars Argo.
[92]
The lawsuit also makes note that, at the time, Poppy
[94]
- who wasn't Poppy yet -
[95]
was clearly a natural brunette but quickly
[97]
changed her hair to platinum blonde, which was similar to Sheets's.
[99]
And in November 2014, Poppy releases her first video titled 'Poppy Eats Cotton Candy'.
[104]
And here, Sheets notices the similarity of the look of Poppy,
[106]
as well as the style of the video to Mars Argo.
[108]
And since then, Poppy and Mixter have released over 250 videos, multiple albums.
[112]
And that has led us to this moment, where Sheets finally decided to file a lawsuit against the two
[116]
claiming that they stole her persona, and ideas, for Poppy
[118]
- some ideas that allegedly only Sheets and Mixter had knowledge of.
[121]
And the lawsuit that was filed in California Court has four major complaints against Mixter and Poppy.
[125]
1. Common law right of publicity,
[127]
2. Violation of California's unfair business law,
[130]
3. Damages for domestic violence and a restraining order, and
[133]
4. Copyright infringement.
[134]
And that appears to be the bulk of the lawsuit,
[135]
Which is also seeking damages from Mixter and Poppy.
[138]
The lawsuits stating:
[162]
And according to the lawsuit, some specific similarities between Poppy and Sheets include:
[165]
dyeing poppy's hair to a specific platinum blonde color because she was brunette before;
[168]
Poppy altering her voice pitch to a specific high range
[171]
- and there are examples you can find online of her speaking differently before the Poppy character;
[174]
and using similar backgrounds and videos. And, there are numerous examples provided.
[178]
In one case, a lawsuit alleges that Poppy wore one of Sheets's own coats.
[181]
Another showing that Poppy uploaded a video of the same name as one of the 'grocerybagdottv' videos.
[185]
Although the content inside of those videos are different on Poppy's video
[188]
- it's just her saying ["delete your facebook"] over and over.
[190]
In the Mars Argo video - there's kind of more of a back-and-forth.
[193]
Some of the other similarities that were listed:
[195]
performance outfits being the same;
[196]
a video which had Poppy with blood coming out of her mouth that looks similar.
[200]
And in fact, there are a lot of these side-by-side comparisons made.
[202]
And there are many more similarities that are listed in the 'suit
[205]
but I'll link down to a video that that compares and contrasts.
[208]
It'll give you an even better idea of what the full argument is.
[210]
We also saw Sheet's lawyers spoke with TMZ and they said:
[220]
It also appears that Sheets went to the Mars Argo Twitter in mid-April to post her feelings on the 'suit.
[224]
So, that's the lawsuit as we know about it right now.
[226]
It will be very interesting to see what happens with it.
[228]
And something people have been pointing out that's kind of interesting/potentially sketchy
[232]
is Sinclair and Poppy's Twitter account.
[234]
I was trying to find out if Poppy or Sinclair had posted anything about Mars Argo, and any of the accussations.
[240]
When I was looking into it - according to socialblade.com - Poppy deleted around 2000 tweets around the 26th-27th.
[247]
According to the site, around that time, Titanic Sinclair deleted around 170.
[250]
So, the question becomes - why did they do this?
[252]
What were in those specific tweets?
[253]
With Poppy, it was essentially scorched earth.
[255]
They're only three listed tweets now from before April 30th of this year.
[258]
With Sinclair, it seems more targeted,
[260]
and it doesn't seem like he was trying to remove things where he's 'being problematic'.
[264]
He still has tweets like this one, where he quote-tweeted @NME - who wrote:
[267]
'Halsey reveals she tried to kill herself after being diagnosed with bipolar disorder at 17',
[271]
to which he wrote, "Wow, she even sucks at that".
[273]
I mean, he even left this tweet up of him criticizing [Grimes] in the past
[277]
that he and poppy appear to be working with now.
[279]
So, if he's not deleting that, what was he deleting?
[281]
And Grimes, by the way, is the reason that this story has popped back up.
[283]
The lawsuit initially came out mid-April but this story got sparked up again
[287]
because Poppy and Grimes posted a picture together - that picture teasing an upcoming collab.
[291]
Many fans linking to the lawsuit - the allegations of both copying, as well as abuse.
[295]
Also, a note I want to hit on: obviously, whenever you're dealing with a lawsuit, any story,
[298]
both sides need to be able to get their story out.
[300]
I reached out to Mixture to see if he had a general statement.
[302]
Also, asking him about the tweets.
[304]
As far as statement, he says he cannot comment now but there is an official statement coming.
[307]
As far as the tweets, he said Poppy's were cleared for promotional reasons.
[311]
As far as his tweets, he said 'I haven't deleted anything from my account'.
[313]
Regarding these two things -
[314]
1. I've reached out to socialblade.com to see if there is a possibility
[318]
that the deleted tweets listed here could have been a bug.
[320]
I'll be sure to include their response along with the follow-up, once an official statement is released.
[325]
That said, I do want to pass a question off to you.
[326]
What is your takeaway from this?
[328]
Seeing those comparisons, does it make you think that Poppy is a copy?
[330]
What do you think about any of the other allegations?
[332]
I'd love to know your thoughts here.
[333]
Then, let's talk about Kevin Hart back in the news.
[336]
You may remember that Kevin Hart got caught cheating on his then-pregnant wife?
[338]
There was this whole sex tape scandal.
[340]
And then, more information about the situation came out and it turned out that the 'sex tape' -
[345]
neither Kevin Hart, nor the woman in it, reportedly knew they were being filmed.
[348]
It also came out whoever filmed this was trying to extort Kevin Hart; trying to get money.
[352]
We learned this week that the man who allegedly did this is Jonathan Todd Jackson.
[357]
He's facing two felony counts. One for attempted extortion, and the other extortion by threatening letter.
[361]
If convicted, Jackson faces up to four years.
[364]
One of the roughest things of all to come from this is, reportedly,
[367]
this guy was Kevin Hart's friend for around 15 years.
[370]
He's appeared in several films with Kevin Hart. He went to his bachelor party.
[373]
Around the time this news came out, Kevin Hart tweeted:
[380]
Now, obviously, there's an easy joke to be made about Kevin Hart's disbelief that his trust was betrayed
[384]
but it is also important point out that, there is a difference.
[387]
Kevin Hart broke someone's trust.
[389]
This other person allegedly broke the law
[391]
- and also, trust -
[392]
but the main thing is the law.
[394]
Then in apparently-I've-been-wrong-this-entire-time, news. Let's talk about IMHO.
[398]
You may have seen online this week, but there's been a debate over what those letters mean.
[402]
Some saying 'it's in my honest opinion'. Others saying 'in my humble opinion'.
[406]
I have been in the 'in my honest opinion' camp
[409]
But according to Merriam-Webster, the dictionary people, 'We're on Team Humble, TBH.'
[414]
And then linking to their site, where it says 'in my humble opinion'.
[417]
But to that say, "It's 2018! We're living in a post-facto, alternative fact world
[422]
"where you don't you don't admit faults, or that you're wrong.
[425]
"No! Why learn from your mistakes when you can just double down on what you feel is right."
[429]
And so, in conclusion - IMHO, you can go straight to hell.
[433]
Then, quickly, let's knock out an update about this dress.
[436]
We talked about it earlier this week.
[437]
There have been a lot of outrage. There was hate being sent her way.
[440]
That, of course, Keziah Daum. She, of course, stuck to her guns.
[442]
That it wasn't offensive - it was appreciation. She loved it.
[445]
I was personally on the side of 'I don't get the outrage'.
[447]
It looks like she just was appreciating a culture; thought it was beautiful.
[450]
One of the big updates coming from this story is apparently,
[452]
in China, there's just a lot of confusion as far as why people are angry about this.
[457]
China Daily reporting that, on Chinese social media, people were praising the outfit.
[461]
Users writing things like:
[474]
This made me wonder. Why did we see a completely different reaction in China than in the United States?
[478]
[United States], obviously, was diverse but there was a lot of outrage.
[480]
Well, according to Lee Bo Chen (who I'm probably mispronouncing your name, I apologize)
[484]
Lee is the director of the Beijing-based Chinese Culture Rejuvenation Research Institute.
[488]
Lee said that 'both the authorities and mainland people view the spread of Chinese culture positively'
[491]
- adding, "For example, Chinese people are elated when foreigners speak Mandarin".
[495]
Whereas in the United States - where there are a ton of different cultures; when you have a majority and minorities;
[499]
when someone from the majority adopts something from the minority - some will see that as exploitive
[504]
and, essentially, robbing a minority of their culture.
[507]
Because this person from the majority who has adopted from other cultures is seen as trendy; as an innovator.
[512]
And, once again, that's not an opinion I had. It's not a mindset that I subscribe to
[516]
but I was just interested to see why are we seeing that big difference.
[519]
And also, I want to say just from earlier this week, when I asked about stories like this,
[522]
I want to thank: 1. The people that just leave comments but [especially,]
[524]
2. The people to leave comments that are respectful but then, disagree.
[527]
It helps me understand where other people are coming from.
[529]
And in the-least-surprising-headline-of-the-day news: Man 'trying to take selfie' with bear is mauled to death.
[535]
Yeah, it's unfortunate but that should be the expected outcome from the beginning of that sentence.
[539]
Reportedly, it happened in India. A taxi driver was driving a group home. He had to stop to relieve himself.
[544]
And according to reports on his way back to the Jeep, he spotted a bear and decided to take a selfie with it.
[549]
And once again, it shouldn't be a surprise, this is a wild animal.
[551]
The bear grabbed him, and mauled him to death.
[553]
There's video of the attack - I'm not going to include that here.
[555]
Reportedly, members of the group that were there tried to throw rocks and sticks
[558]
at the bear to get the bear to stop.
[559]
And, that's it! That's the story.
[560]
I mean, what's the lesson here?
[562]
Don't be stupid, stupid?
[563]
I feel a little bit bad because it's another human being who lost their life
[567]
but it should be pretty common sense that when when you see a dangerous wild animal
[571]
that, if it just even wanted to, could murder the hell out of you.
[574]
When you see it, the first thing you should do is not
[576]
A) "Let's get a selfie!"
[578]
You do what every other normal person would do. You try and remember what you heard that one time about,
[583]
"Was it a black bear, or is it a brown bear?"
[585]
And with this specific one, "Are you supposed to make yourself big,
[587]
or are you supposed to go in the fetal position and act like you're dead?"
[589]
And you just hope you'll remember the right one.
[590]
You've only got this one life - do not be stupid with it!
[592]
And then, we have the Twitter news which you most likely know about
[595]
if you have logged onto Twitter in the past day.
[597]
But if you have not, Twitter is advising all 330 million Twitter users to change their password right now.
[602]
And of course, like in all situations around this, if the password you used on Twitter
[605]
is the password you used somewhere else, change that password as well.
[608]
The reason they're advising users to do this is - according to their official blog - is that:
[615]
And then, adding:
[624]
But then, adding:
[629]
Then, it goes into even more specifics about the bug.
[631]
I'll link to the official blog down below, if you want to read into it.
[634]
So, be safe out there!
[635]
And also, don't change your password to 'password' or 'password123'.
[638]
Sounds simple. Still, every single year, on the top 10 most used passwords.
[642]
Like no matter what, your information will be out there. Someone will get into your account.
[645]
But just don't make it that easy.
[646]
Then, let's talk about the situation [for teachers] in Arizona.
[649]
You might not have heard about it but Arizona public school teachers across the state staged a walkout.
[652]
And this was the protest low wages and lack of support for school funding.
[655]
The strike involved tens of thousands of teachers, and closures of hundreds of schools across the state.
[660]
The teachers initial demands included a 20% increase in pay, by next year;
[664]
yearly raises until their salaries reach the national average; competitive wages for school staffers;
[669]
a roughly 1 billion dollar annual increase in education spending which would match pre-Great Recession funding levels;
[674]
driving down class sizes to a ratio of 23 students to one teacher;
[678]
and a freeze on tax cuts until spending on each student reaches the national average.
[682]
And according to the National Center of Education Statistics, Arizona teachers make on average
[686]
$10,000 less than the national average.
[688]
But, even worse, according to 2016 data from Morrison Institute for Public Policy,
[691]
the median salary for Arizona elementary school teachers
[694]
- when adjusted for the cost of living - is dead last in the nation.
[697]
And if you're a high school teacher in Arizona?
[699]
Well, congratulations, you're not last! But you're 49th.
[702]
And keep in mind, while I'm talking about these latest walkouts,
[703]
that this situation actually started near beginning of March.
[706]
There's been a long road. Governor Doug Ducey of Arizona trying to come up with solutions.
[710]
Educators push back on initial plans, saying it did not do enough.
[713]
That then brought us to the latest walkout, which started last Thursday,
[716]
which then led to this last Tuesday, where Governor Ducey released a letter
[719]
detailing a proposed budget agreement that he said was very close to passing the state legislature.
[723]
This budget largely mirroring his original proposal that he announced mid-April
[726]
but it did also give individual school districts the power to divvy up the money how they want.
[730]
So, for example, a school district can decide to give bigger raises to lower-earning teachers,
[734]
and smaller raises to higher-earning teachers.
[735]
So, the educators looking for a '20% increase'? They're getting it.
[739]
But they're also maybe not getting it, depending on their existing pay
[742]
and depending on what each individual school district does. It's not across the board.
[746]
The budget also called for restoring 400 million dollars in school maintenance
[749]
funding that was cut during the Great Recession, within the first year.
[751]
It also restores another 100 million dollars in cuts next year, as part of a plan to
[755]
return school funding levels to pre-recession levels within five years.
[758]
This money will go to things like new textbooks, school buses, support staff salaries.
[762]
And in reaction to that, organizers with Arizona [Teachers] United announced that
[765]
- while the budget proposal does not go far enough -
[767]
if the Legislature passed the proposed budget, then they would end the walkout and return to class.
[771]
What ended up happening was, at the Arizona House, the Arizona Senate negotiated the bill; they passed it;
[776]
and, Thursday morning, governor Ducey signed the bill into law.
[779]
And the final number as we ended up seeing was 644 million dollars for schools to use
[783]
to increase teacher pay by 20% over the next three school years,
[786]
and it provides 371 million dollars - over five years - to restore Recession Era education cuts.
[790]
In response to this, as promised, Arizona teachers announced that they were ending the walkout.
[794]
That's where I'm going to end today's show!
