talk about in this video is subleasing

or sometimes called subletting and

assignment of leases now a couple of

things before we get going

remember all real estate contracts can

be assigned unless the contracts
[40]
strictly prohibits it so absent some
[43]
kind of prohibition every every real
[46]
estate contract including a lease
[48]
contract can be assigned so I'm going to
[52]
explain the differences between
[53]
assignment of a lease and subleasing so
[56]
check this out so in a typical
[59]
landlord-tenant relationship we have two
[64]
parties we have the lessor and the
[68]
lessor is the landlord and there's a
[73]
lease agreement that's entered into with
[77]
the lessee le SS EE that is the tenant
[84]
all right so let's say it's a one-year
[86]
lease and it's 500 bucks a month and
[91]
this is a single-family house now it
[93]
doesn't matter what type of contract it
[96]
or what type of property it can be a
[98]
single-family home an apartment a
[100]
commercial space it doesn't matter
[102]
conceptually it's all the same so this
[104]
is a one-year lease to two months into
[107]
that one-year lease the tenant decides
[110]
they want to move and they found a
[113]
friend of theirs that wants to take the
[116]
lease over so what's going to happen is
[118]
the tenant is going to do one of two
[120]
things if the lease agreement strictly
[123]
prohibits it
[124]
the tenant may go to the landlord and
[126]
get written permission to do it or in
[129]
the case where the the lease agreement
[131]
doesn't have any kind of prohibition
[133]
then the tenant is free to do it now
[136]
remember the relationship here here are
[138]
the league
[139]
terms in this relationship between the
[141]
Landlord and Tenant the landlord is the
[143]
lessor with an O R and the tenant is the
[146]
lessee all right now at the point that
[149]
the tenant wants to assign the lease
[151]
agreement over to somebody else the
[153]
relationships change and so do the legal
[156]
names all right so the tenant wants to
[160]
assign the lease agreement over to one
[162]
of their friends so the tenant becomes
[165]
what's called the assign or assi GN o r
[171]
and the person that's receiving the
[176]
assigned lease agreement is the you
[178]
guessed it assign e with two E's all
[182]
right so the relationship between these
[185]
two is called the assign or the assignee
[188]
but this relationship between the
[190]
Landlord and Tenant still exists which
[192]
becomes the the lessor letter which is
[195]
the lessor and lessee right that's why I
[198]
drew this the way it is now here's the
[200]
deal the original term of this lease
[204]
agreement was one year for 500 bucks a
[207]
month so on and so forth so let's say
[210]
that it's Tom that is receiving the
[215]
assignment so the tenant is going to
[217]
assign the lease over to Tom Tom still
[220]
must abide by all the terms of the
[223]
original lease agreements so it's still
[225]
going to be for the remaining one the
[227]
balance of the one year it's going to be
[228]
500 bucks a month and all the other
[230]
rules and recs in fact Tom is more than
[233]
likely going to pay monthly rent to the
[236]
landlord it can go through the tenant
[239]
but typically it doesn't it kind of
[242]
depends on how the assignment is set up
[244]
so you have to know for the real estate
[246]
licensing exam who the parties are
[250]
landlord tenant or lessor lessee but at
[252]
the time that the assignment happens
[254]
then the tenant is legally known as the
[256]
assign or and tom is the assignee now
[260]
let's talk about the same scenario but
[262]
we're doing subleasing here now it's a
[264]
different beast all right so we have the
[267]
the landlord which is the lessor
[272]
and they have a relation or a contract
[275]
lease agreement with the lessee with two
[281]
E's now what happens instead of the
[285]
tenant assigning the contract the tenant
[289]
becomes the landlord so what happens as
[292]
the tenant becomes what's called the sub
[296]
lessor oh are less or because they are a
[301]
subtenant or a sub landlord and they
[304]
turn around and rent the property out to
[306]
what's called a sub tenant or a sub
[311]
lessee all right so here's how this
[314]
works
[315]
the landlord rents the property out it's
[320]
a one-year lease agreement at $500 per
[323]
month but the tenant says hey I think I
[327]
can I think this properties under rented
[328]
I think I can make a couple of hundred
[330]
extra dollars a month so the tenant
[332]
finds a tenant and then says hey I'll
[335]
move out you can move in but guess what
[337]
the rent is seven hundred dollars a
[340]
month so the sub tenant is going to pay
[343]
the original ten at seven hundred
[346]
dollars a month and then the original
[348]
tenants going to pay the landlord five
[351]
hundred dollars a month so the tenants
[354]
going to make two hundred bucks a month
[357]
extra that's how that one works now
[360]
here's the interesting thing that if the
[364]
sub tenant stops paying the rent just
[368]
like in our assignment the the tenant
[371]
the original tenant is still responsible
[373]
for all the terms and conditions of that
[375]
original of that original lease
[379]
agreement even though they have a
[381]
separate lease agreement here they're
[385]
still bound by it so if this particular
[388]
tenant stops paying the rent and an
[390]
eviction has to happen the landlord
[392]
actually has to evict both of them it
[395]
can be very complicated legally now up
[398]
here Tom as I said has has to abide by
[402]
the original terms of the contract and
[405]
the same would
[406]
that if somebody stops paying the rent
[409]
here then the the landlord's gonna evict
[411]
both of them the thing to remember is
[413]
the process how it all works and you
[415]
have to understand who is who who is who
[418]
here as far as their legal names go all
[422]
