talk about some advice that i'm seeing

going around that's going to cause you

serious problems and it relates to

charge offs

a lot of people are saying don't pay
[14]
charge offs don't pay collections
[16]
i'm going to tell you why that could be
[17]
really really horrible advice
[19]
and some things that you can do instead
[21]

right let's talk about charge offs

i've done videos on charge-offs before

and

there's there's very few topics out
[37]
there where i get more reaction and more
[39]
like

hate comments coming back to me saying
[41]
that i'm just totally wrong and i don't
[43]
know what i'm talking about
[44]
clearly this that guy didn't go to law
[46]
school because if if i did i would know
[48]
that
[49]
if a company charges off the debt then
[50]
you no longer owe the debt and
[52]
you can just ignore all those
[53]
collections that are coming your way
[55]
and in fact recently i've been looking
[57]
at you know some videos that pop up in
[59]
my
[60]
youtube stream and feed that are talking
[64]
about charge offs i see this with a lot
[66]
of credit repair type companies
[68]
and they have the big bold headline of
[70]
never pay collections don't ever pay
[72]
charge offs
[73]
because you know you don't know them and
[76]
just let them go away and eventually the
[77]
statute of limitations will run
[79]
and uh things will be great generally
[81]
things are not great
[83]
they don't they don't end up that way
[84]
and to to realize and to understand
[86]
why this information is such bad advice
[89]
and bad information these people are
[91]
putting out on the internet
[92]
you need to understand the collection
[93]
cycle when a debt like a credit card
[96]
goes into collections it's usually
[98]
internal collections for the first 30 to
[100]
90 days they're calling you on the phone
[102]
they're sending you letters
[103]
if you've been through that process you
[104]
know it's annoying they are
[106]
they don't ever stop but after you they
[109]
get to about 90 days they may farm it
[111]
out to some other collection agencies
[112]
they'll try their part trying to get
[115]
this money from you
[116]
but if it goes 180 days and they're not
[119]
able to collect from you
[120]
essentially from the time you made that
[122]
last payment until now it's been
[124]
roughly six months since you've been
[126]
able to make a payment on it they
[128]
are required to charge that off let me
[130]
read you directly
[131]
from the fdic uniform retail
[135]
credit classification account management
[137]
policy
[138]
it states specifically open and retail
[141]
loans that become past due
[143]
180 cumulative days from the contractual
[146]
due date
[147]
should be classified as loss and charged
[150]
off
[151]
okay so 180 days goes by no payments
[153]
made
[154]
by law those credit card companies have
[156]
to charge off that debt
[158]
now the the kind of the the rub on this
[160]
is understanding what the charge off
[162]
means and what it doesn't mean
[164]
a charge off means that that company is
[166]
no longer counting
[168]
your account that a balance owed has an
[170]
asset on their books
[171]
they're saying it's a loss we're not
[173]
going to be able to collect on it it's
[174]
uncollectible at this point
[176]
and so this helps in making sure that
[178]
they have a proper valuation of what
[180]
their company is
[181]
that they can't treat this big backlog
[183]
of accounts receivable
[184]
as an asset that's going to be collected
[186]
they're saying hey we haven't collected
[188]
anything for six months
[189]
it's not an asset anymore when we're
[191]
determining proper valuation of our
[192]
company
[193]
however if they receive money from you
[195]
after the fact if you make some type of
[196]
payment
[197]
then they have to count that uh as an
[200]
increase in the overall value
[202]
so but what it doesn't so it that that's
[204]
what it means but what it doesn't mean
[205]
it doesn't mean that the debt is no
[206]
longer
[207]
collectible as long as it's within the
[209]
statute or limitations
[210]
of the applicable state each state has a
[213]
somewhat different uh
[214]
statute limitations as relates to credit
[216]
card companies
[218]
even if an account's been charged off it
[220]
doesn't mean that it's not collectible
[222]
anymore they can still try to call you
[223]
and ask you to pay
[224]
they can sell it to a junk debt buyer
[226]
they can file a lawsuit they can sell to
[228]
somebody else who can file a lawsuit
[230]
if you don't if you don't believe me
[233]
i've spent 20 years defending
[234]
thousands of these lawsuits and so
[238]
either the state of arizona just has it
[239]
completely wrong maybe i'm completely
[241]
wrong
[242]
i know i'm not wrong the these charged
[245]
up debts
[246]
can be collected on they can be sued on
[248]
and so this advice of hey just ignore
[250]
these and wait out the statute of
[251]
limitations
[252]
that may work for low dollar collections
[255]
you know if you have an old medical bill
[256]
that's 150 bucks
[258]
yeah you're not going to get sued for
[259]
150 but credit cards
[261]
larger collections medical bills
[263]
deficiencies from car
[265]
loans or repossessed those will often be
[268]
sold
[268]
to junk debt buyers and they do file
[270]
suit that is their business model
[272]
they're not a collection agency that's
[273]
just going to call you call you call you
[275]
kind of thing
[276]
they are going to file suit and try to
[278]
garnish your wages and hit your bank
[279]
accounts
[280]
that will happen and so the advice that
[283]
i see people throwing out there on the
[284]
internet of hey just
[285]
just wait these things out that that
[288]
often ends in a lot of heartache it
[290]
often ends
[291]
in wage garnishment it often ends in
[294]
bank levy
[295]
and that's why i put so much information
[296]
about here about how to fight back

against these junk debt buyers
[300]
is because you have to take action to
[301]
make this go away i think deep down we
[303]
all know that the advice of just don't
[304]
do anything
[305]
is probably not a good idea it feels
[307]
good because we don't want to have to
[309]
pay off these collections
[310]
but often it's horrible advice as it
[313]
relates to dealing with these debts
[314]
effectively
[315]
you have debt settlements you have
[316]
bankruptcy you have contesting these
[317]
things
[318]
but doing nothing will often result in
[320]
disastrous
[321]
consequences so i hope that helps when

it comes to charge-offs

understanding that just because the
[327]
debts are charged off does not mean that
[329]
they can't still try to collect on it

anybody else who is telling you that on
[333]
the internet and on youtube

is not being truthful with you they
[336]
either don't know or they have some
[338]
ulterior motive for throwing that out

there
