is someone who

uh is occupying

a property whether they're on the

property or they're actually

in the improvement on the property maybe

the this is a common thing in england

where

where squatters go in and they they

squat inside a house the house is left

vacant

the people went on vacation in france

and they go in and they just

they take the property over a squatter

once they have met

certain statutory provisions i.e

they have occupied the property for a

statutory period of time and that

statutory period of time is determined

by each individual state statute they've

done it in a hostile way meaning

they didn't get the permission of the

owner they did it in a continuous way
[264]
meaning they didn't occupy the property

for six months then leave for six months
[268]
and then come back for six months

uh it was visible distinct and actual if
[272]
somebody if the neighbor
[274]
looked onto the property they would
[276]
notice that this person they they would
[277]
think that this person actually is
[279]
legally there when they are not
[281]
so that's the that's the elements of
[284]
squatters rights
[286]
if that squatter uh they
[289]
fulfill all the elements within that
[292]
particular state under adverse
[294]
possession they can go in front of a
[295]
judge
[296]
and and plead their case and the judge
[298]
can award him
[299]
title to the property and if the judge
[302]
does
[302]
award him title that means title passes
[304]
from the previous owner to the squatter
[307]
and under adverse possession title
[309]
passes
[311]
no compensation is required to the uh
[313]
previous owner
[315]
all right let's look at a sheet a sheet
[318]
i always tell my students that a sheet's
[321]
root word is
[322]
cheat because they are the government is
[324]
cheating
[325]
someone out of their property now there
[328]
are two
[329]
instances when a sheet is used now
[332]
understand that a sheet is an old common
[334]
law
[335]
doctrine that many states have codified
[337]
within their statutes
[339]
and it simply allows a government agency
[343]
and that agency that's tasked with doing
[346]
that is different within each state and
[347]
it's based on state law
[349]
but it allows the government to wrap up
[352]
one's
[353]
estate and wrap up someone's affairs if
[355]
they've died
[356]
intestate when somebody dies in
[359]
intestate they've died without a will
[362]
and there's no errors to be found so
[365]
somebody dies without a will they have
[366]
no errors
[367]
there has to be a legal mechanism to
[369]
wrap up this person's
[371]
affairs and what they do is they will
[374]
take title to the property sell it and
[376]
then what happens to the proceeds of the
[378]
sale is determined by state statute you
[380]
don't have to know that for the real
[381]
estate exam but i wanted to do it for
[383]
illustrative purposes
[384]
there is another function for a sheet
[387]
and that is for abandoned property so
[388]
let's say that a piece of property
[390]
has been abandoned by the owner who
[391]
lives in a different state a different
[393]
country
[394]
and wants nothing to do with the the
[396]
property the property has become a
[398]
haven for crime there's prostitution
[401]
drug dealing
[402]
the local government has to have a
[404]
mechanism to go in and take care of that
[406]
and uh that is another way that uh
[410]
a purpose of a sheet and again title
[412]
passes and no compensation
[415]
all right so just with a sheet title
[418]
passes
[419]
no compensation to that owner that who
[422]
abandoned the property
[424]
police powers is the last one now police
[427]
powers permits the state
[428]
and local governments to impose
[430]
restrictions and control
[432]
upon private property and i'm going to
[434]
explain that
[435]
this also extends to the federal
[437]
government and i'll explain that in a
[438]
minute
[439]
but if they're going to impose these
[441]
restrictions and controls it has to be
[443]
in the
[444]
public's benefit it has to benefit the
[447]
public through
[448]
like welfare health and safety those
[450]
type of things and some common examples
[452]
of what i'm talking about here
[453]
is zoning laws building codes occupancy
[457]
standards those type of
[460]
regulations are imposed on private
[462]
ownership and private owners
[464]
title does not pass the owner still has
[467]
to comply with the regulations and if
[469]
there's a cost associated with that that
[472]
cost is
[472]
borne by the owner there is no
[476]
compensation for the
[478]
landowner so under police powers there's
[481]
title does not pass and there's no
[483]
compensation
[484]
now the federal government also has
[486]
police powers particularly within the
[489]
environmental environmental arena um
[493]
i think i've told you this story before
[495]
in a previous video but i had a couple
[497]
that was in my
[498]
my pre-licensing class several years ago
[501]
and they had moved from oregon they had
[502]
purchased 40 acres of timber
[505]
and they paid like a million dollars for
[507]
it and the value was in the timber
[510]
that they were going to harvest shortly
[511]
after they closed
[513]
on the property remember they had a
[514]
million dollar plus mortgage
[516]
uh the federal government came in
[518]
because they found the
[520]
spotted owl on the property and at that
[522]
time the spotted owl was on the
[523]
endangered species list
[525]
so they weren't allowed to do anything
[527]
with that property whatsoever
[530]
that is an example of when where the
[532]
federal government gets involved with
[533]
police powers
[535]
again excuse me police powers title does
[537]
not pass
[539]
no compensation is given to the
[541]
landowner
[542]
