what the anti-lapse statue is or maybe in the聽 vernacular maybe more understandably what if聽聽

my beneficiary dies or what if my beneficiary聽 predeceases me that's a common question I often聽聽

hear from folks so I want to address that folks聽 for you here today anti-lab statute is actually聽聽

a law and it's recognized by the uniform probate聽 code and here in the commonwealth of Massachusetts聽聽

Massachusetts adopted the uniform probate code聽 between the year 2009 and 2012 and with that聽聽
[48]
Massachusetts adopted the anti-lap statute from聽 the uniform probate code what does it mean folks聽聽

so I'll give you a basic example Bill and Mary聽 parents create their will or their trust and they聽聽

say their three darling children get everything聽 when they're gone their children are Mo Larry and聽聽
[69]
Curly let's say for example Mo predeceases their聽 parents Bill and Mary what happens to Mo's share聽聽

well let's discuss that well the anti-lab statute聽 would say that Mo share does not lapse meaning聽聽

that Mo's share would go to Mo's descendants聽 usually Mo's child or Bill and Mary's grandchild聽聽

so let's explore first folks from my experience a聽 good way to explain the anti-lapse statute is this聽聽

what does the word lapse mean the word聽 lapse means to feel to feel or to not happen聽聽

it laps like an insurance policy lapsing聽 you no longer have coverage or protection聽聽

or the word anti what does the word聽 anti mean it means to stop and to avoid聽聽

the policy from lapsing or to stop the聽 protections or the benefits from happening okay聽聽

so the word anti means folks is to stop or be聽 against be against the lapsing of the gift okay聽聽

so anti-lap statute would say hey Mo's gift does聽 not lapse it does not feel because if it fails聽聽

then the question is who does Mo's one-third go聽 to does it go to his children the grandchildren聽聽

of Bill and Mary or does it go to Mo's brothers聽 Larry and Curly the anti-lap statue will say that聽聽

the gift does not fail and that the gift goes down聽 to Mo's children or Bill and Mary's grandchildren聽聽

and so that's the general rule of the anti-lab聽 statute there's specific language in the uniform聽聽

probate code that talks about it has to be a聽 blood relative of the testators who made the will聽聽

so it would have to be maybe a grandchild a lineal聽 descendant is the legal terminology they use聽聽

so usually a grandchild who does the anti-lab聽 statute exclude well it excludes all non-blood聽聽

relatives which could be step children聽 could be in-laws could be husbands and wives聽聽

so Bill and Mary might be thinking well聽 if Mo Larry or Curly pre-deceased me聽聽

we love our in-laws they'll get their share not聽 so according to the anti-left statute so folks聽聽

long and short of it make sure you work with聽 your state elder attorney to put in place what聽聽

I call contingencies contingencies or contingent聽 beneficiaries always plan for who your primary聽聽

beneficiaries are in your will and your trust聽 Mo Larry Curly but also plan for contingent or聽聽

backup beneficiaries what if Mo Larry and Curly聽 pre-deceased Bill and Mary the appearance who聽聽

gets Mo Larry and Curly share usually from my聽 experience most folks will say hey Patrick I want聽聽

their share to go to their children our聽 grandchildren we want to keep everything聽聽

in the family bloodline really really important聽 to spell that out in your will and in your trust聽聽

because not all states have adopted the uniform聽 probate code for my recommendation generally聽聽

speaking two ways to avoid a gift from lapsing聽 is number one have a backup contingency or a聽聽
[296]
backup beneficiary in your will in your trust聽 also remember folks to do your annual reviews聽聽

that's part of our process here we do annual聽 reviews with our clients to slay the four-headed聽聽

beast of estate planning and elder law do those聽 annual reviews for the three L's changes in law聽聽
[315]
changes in life changes in learning and update聽 your attorney if there's anything going on聽聽

for example if you're a beneficiary your child聽 for example maybe has a change in health and聽聽

they're not doing well you want to make sure that聽 your will or your trust is updated accordingly聽聽

so if they do pre-decease you you're clear on聽 where their share will go after you go to your聽聽
