asked frequently lately because so many

of you

actually are either finding yourself at

home maybe even potentially out of work

but looking for additional income

sources

but you love to cook you love to bake

can you start a food business from home

and the answer is yes you can

now with the actual exemption i believe

in the only state that doesn't allow it

from home is new jersey

and i'm going to double check that but

i'm pretty sure that that is actually
[77]
the only one that i've ever come across
[79]
that doesn't have
[80]
what's known as cottage food law and
[82]
that is actually laws that allow you to
[84]
sell food products
[86]
from home and they give you a certain
[88]
area to sell them and a certain amount
[90]
and all that
[90]
so i'm going to actually dive into all
[92]
of that and explain how that works and
[93]
even give you a tip
[94]
on how to find out your specific state
[97]
now

really quick side note on our channel

in the united states we have already

florida and georgia and so on so let me

dive into this and give you some tips on

how this works

and let you know what you can and can't
[121]
make so number one

the most important step is the legality
[124]
of your business the business legalities
[126]
these are something you got to do right
[128]
off the bat
[128]
you need to find out number one what you
[131]
can make in your state
[132]
as far as what is going to be required
[134]
for the licensing and permits
[136]
now understand this the state can create
[138]
cottage food laws but
[140]
it trickles down to the local cities and
[142]
counties those local municipalities
[144]
where you live
[145]
they may have additional rules
[147]
regulations they may allow you to do
[148]
certain things or
[149]
even omit certain things and say look
[151]
you can't necessarily do that in our
[152]
county
[153]
or you can't do that in our city so you
[155]
need to find out not just your state
[157]
cottage food laws but what your city is
[159]
so
[159]
for instance if you lived in atlanta
[161]
georgia okay the state of georgia has
[163]
cottage food laws of course
[165]
now the city of atlanta though may have
[167]
some additional
[168]
regulations some limitations or even
[171]
permits and licensing
[173]
now many of the states believe it or not
[175]
this is very unusual
[176]
but many states actually don't require
[179]
you to incorporate as a business
[181]
but i'm going to give you a tip and this
[183]
is for protecting yourself
[185]
i highly recommend whether your state
[188]
requires it or not
[189]
you really need to incorporate yourself
[192]
as a business to separate the potential
[194]
liability
[195]
okay when i started my food business um
[198]
my wife and i actually had a bakery
[200]
of course um slightly different of
[201]
course than the cottage food law
[203]
but we definitely incorporated as an llc
[205]
and you could create an llc actually for
[207]
a home-based business
[208]
i've actually got a link down below for

inc file and swift files
[213]
these are actually online websites that
[214]
allow you to create
[216]
your business entity in literally like
[218]
less than 10 minutes or so maybe in 15
[220]
minutes
[220]
and you're done and you can do it in any
[222]
state but check out those websites
[223]
because they
[224]
also have fantastic deals and pricing
[226]
for you to create an llc
[228]
and to make sure that you're protected
[229]
under that limited liability so
[231]
the business legalities my advice is if
[234]
your state says hey you don't
[235]
necessarily need it
[236]
definitely do this okay this is
[238]
something that is very very good for
[240]
your
[241]
liability factor it's going to limit
[243]
what you as a person personally would be
[245]
liable for
[246]
as an llc of course your business is is
[248]
the only entity that they can go after
[250]
if somebody gets sick
[251]
if somebody eats food that's not cooked
[252]
properly or baked properly and someone
[254]
has an allergic reaction
[256]
they can cause potential illnesses in
[258]
situations that would be very bad for
[260]
you financially so
[261]
should you incorporate yes please do
[263]
yourself the favor of doing that i try
[265]
to tell my clients that all the time as
[266]
well
[267]
it's always the best route to go so now
[270]
what kind of permits
[271]
and licenses damian would you need for a
[273]
home business well it varies by state
[275]
but in general
[276]
some states require a food handlers card
[279]
like a class that you can actually take
[280]
to get that actual permit or the little
[282]
card that allows you to do that
[284]
some states do not need that some have
[287]
local
[288]
city and county permits and licenses
[290]
that have nothing to do with the state
[292]
licensing
[293]
so you definitely want to look into what
[295]
is required and again you can simply
[296]
google that
[297]
and if you are in a city if it happens
[299]
to be miami florida let's say
[301]
you can type in a home-based food
[303]
business miami florida
[304]
permits or you could basically
[306]
substitute whatever city that you're in
[308]
easy way to locate exactly what you'll
[310]
need but it's in your particular city
[312]
so number two where to sell now
[315]
some states don't allow you to sell
[318]
online
[319]
some states actually do now when some
[321]
states do allow you to sell online
[323]
most of the time you have to sell within
[324]
the state though normally you cannot
[327]
sell something and ship it outside uh
[329]
interstate sales as it's known outside
[331]
of your city
[332]
and state limits i mean so you want to
[334]
definitely make sure
[335]
and see if you can do that online
[336]
because some i've actually had a lot of
[338]
questions in regards to this and
[340]
comments about people starting at home
[342]
and they're telling me hey damian you
[343]
know we actually have a website up and
[344]
running
[345]
our state allows us to have an online
[346]
website to take orders and i think
[348]
that's great
[349]
i hope that more states follow suit and
[351]
they do that
[352]
now locally it would be like farmers
[354]
markets local events
[356]
outdoor events now with obviously
[358]
everything that's going on currently
[359]
there's a handful of events that have
[361]
either taper down or minimize the amount
[363]
of people who could sell
[365]
but i'm going to tell you something i
[366]
have a very good gut feeling on
[368]
in 2021 you're going to see a lot more
[371]
outside
[372]
events not vents that are obviously that
[374]
are more aerated
[376]
that have the six foot distancing and so
[378]
on so i would highly recommend
[380]
you don't give hope on the idea to give
[382]
up hope that you can't do this in the
[384]
coming year
[384]
there's going to be a lot more events
[385]
that are going to be outside and they're
[386]
going to need food vendors
[388]
and that's where you guys can come in
[389]
because farmers markets festivals fairs
[392]
different outdoor events music festivals
[394]
they're going to begin to happen again
[396]
maybe a lot smaller than used to but
[398]
they're going to still need food vendors
[400]
and that's where your opportunity lies
[402]
number three
[403]
what types of food can you sell so what
[406]
types of food can you sell that is a
[408]
great question and that is obviously
[409]
probably
[410]
the most important question because
[411]
everybody's wondering well can i start
[413]
cooking
[413]
food you know like chickens and ribs and
[416]
meats and proteins and fish
[418]
absolutely not unfortunately under
[421]
california is the only state that
[422]
actually has a law that allows you to
[424]
almost create a restaurant in a sense
[426]
on the state level but many of the
[428]
counties and cities in california
[430]
haven't yet
[430]
adopted the law allowing you to do it
[433]
within the city limits
[435]
that's one of the one of the tricks that
[436]
have to unfortunately unfold
[438]
is that those cities and counties have
[440]
to allow that to happen within their
[442]
city and county
[443]
the state can put it on the books but
[445]
unless it's
[446]
adopted and taken on in those little
[449]
cities and counties
[450]
it's something that won't be allowed but
[451]
that doesn't limit what you can make
[453]
anywhere from baked goods to a lot of
[455]
times even salsas
[456]
hot sauces you can do snacks popcorns
[460]
chocolate pretzels chocolate cookies any
[463]
type of cookie you can imagine
[464]
bundt cookies bundt cakes trail mixes
[466]
these are products that are considered
[468]
non-potentially hazardous
[469]
okay so potentially hazardous items are
[471]
items that have to be kept at a certain
[473]
temperature
[474]
or they have a certain time frame that
[476]
they have to be consumed
[477]
most states don't allow you to make
[479]
those types of food products but
[481]
the list is gigantic in most every state
[484]
and all of them are pretty similar as
[485]
far as what you can make
[487]
and you can still make a heck of a a
[488]
side business out of this okay
[491]
number four restrictions and limitations
[494]
so
[495]
many of the restrictions and limitations
[496]
are actually entailed to who can be in
[498]
the kitchen at the time of food
[499]
preparation
[500]
obviously pets are not allowed smoking's
[502]
not allowed if you're preparing food for
[504]
your family they ask that you do that
[506]
separately
[507]
so if you're creating a food product for
[509]
your food business try to do that at a
[511]
separate time frame than actually
[512]
cooking breakfast for your kids while
[514]
you're trying to make cookies to sell
[515]
locally
[516]
they try to prohibit that as well okay
[518]
some of the other limitations are the
[519]
types of equipment
[520]
you can't use commercial equipment or
[522]
large mixers things that are normally
[524]
found in commercial kitchens
[526]
are normally not allowed to be in a home
[528]
setting and used
[529]
for home products so number five step
[532]
five is insurance
[534]
now this is something that again it's in
[536]
many states it's not required
[538]
i highly highly recommend that you have
[540]
food business insurance and yes you can
[541]
actually get
[542]
a food business policy for your home
[544]
based food business
[545]
um i recommend that and believe it or
[547]
not your auto policy
[549]
if you don't have a commercial auto
[551]
insurance policy which you may obviously
[552]
not because you haven't started your
[554]
business yet
[555]
check into getting an auto insurance
[556]
quote for your vehicle
[559]
that would actually allow you to use it
[561]
for your business so
[563]
if you go around town and you're
[564]
collecting you're getting ingredients
[565]
maybe packaging or whatever it is
[567]
locally
[567]
and you're using your vehicle there are
[569]
potential tax benefits to that
[572]
and make sure that if you can get
[573]
yourself an actual commercial lice a
[575]
commercial insurance policy
[576]
for your vehicle and your auto insurance
[579]
you can actually write that off as a
[580]
business expense
[582]
now the tax benefits and all that that's
[583]

the way some huge tax benefits to doing

this to having a business like this at

home

number six step six is labeling and logo

okay so if you don't have a logo and i

highly recommend you really dive into

this and get creative

you don't have to be the designer of it

your brand is just starting and you can

build on that

and continue to use this and build a

brand once you get into a commercial

setting

number seven packaging think of how

you're going to package your particular
[658]
products as i mentioned in the
[659]
introduction the opening
[660]
there's a variety of things so if you're

doing chocolates well then you need to
[663]
look at some type of really fancy
[665]
box for the chocolates you want to make
[667]
the presentation stand out you want to
[668]
look professional
[670]
and be taken as people to consider you
[672]
as a professional
[673]
food business buy your packaging it says
[676]
a lot about
[677]
your product and a lot about your
[678]
business so look into the packaging
[681]
if it's a bag don't make it just a
[682]
simple bag create a really colorful
[685]
beautiful logo on the front you got a
[686]
great label on the front
[687]
and then all of that necessary
[688]
information on the back such as
[690]
ingredients
[690]
allergen listings and so on that stuff

can go on the back but you want to
[694]
really get it i attention
[696]
eye grabbing packaging for your product

so don't underestimate the power of

having a really cool packaging when you

start

now you can down the road always change

and always evolve and that's okay

there's nothing wrong with that

so number eight how are you going to

market and promote it well

believe it or not whether or not your

state allows you to sell products

through your website

i highly recommend you create a website

and again

don't be afraid or or seem afraid of

that idea

the concept of creating a website

because you may not have any type of

technical skills

you can actually get one made for you

the website the reason why i tell you

create the website when you start your

home-based food business as your

business

grows and becomes a commercial business

you're going to have a completely done

viable ready to go ecommerce website

okay and you can actually easily

transition that website into something

that

can sell products once you get to that

level so that's why i always tell my

clients when i do my consulting too

start your website as soon as possible

next up step nine keep all of your

receipts and expenditures now now like i

mentioned before

check into your auto insurance policy if

you can change that into a commercial

policy or upgrade that and let them know

you're using that

keep understand and know all of the

different monthly payments for that

any receipts that you use for
[780]
ingredients receipts for packaging
[782]
if you create a website with shopify or
[785]
if you create a website with weebly or
[787]
godaddy or wix
[789]
you want to make sure that all these
[790]
hosting domains that you have out there
[793]
every month you're paying for that
[794]
use that also to keep the receipts for
[796]
that because that is part of your
[797]
business expense
[798]
so all of these expenses that add up are
[800]
actually going to be hugely beneficial

for your home based food business great

platforms to create websites on really

quick would be wix

shopify weebly and you're looking at

like a 20 to 30
[811]
a month or 35 a month fee and those fees

can add up definitely

very quick step 10

just start okay and i know you may be

thinking oh i saved and waited all the

way to another step 10 to hear that

yes don't delay and don't procrastinate

just get started now are you going to

have all the answers up front

no are you going to know everything what

to do no i didn't

12 years ago i just kind of i just

determined i was going to start a

business and i was going to make it work

and it was going to succeed
