it's been two and a half months since bernard聽
al-madoff was picked up and charged with what's聽聽

believed to be the largest financial fraud in聽
history yet we still don't know much more about聽聽

the alleged 50 billion scam than what madoff聽
initially told the fbi agents who arrested him聽聽
[22]
there are still no indictments as federal聽
prosecutors continue to unravel the case聽聽
[27]
and to try and figure out exactly聽
what happened and who all was involved聽聽
[31]
but the proof that it happened can be found聽
in the ruined lives of thousands of victims聽聽
[36]
the one person who knows the most and is willing聽
to talk is harry marco polis the man who figured聽聽
[42]
out made off scheme before anyone else he sat聽
down with us for his only television interview聽聽
[48]
until a few months ago harry marco polis was an聽
obscure financial analyst and mildly eccentric聽聽
[54]
fraud investigator from boston who most people聽
would never notice on the street my modern greek聽聽
[60]
hero how you doing but today he enjoys an almost聽
heroic status pursued by journalists and movie聽聽
[66]
producers and honored by colleagues as the聽
man who went to the securities and exchange聽聽
[71]
commission and blew the whistle on bernie聽
madoff in his 50 billion dollar fraud

thank you thank you please take your seats but聽
he seems uncomfortable with all the attention聽聽

and knows that he is no hero i stand聽
before you a 50 billion dollar failure

how many times did you send material to the聽
sec may 2000 october 2001 october november and聽聽

december 2005 then again june 2007 and finally聽
april 2008 so five separate sec submissions聽聽

and in spite of all of the things that you did聽
it still ended up in disaster there's nothing to聽聽

be proud about in this case i feel horrible聽
about the result it's been a total disaster聽聽

for the victims it began a decade ago when marco聽
polos was working for a boston investment firm聽聽
[132]
his boss told him that bernard madoff a聽
former chairman of the nasdaq stock exchange聽聽
[137]
was running a huge unregistered hedge聽
fund that was producing incredible returns聽聽
[142]
he wanted harry to reverse engineer its聽
trading strategy and revenue streams聽聽
[147]
so that the firm could duplicate madoff's results聽
he had the patina of her being a respected citizen聽聽
[154]
one of the most successful businessmen in new york聽
and certainly one of the most powerful men on wall聽聽
[157]
street you would never suspect him a fraud unless聽
you knew the math so i mean you're like a math guy聽聽

right i've taken all the calculus courses from聽
integral calculus through differential calculus聽聽
[168]
as well as linear algebra and statistics both聽
normal and non-normal how long did it take you聽聽
[174]
to figure out that there was something wrong it聽
took me five minutes to know that it was a fraud聽聽

it took me another almost four hours of聽
mathematical modeling to prove that it was a fraud聽聽

what were the things that caught your聽
attention it was the performance line聽聽

as we know that markets go up and down and his聽
only went up he had very few down months only聽聽

four percent of the months were down months and聽
that would be equivalent to a baseball player in聽聽
[201]
the major leagues batting 960 for a year clearly聽
impossible you would suspect cheating immediately聽聽

maybe he was just good no one's that good harry聽
said there were only two plausible explanations聽聽

either madoff was using insider information聽
to rack up huge profits or he was running a聽聽
[219]
giant ponzi scheme so either way he was doing聽
something illegal either way i knew he was going聽聽

to go to prison in may of 2000 marco polos聽
took his suspicions about bernie madoff to聽聽

the boston office of the securities and exchange聽
commission did you have any financial motive yes聽聽

he was a competitor of mine in 2000 to 2004 while聽
i was still in the industry and when someone's聽聽
[242]
competing on your playing field who's a dirty聽
player you want him tossed off the field he also聽聽
[248]
thought he might be eligible for a sizable reward聽
if the fraud involved insider trading but that聽聽
[254]
turned out not to be the case in your first letter聽
to the sec back in 2000 you're a little tentative聽聽

you say look i have no smoking gun in 2000 it聽
was more theoretical in 2001 it was a little bit聽聽

more real by 2005 i had 29 red flags that you聽
just couldn't miss on but by 2005 the degree聽聽

of certainty was approaching 100 percent over聽
time and with some simple math calculations聽聽

marco polos concluded that for madoff to execute聽
the trading strategy he said he was using聽聽
[289]
he would have had to buy more options on the聽
chicago options exchange than actually existed聽聽
[295]
yet he says no one he spoke to there remembered聽
making a single trade with bernie madoff's fund聽聽

i would talk to the people i had trading聽
relationships with and asked did you have a聽聽
[305]
trading relationship with mr bernard manoff and聽
they all said no we don't think he's for real聽聽
[311]
could you find anybody i found no one that聽
ever traded with mr manoff and i traded with聽聽
[315]
the largest equity derivative service in the聽
world and that's because madoff's investment聽聽
[320]
fund never actually made any trades at least going聽
back to 1993 and probably further a fact confirmed聽聽
[327]
last week at a meeting of madoff investors by聽
the trustee charged with liquidating his assets聽聽
[333]
no one knew the depth of the fraud聽
but a lot of people had questions聽聽
[338]
who else figured this out besides you i would say聽
that hundreds of people suspected something was聽聽
[345]
amiss with the madoff operation if you look at聽
who the victims were not you'll notice that the聽聽
[350]
major firms on wall street had no money with mr聽
manoff i mean you write in the this is the letter聽聽
[356]
i'm quoting from the letter to the securities聽
and exchange commission red flag number 20.聽聽

madoff is suspected of being a fraud by some of聽
the world's largest most sophisticated financial聽聽
[366]
services firms and then you list some of the聽
firms yes i do the biggest firms on wall street聽聽
[371]
in conversations with people high up in those聽
firms that is correct and the sec ignored that聽聽
[378]
did they call any of these people all the sec聽
had to do was pick up the phone they never did聽聽
[383]
if you had executives at the biggest investment聽
houses on wall street that knew something was聽聽
[388]
wrong why do you think they didn't go to the sec聽
because people in glass houses don't throw stones聽聽

and self-regulation on wall street doesn't work in聽
january 2006 the new york office of the securities聽聽

and exchange commission finally opened a case聽
file to look into harry's allegations about bernie聽聽

madoff despite uncovering evidence that madoff聽
had misled them about his investment activities聽聽

the sec closed the case 11 months later without聽
ever opening a formal investigation the staff said聽聽

there was no evidence of fraud what i found out聽
from my dealings with the sec over eight and a聽聽
[423]
half years is that their people are totally聽
untrained in finance they're unschooled聽聽
[428]
most of them are just merely lawyers聽
without any financial industry experience聽聽
[432]
well if the people there aren't trained in聽
securities work what are they trained in聽聽
[437]
how to look at pieces of paper that the securities聽
laws require they can check every piece of paper聽聽
[442]
perfectly and find misdemeanors and they'll miss聽
all the financial felonies that are occurring聽聽

because they never look there even when pointed聽
to fraud they're incapable of finding fraud聽聽

no one at the sec would talk to us on the record聽
about harry marcopolis allegations but one person聽聽
[458]
who seemed to have had a high opinion of the聽
agency was bernie madoff i'm very close with聽聽
[463]
the regulator so i'm not trying to say that they聽
can't you know that what they do is bad as a聽聽
[467]
matter of fact my niece just married one besides聽
his niece's husband who no longer works at the sec聽聽
[472]
madoff has had long-standing ties to the agency聽
and has been called upon to give advice at this聽聽
[478]
2007 meeting of a non-profit group called the聽
phil octady center madoff seemed to think the聽聽
[484]
sec was doing a great job you know in today's聽
regulatory environment it's virtually impossible聽聽
[491]
to violate rules when this is something聽
that the public really doesn't understand聽聽

but you it's impossible for you to go under for聽
a violation to go undetected certainly not for聽聽

a considerable period of time but don't try聽
and tell that to the phil octadies center today聽聽

its main benefactor the betty and norman levy聽
foundation was fully invested in madoff one聽聽

of dozens of charitable organizations聽
that have been devastated or wiped out聽聽

madoff's customer list single spaced with聽
small type is 162 pages long with victims聽聽

running the gamut from hollywood royalty to a聽
carpenter's pension fund in syracuse new york聽聽

shelley ludlow has been forced to put her聽
mother in a medicaid assisted living facility聽聽
[538]
while she packed up their apartment to move聽
in with a friend all because of bernie madoff聽聽
[543]
their whole lives were turned upside down by聽
this man that sits in his penthouse and smirks

the same day last week 70 miles away len and marge聽
forest were leaving their house that they just聽聽

sold in setup at long island and were preparing聽
to drive to south florida to sell their home there聽聽

they had their money with bernie madoff for 30聽
years and lost an eight-figure family fortune聽聽

two days before his 80th birthday聽
do you have any money to live on聽聽

enough i would say for 60 days do you know other聽
people who are in the same situation oh yes聽聽

we have a lot unfortunately and i think probably聽
the thing that tears me up more than anything聽聽

is the fact that i recommended made off to聽
a number of people and they lost their money聽聽

and i i'll never stop feeling responsible for聽
that they were all close family and friends聽聽

part of a small exclusive group of investors lucky聽聽

enough to have a connection with bernie madoff and聽
because they thought they were making 12 percent聽聽

a year they weren't inclined to ask a lot of聽
questions harry marcopolis called it the classic聽聽

affinity scam an affinity scam is where you prey聽
on groups that are similar in nature to yourself聽聽

so i'm greek if i was going to run an affinity聽
scam i would run it on the greek american聽聽

community here bernie was jewish so he ran聽
into the jewish community in the united states聽聽

but that didn't that wouldn't get聽
him enough customers because he聽聽

always needed new money to keep the scheme聽
going the story will continue after this

over time madoff extended his reach from new聽
york to palm beach where he enlisted hundreds聽聽

of wealthy clients many of them recruited聽
from his own country clubs and he also聽聽

made connections that gave him entree to europe聽
and the hedge fund capital of america greenwich聽聽

connecticut it was here that bernie madoff made聽
some of his biggest deals with large investment聽聽

firms that were willing to feed him billions聽
of dollars of their clients money to manage聽聽

and in return bernie madoff agreed to pay these聽
so-called feeder funds a fortune in annual fees聽聽

the largest of the feeder funds was the fairfield聽
greenwich group how much money did fairfield make聽聽
[689]
off bernie madoff every year hundreds of millions聽
of dollars if you're a feeder fund what are you聽聽
[693]
supposed to do for those hundreds of millions of聽
dollars you're supposed to identify the world's聽聽
[699]
best hedge fund managers and invest only in聽
them and you're supposed to make sure they're聽聽
[703]
not running ponzi schemes the real steroids聽
here were the feeder funds that's what made it聽聽

an international ponzi scheme attorney david聽
boyes is one of the most prominent lawyers in the聽聽
[715]
country and is representing fairfield greenwich聽
investors who lost nearly seven billion dollars聽聽
[721]
when madoff went under they're suing the firm for聽
gross negligence claiming it failed to investigate聽聽

madoff thoroughly or monitor his activities as聽
it promised to do in its marketing materials聽聽

analysis of portfolio composition portfolio聽
stress testing risk management asset verification聽聽

do you think that really happened聽
no we know it didn't happen聽聽

because we know all they did was turn the money聽
over to bernie madoff and they did that for 20聽聽

years they did nothing they essentially did聽
nothing except lose their investors money聽聽

and enjoy very luxurious lifestyles from the money聽
they took out walter noel one of the founding聽聽

partners of fairfield greenwich declined to talk聽
to us and has reportedly been lying low with his聽聽

wife at their compound on the private island聽
of mystique but in a statement to 60 minutes聽聽
[770]
his firm said that it too was a victim of bernie聽
madoff that it had placed too much trust in his聽聽
[776]
then impeccable reputation and in the fact that聽
there had been multiple reviews of made off by the聽聽
[782]
second in the end harry marcopolis had been right聽
about bernie madoff he will be going to prison but聽聽

not because of anything that harry or the sec did聽
in a bad economy madoff's lies simply collapsed聽聽

under their own weight no one was investigating mr聽
manoff at the end so he turned himself in before聽聽
[805]
anybody in a position of authority began a serious聽
investigation that's typically how the sec does it聽聽

they come in after the crime has been committed聽
they toe tagged the victims count the bodies聽聽

and try to figure out who the crooks were聽
after the fact which does none of us any
