[0]
power of attorney is a it's it's a
[3]
device by which you can appoint somebody
[6]
else to manage your affairs if you are
[9]
unable to do it for yourself or just to
[12]
help you manage your affairs if you can
[14]
only manage them to an extent yourself
[17]
until 2007 you could only make what's
[20]
called an enduring power of attorney and
[22]
anybody who did those are still valid
[24]
you just can't make a new one of those
[26]
anymore
[27]
those dealt only with money and property
[31]
it wasn't possible to make a power of
[34]
attorney to deal with your medical
[36]
decisions on welfare where you should
[37]
live for example if you needed to go
[39]
into a nursing home so there was a in
[42]
2007 to sorts of powers of attorney was
[44]
set up they're both called lasting
[46]
powers but ones are lasting power for
[49]
your property and affairs so rather like
[51]
the old EPA enduring power and the other
[55]
one is a lasting power for Health and
[57]
Welfare and the beauty of the means that
[60]
you can appoint the person or people
[62]
that you would choose to to manage your
[66]
affairs if you can't do it anymore
[68]
rather than you know if disaster strikes
[72]
let's say you had a stroke can't manage
[75]
your affairs maybe only for a few weeks
[76]
but during that period somebody has got
[79]
to keep the show on the road and the
[83]
alternative to you having an attorney is
[84]
that somebody will apply to the court
[86]
for a deputy to be appointed that's what
[90]
used to be called a receiver that might
[93]
be a member of the family it might be a
[95]
family solicitor it could be a panel
[98]
deputy there are 60 of those around the
[102]
UK or England and Wales I should say
[104]
correctly of whom I'm one for the nice
[107]
thing about a power of attorney is that
[108]
you can choose for yourself and it can
[110]
be a member of the family
[111]
professional combination of those if you
[114]
feel that there are issues that remember
[116]
the fam
[117]
need a hand with and the attorneys the
[121]
way you make power of attorney is that
[123]
you fill in a form basically you can
[126]
download them from the internet if you
[128]
want to you couldn't get them from
[129]
government site the courts site people
[133]
do get entangle with them there's quite
[134]
a lot of bureaucracy attached to it and
[136]
you do need to make sure that you've got
[138]
every I dotted and every T cross in
[141]
exactly the right place you had to pay a
[143]
court fee there 130 pounds for
[145]
registering power once you've made it at
[148]
the office of the Public Guardian who
[150]
then keep a light hand eye on things to
[153]
make sure that nobody's doing what they
[154]
all want
[155]
and once the power is registered the
[158]
attorneys can then act provided that the
[162]
person who's given them that power is
[166]
happy for them to make the decisions and
[167]
can't make the decisions themselves so
[170]
to the extent that a person can make
[171]
their own decision they must be allowed
[173]
to do that you can just confer with them
[175]
if they really can't make the decision
[177]
then it's up to the attorney to to make
[179]
a decision in their best interests quite
[184]
often people will appoint different
[185]
attorneys for their property and affairs
[188]
ideally you want somebody with a good
[189]
financial head on their shoulders from
[193]
the people who might make the decisions
[194]
about which nursing home they would go
[196]
into for example it's more likely to be
[198]
a close member of the family for that or
[202]
should should you be revived if you're
[205]
in a coma with no prospect of a quality
[208]
of life after being revived is that what
[211]
she wants and who's going to tell the
[212]
doctor what she want and that would go
[215]
into your health and wealth
[217]
so it can be pretty extreme in what it
[221]
does but you can control how much power
[223]
you give you attorneys within the
[225]
document as to what decisions you'd like
[227]
them to make whether you want one or
[229]
more people to make a decision whether
[231]
you happy just for one to do it
[233]
you can also point a backup attorney so
[235]
if you appoint somebody who then dies or
[239]
goes off the rails or disappears abroad
[241]
or whatever you can have a backup
[243]
attorney come in and and take over so
[245]
they couldn't flexible I mean my view
[247]
you know I think everybody should have
[249]
one people will say oh but I'm not old
[251]
enough you know road accidents happen
[256]
sadly illness happens sadly and you know
[260]
just because you're 20 doesn't mean to
[262]
say it's not going to happen
[263]
to you just because you're not wealthy
[266]
doesn't mean to say that you don't have
[268]
affairs that need managing I've got a
[272]
young lady very young lady who had had a
[277]
difficult time at birth she's on
[280]
benefits she can't manage them so I get
[283]
to do that to give her a hand with how
[285]
to how to manage things and where she's
[287]
going to help her with where she's going
[289]
to live and so on so it's a good
[293]
flexible system
