We got to know that some days ago that Dinesh Prasad Ratauri,

was shopping for shoes from Bata showroom in Chandigarh

He bought the shoes and when the bill was made it had 3 rupees extra for a paper bag

The paperback also had the logo of Bata. Dinesh Prasad asked a simple question

Why I am paying 3 rupees for this paper bag? other showrooms never charged me for the same

So why are you charging? especially the bag which has Bata's branding.

Why are you branding with consumer's money only?

So when the showroom refused to refund the 3 rupees,

then Dinesh Prasad didn't ended that matter are there

He filed a complaint in consumer court.

So after the complaint, consumer court gave an order to bata which directed that

they should refund 3 rupees to him plus they also have to pay the litigation charges 1000 rupees

And 3000 rupees fine which has to pay to Dinesh Prasad as compensation for

Mental agony caused to the customer due to the deficiency in services.

This means because of the deficiency in their service customers have to bear this pain and

to file a complaint in consumer court for all this also, the compensation of Rs 3000 would be given

Dinesh Prasad got 4003 rupees instead for 3 rupees.

This does not end here court also gave order to Bata that they have to deposit

5000 rupees in Legal Aid of state Consumers dispute Redressal Commission

Through this case, we want to tell you that around you

many such unfair trade practices are followed

But we common people overlook such practices we think who will go in such botheration

And we leave it but you should know that 3 Rupees can cost 4003 rupees also

And you should handle such matter seriously because

what is happening with you is also happening with crores of customer

Just think if from Bata Store 1 crore people bought that item and

1 crore people also bought 3 rupees paper bag

Then Bata's 3 crore rupees revenue is coming only from selling paper bags.

Which is considered an unfair trade practice

Again one such case which your notice many times but have ignored it, is a service charge.

If you don't know service charge is not any kind of tax it's just the tip that restaurant charges from you

You are supposed to give that tip on your own and if you are happy with their service

If you are not satisfied with the service then you can tell the restaurant

that excludes the service tax and give me the new bill

So Jaijeet Singh (IPS) from Mumbai in 2017, with his wife went to the restaurant for dinner

The bill was 1810 rupees in which 10% service charge was added

that is 181 rupees service charge extra was charged by the restaurant

When Jaijeet Singh told that I am not satisfied with your service and I am not willing to give you this charge
[201]
Then the restaurant refused to give him another bill

so he had to pay the amount but Jaijeet Singh didn't let it go

He filed a complaint in consumer court and when the court asked for clarification,

which the restaurant failed to provide.

Now that restaurant didn't approach the consumer court then imposed a penalty on it and

ordered that you should pay 5000 rupees to Jaijeet Singh as compensation

for mental agony caused to him and 5000 rupees litigation charges

Means Jaijeet Singh got the whole of 10,000 rupees compensation

for 181 rupees which he paid to a restaurant without his will.

After closing of this case Jaijeet Singh also said that I will donate all Rs 10,000 to the chief minister relief fund

My purpose was not to take 10000 rupees from any restaurant but to spread awareness

So that by seeing me many consumers will show faith in consumer court

And if they are paying service charges against their will then they should take action.

I would like to tell you one more case which is related to a cinema hall. Many times you have also faced

That cinema hall doesn't allow you to take outside Food inside
[271]
and sometimes they don't even allow outside Water bottles to take inside too
[276]
Similar cases of Vijay Gopal living in Hyderabad.

In 2016 Vijay Gopal was going to watch a movie in the INOX theatre
[284]
When the security said to him that you have to keep outside the water bottle you brought
[290]
If you want to go inside and when he asked why so? Then he said it's our company policy
[295]
We don't allow means we don't allow. So Vijay Kumar went inside leaving the water bottle outside
[301]
When he came outside in interval he tried to ask management staff for the document in which
[307]
it is written their company policy that we don't allow outside Water bottles inside
[313]
they didn't have any such document and that same bottle was sold inside the cinema hall for 50 rupees
[319]
Which is more than its MRP. So Vijay Gopal filed a complaint in consumer court
[323]
When consumer court sought clarification from Inox, they wrote that

We do not allow outside food and water bottle because it threatens the security of the cinema hall.

They said that by mixing minerals like sodium or potassium in water can cause fire smoke
[340]
And if the fire smoke is created there, it can lead to stampede and security can be breached.
[345]
As a result, those who have to eat we encourage them to buy it inside the movie theatre
[351]
But on buying from inside the water bottle is sold expensive than the MRP.

So consumer court gave two decisions.

1st, all the movie theatres should provide free water service to their viewers.
[364]
They can't force anyone to buy a water bottle for the money
[369]
2nd is that they cannot sell water bottle above the MRP because it is considered an unfair trade practice

and Vijay Gopal who filed the case was given 5000 as compensation for mental agony
[382]
and 1000 for litigation charges was also given means he got 6000 rupees.

With this one more important point I would like to tell you

In 2017 Supreme Court decided that hotels and restaurants, bottled water and other prepacked materials,

Can sell above the MRP because they are not only selling the product but also providing you service.

Because no person goes to a hotel just to buy water so there is always an element of service involved
[412]
It is considered as a composite transaction not just goods are sold but services too
[417]
So selling above the MRP is legal

By telling you all these cases I want to encourage you that

if you ever experience such unfair trade practice in your life

Which is very negligible it is possible that you will ignore it but you should not

You have to file a complaint in consumer court
